    it's done an amazing job over there

    tonight we're really talking about the

    the architectural work
  • 5:09 - 5:16
    I I'm not quite sure there's a whole lot
  • 5:13 - 5:20
    I can do about it but Scott and Jeff in
  • 5:16 - 5:22
    particular I would just like to see us
  • 5:20 - 5:24
    find a way to streamline this it's my
  • 5:22 - 5:27
    understanding as I look at the designs
  • 5:24 - 5:28
    which the blue letter rightfully points
  • 5:27 - 5:30
    out that we've done most of the design
  • 5:28 - 5:33
    work we've done the conceptual stuff
  • 5:30 - 5:36
    we've there's pictures of it in there
  • 5:33 - 5:39
    but even with all that and the fact that
  • 5:36 - 5:40
    we've done something identical on many
  • 5:39 - 5:42
    blocks already in the corridor we're
  • 5:40 - 5:44
    spending another five hundred and
  • 5:42 - 5:48
    twenty-five thousand dollars to design
  • 5:44 - 5:51
    the next section and I have voiced this
  • 5:48 - 5:53
    not just about Ingersoll but many other
  • 5:51 - 5:56
    places I just think it's in the best
  • 5:53 - 5:58
    interest of our taxpayers to streamline
  • 5:56 - 6:00
    the conceptual designs that we might
  • 5:58 - 6:02
    spend for streetscape there might be
  • 6:00 - 6:05
    little tweaks we can do to make it
  • 6:02 - 6:09
    unique around the community but you know
  • 6:05 - 6:12
    this is gonna we're gonna have millions
  • 6:09 - 6:16
    of dollars on the Ingersoll streetscape
  • 6:12 - 6:18
    in just architectural fees and it seems
  • 6:16 - 6:22
    to me that it's just not that
  • 6:18 - 6:25
    complicated especially when we're
  • 6:22 - 6:30
    replicating what we've done for blocks
  • 6:25 - 6:37
    the rest of the way so that's that's my
  • 6:30 - 6:39
    primary frustration and concern it it
  • 6:37 - 6:42
    just seems repetitive and a bad use of
  • 6:39 - 6:45
    money and I wish we would have written
  • 6:42 - 6:49
    the specs to kind of build off of what
  • 6:45 - 6:51
    was done already I mean the blue letter
  • 6:49 - 6:55
    includes the design stuff I'm not really
  • 6:51 - 6:57
    quite sure what it is that we're getting
  • 6:55 - 6:59
    for the next five hundred thousand
  • 6:57 - 7:03
    dollars its manager would you want to
  • 6:59 - 7:05
    touch on that yeah I can answer to some
  • 7:03 - 7:08
    of that and pull up staff as well as as
  • 7:05 - 7:10
    they come up there are some elements of
  • 7:08 - 7:12
    the design that are different with
  • 7:10 - 7:16
    bump-outs in particular which you don't
  • 7:12 - 7:19
    often see in some other portions but a
  • 7:16 - 7:21
    lot of times that design has to be
  • 7:19 - 7:23
    specific to the site with the other
  • 7:21 - 7:27
    utilities the
  • 7:23 - 7:30
    right away constraints that are that are
  • 7:27 - 7:32
    specific to the segments that we're
  • 7:30 - 7:34
    looking at now that doesn't account
  • 7:32 - 7:35
    obviously for the full amount but you
  • 7:34 - 7:38
    can't just simply say I want the same
  • 7:35 - 7:41
    thing as what's on this block or that
  • 7:38 - 7:44
    block and not still have to design it
  • 7:41 - 7:48
    out for what the actual construction
  • 7:44 - 7:51
    specs would require to build that's a
  • 7:48 - 7:52
    good segue to it let's Steve thank you

    the the drawing that you included that I

    included in the council communication is

    a a concept not to read it but it's

    basically a pretty drawing it's just a
  • 8:06 - 8:11
    surface drawing what would this what

    this engineering services contract
  • 8:11 - 8:16
    includes is actually that detailed
  • 8:13 - 8:18
    design the sake of actually putting
  • 8:16 - 8:20
    elevations to those curves actual
  • 8:18 - 8:22
    dimensions designing the stormwater
  • 8:20 - 8:23
    drainage so that you can actually when
  • 8:22 - 8:25
    you add these bump outs and change the
  • 8:23 - 8:27
    curb lines you can make them drain
  • 8:25 - 8:30
    that's designing the actual
  • 8:27 - 8:32
    reconstruction of the roadway photo
  • 8:30 - 8:34
    metrics for lighting it's it's it's the
  • 8:32 - 8:35
    actual detailed design so all that's
  • 8:34 - 8:39
    been done to date to be honest this is a
  • 8:35 - 8:42
    conceptual estimate of what the
  • 8:39 - 8:43
    geometrics could look like so and then
  • 8:42 - 8:46
    they also put the contract
  • 8:43 - 8:48
    specifications bid items they calculate
  • 8:46 - 8:51
    all the quantities that that the
  • 8:48 - 8:53
    contractors use to develop their bids
  • 8:51 - 8:56
    and so none of that work has been done
  • 8:53 - 9:00
    this actually is for just for phase one
  • 8:56 - 9:02
    - is it comes communication States is

    this not about the ten to twelve percent
  • 9:02 - 9:09
    or even potentially less of the total

    project cost if we may so if we're

    is sixteen million we're probably

    looking at about two and a half out two

    so are we going to be able to take this

    and use it in other sections are we

    gonna every time we do a streetscape

    project we're we're we working out this

    kind we can take concepts and apply it

    out elsewhere but in terms of like

    actual elevations and how drainage works

    that it never yeah you cannot take it
  • 9:46 - 9:50
    anywhere else you you at all you would
  • 9:48 - 9:52
    need to detail out you know the grades
  • 9:50 - 9:54
    are different the utilities are
  • 9:52 - 9:56
    different in each location
  • 9:54 - 9:59
    so but in terms of like a concept or a
  • 9:56 - 10:01
    principle you could take that elsewhere
  • 9:59 - 10:04
    but but but a specific design you

    typically never use elsewhere and I
  • 10:04 - 10:08
    think one of the other things that has
  • 10:06 - 10:10
    happened is we've looked at different
  • 10:08 - 10:11
    sections of town there's certain
  • 10:10 - 10:12
    infrastructure pieces that are
  • 10:11 - 10:15
    underground that are going to be
  • 10:12 - 10:18
    affected as you mentioned the water in
  • 10:15 - 10:22
    the intakes and what are part of which
  • 10:18 - 10:25
    it was put in place over 150 years ago
  • 10:22 - 10:27
    and so we've got to you know deal with
  • 10:25 - 10:30
    that and you've got to have some pretty
  • 10:27 - 10:32
    expert opinions I think in a lot of
  • 10:30 - 10:36
    those cases especially coming down
  • 10:32 - 10:38
    Ingersoll and that area that has some
  • 10:36 - 10:41
    older infrastructure that that really
  • 10:38 - 10:42
    needs to be addressed and the other
  • 10:41 - 10:44
    thing with Street scapes again it comes
  • 10:42 - 10:45
    back a lot of its televisions when we're
  • 10:44 - 10:47
    working with the Americans with
  • 10:45 - 10:49
    Disabilities Act design guidelines your
  • 10:47 - 10:52
    sidewalks are there's requirements on
  • 10:49 - 10:54
    those sidewalks slopes and that not only
  • 10:52 - 10:56
    at the intersection ramps and corners
  • 10:54 - 10:57
    themselves at driveways and even the
  • 10:56 - 11:00
    cross slope itself when you're changing
  • 10:57 - 11:03
    that curb line those can be quite be
  • 11:00 - 11:05
    quite cumbersome I used to be the
  • 11:03 - 11:06
    streetscape diet at my previous firm and
  • 11:05 - 11:09
    have rebuilt all of downtown DeKalb's
  • 11:06 - 11:11
    eyen Glenview a number of communities
  • 11:09 - 11:13
    and and that was always a very
  • 11:11 - 11:16
    challenging Elizabeth it was detailing
  • 11:13 - 11:18
    out what those elevations could be any
  • 11:16 - 11:22
    other questions those are good points I
  • 11:18 - 11:25
    get a second question I felt this is
  • 11:22 - 11:28
    about funding I I felt like the
  • 11:25 - 11:30
    statement there I just want to make sure
  • 11:28 - 11:35
    I'm not reading too much into it it it

    said that with the current increment it
  • 11:35 - 11:39
    was fully funded
  • 11:39 - 11:44
    that's God I'm kind of looking to you

    when is that is that development that's

    already happened or does that include an

    TIF from a valuation standpoint it would

    still take borrowing to get it done but

    it can be done through the the TIF

    growth that's already occurred to this
  • 12:16 - 12:23
    point and that's each of the that's each
  • 12:18 - 12:26
    of the phases in total in totality so

    the district as a whole there's I

    haven't done the analysis of

    block-by-block what growth is a clear

    recoup the cost even further yet with

    future growth and that's that's a key

    point that differs from some other TIF

    opportunities and streetscapes alright

    redoing the corner of Merle hay and

    Hickman five years later what have we

    got this this is really you know if you
  • 14:08 - 14:12
    if you look at what the intent of this
  • 14:10 - 14:14
    is it says right here the goals of these
  • 14:12 - 14:17
    improvements are to entreat increase the
  • 14:14 - 14:18
    traffic capacity and improve the safety
  • 14:17 - 14:22
    of the intersection at Merle hay road
  • 14:18 - 14:24
    and hip let me tell you what we have
  • 14:22 - 14:26
    there we have probably the worst
  • 14:24 - 14:31
    intersection in the entire city of des
  • 14:26 - 14:33
    moines a five-way intersection this
  • 14:31 - 14:36
    doesn't make any sense and this is the
  • 14:33 - 14:38
    gate Western gateway for people coming
  • 14:36 - 14:40
    in to visit des moines I won't go into
  • 14:38 - 14:42
    signage because Windsor Heights has a
  • 14:40 - 14:43
    nice monument sign identifying their
  • 14:42 - 14:46
    territory
  • 14:43 - 14:48
    bourbon Dale has a nice sign identifying
  • 14:46 - 14:49
    their territory and if it weren't for
  • 14:48 - 14:51
    the Merle hay neighborhood posting a
  • 14:49 - 14:53
    sign you wouldn't even know you're in
  • 14:51 - 14:56
    Des Moines but that's another issue that
  • 14:53 - 14:57
    we can go at but this you know if you
  • 14:56 - 15:00
    look at this inner
  • 14:57 - 15:03
    section there's only one corner that is
  • 15:00 - 15:07
    turning lights people are piled up there

    we have a letter from Jason poem Merle

    hay Neighborhood Association president

    one of his big concerns in the Myrtle in

    the whole neighborhood association is

    the fact that westbound traffic on
  • 15:16 - 15:22
    Hickman has no no left-hand turn lane at
  • 15:19 - 15:24
    all and again it comes back to this
  • 15:22 - 15:27
    eminent domain and what we need to do
  • 15:24 - 15:29
    we're already going after three separate
  • 15:27 - 15:33
    property owners for four improvements
  • 15:29 - 15:35
    but keep in mind now we have some new
  • 15:33 - 15:37
    businesses in here they're gonna warrant
  • 15:35 - 15:41
    more traffic Ivy's going to be opening
  • 15:37 - 15:44
    up one of their fresh and fast stores on
  • 15:41 - 15:47
    the northwest corner they're in this
  • 15:44 - 15:50
    spring CVS has just invested a lot of
  • 15:47 - 15:52
    money on the northeast corner there and
  • 15:50 - 15:55
    we have a new housing development up the
  • 15:52 - 15:58
    street on rural haein and Franklin I
  • 15:55 - 16:00
    keep looking at this and this can has
  • 15:58 - 16:04
    been kicked down the road
  • 16:00 - 16:06
    way too long we missed when CVS was
  • 16:04 - 16:07
    built as we could have taken part of
  • 16:06 - 16:11
    that property and put a turn lane in
  • 16:07 - 16:12
    which shows not to IVs going to be doing
  • 16:11 - 16:14
    some stuff but we're going to put in a
  • 16:12 - 16:17
    left-hand two left-hand turning lane
  • 16:14 - 16:19
    it's not take into account that crazy
  • 16:17 - 16:21
    corner where people can just drive in
  • 16:19 - 16:24
    and make a complete turn without having
  • 16:21 - 16:27
    to stop this is if this intersection is
  • 16:24 - 16:29
    atrociously designed it's not conducive
  • 16:27 - 16:31
    to the betterment of the neighborhood
  • 16:29 - 16:35
    nor the City of Des Moines
  • 16:31 - 16:38
    also that's its state highway highway 28

    roars up through there I did talk to
  • 16:38 - 16:43
    engineering at one time about the path
  • 16:40 - 16:45
    white why it was this crazy design set
  • 16:43 - 16:48
    up and some were in the fifties the
  • 16:45 - 16:51
    concept came well we're gonna make Merle
  • 16:48 - 16:53
    hay road a six-lane superhighway and
  • 16:51 - 16:57
    then we're going to bend all the traffic
  • 16:53 - 16:59
    down murkland way which is a one-way to
  • 16:57 - 17:00
    head towards a future freeway
  • 16:59 - 17:03
    well now that stuffs ever happened and
  • 17:00 - 17:06
    Merkel away those poor people that live
  • 17:03 - 17:08
    there after coming home from downtown
  • 17:06 - 17:10
    they have to drive down probably 55th
  • 17:08 - 17:11
    get down to Hickman Road and
  • 17:10 - 17:14
    backtrack to get on berkland way so they
  • 17:11 - 17:18
    can get to their home this whole corner
  • 17:14 - 17:20
    has been a hodgepodge of patches I would
  • 17:18 - 17:22
    like to see with the backing of the
  • 17:20 - 17:24
    Merle hay Neighborhood Association I
  • 17:22 - 17:27
    want to see where we can move forward
  • 17:24 - 17:29
    and make this a corner that that the
  • 17:27 - 17:32
    city can be proud of is functionally
  • 17:29 - 17:35
    good and and meets the needs of the
  • 17:32 - 17:38
    neighborhood as well as the city so I
  • 17:35 - 17:41
    will move fifteen but added it to the
  • 17:38 - 17:43
    stipulation that I want this referred
  • 17:41 - 17:46
    back to the city manager and engineering
  • 17:43 - 17:48
    we need a target well I was just told it
  • 17:46 - 17:50
    cost too much money tell me what it is
  • 17:48 - 17:52
    we have got to have a target to go and
  • 17:50 - 17:53
    we got to work with the Neighborhood
  • 17:52 - 17:55
    Association

    I want this corner fixed before I leave

    this earth so yeah I do too but that's

    the stipulation that we refer to the

    design done let's make something that's

    functional it's going to work for our

    city and let's get a price tag on it

    that we can shoot for that moment I'd

    love to see that master plan even if we
  • 18:22 - 18:25
    have to walk away from the price tag

    because I think it can be affordable

    I think the five-way intersection has to
  • 18:27 - 18:32
    stop you and I have talked about that
  • 18:29 - 18:37

    all this in in my five minutes so I'm

    here today to talk about the issue of
  • 26:00 - 26:06
    predatory towing I want to start by just
  • 26:02 - 26:09
    orienting you to the current ordinances
  • 26:06 - 26:12
    that deal with the removal of vehicles
  • 26:09 - 26:15
    from private property in a nutshell the
  • 26:12 - 26:16
    ordinances today say that any vehicle
  • 26:15 - 26:17
    that is parked on private property
  • 26:16 - 26:19
    without the permission of the owner is
  • 26:17 - 26:22
    illegally parked and there are two ways
  • 26:19 - 26:24
    that a private property owner can handle
  • 26:22 - 26:28
    that situation
  • 26:24 - 26:33
    one is to all of them flow through
  • 26:28 - 26:37
    contacting the police department in
  • 26:33 - 26:41
    which case they can offer a citation or
  • 26:37 - 26:43
    they can have the vehicle removed and
  • 26:41 - 26:45
    impounded but again this all is done
  • 26:43 - 26:47
    through the police department the
  • 26:45 - 26:50
    Department of Public Works or the
  • 26:47 - 26:52
    Department of Community Development so
  • 26:50 - 26:56
    that's those are the current ordinances
  • 26:52 - 26:58
    in the Municipal Code in
  • 26:56 - 27:01
    des Moines that cover the removal of
  • 26:58 - 27:02
    vehicles from private property so what
  • 27:01 - 27:04
    do I mean when I talk about predatory
  • 27:02 - 27:07
    towing there's a lot of different
  • 27:04 - 27:11
    aspects to predatory towing I'm going to
  • 27:07 - 27:14
    really focus on just two of those
  • 27:11 - 27:16
    aspects so when I say predatory towing
  • 27:14 - 27:20
    I'm talking about a private
  • 27:16 - 27:22
    non-consensual tow that has either of
  • 27:20 - 27:24
    the following aspects either entrapment
  • 27:22 - 27:27
    which is concealing the intense to tow
  • 27:24 - 27:29
    or price gouging which is charging
  • 27:27 - 27:32
    significantly above market rates for
  • 27:29 - 27:34
    towing services so I say private in that
  • 27:32 - 27:37
    these would be toes that are not
  • 27:34 - 27:41
    pursuant to a citation that are not
  • 27:37 - 27:45
    ordered by either the police department
  • 27:41 - 27:48
    or the Department of Public Works and
  • 27:45 - 27:48
    they're and they're fairly common
  • 27:49 - 27:55
    obviously I have a personal story that's
  • 27:51 - 27:57
    what brings me here today so in December
  • 27:55 - 27:59
    of last year I had parked in a
  • 27:57 - 28:02
    commercial zone parking lot across the
  • 27:59 - 28:05
    street from a restaurant that I was
  • 28:02 - 28:09
    going to this parking lot is near Drake
  • 28:05 - 28:11
    University and as I pulled in I made
  • 28:09 - 28:13
    sure to check the walls check the curb
  • 28:11 - 28:15
    cuts look for signage that would
  • 28:13 - 28:20
    indicate that this was a parking lot
  • 28:15 - 28:21
    that I could not park in and went to the
  • 28:20 - 28:24
    establishment I was there for about two
  • 28:21 - 28:26
    hours when I came out and my car was
  • 28:24 - 28:29
    gone there was a tow truck there that
  • 28:26 - 28:30
    was removing another vehicle at the time
  • 28:29 - 28:34
    so I went for the tow truck driver and I
  • 28:30 - 28:36
    said oh I imagine my car got towed when
  • 28:34 - 28:37
    I pulled in I looked for a sign where's
  • 28:36 - 28:39
    the sign I don't see any sign that would
  • 28:37 - 28:41
    say this is not a place that I can park
  • 28:39 - 28:42
    and he gestured to the corner there so
  • 28:41 - 28:44
    just to orient you to the photos on the
  • 28:42 - 28:47
    screen what you're looking at is the
  • 28:44 - 28:48
    wall adjacent to the parking lot and the
  • 28:47 - 28:49
    big photo on the right you can see
  • 28:48 - 28:52
    there's kind of two parts to the wall
  • 28:49 - 28:54
    large and short bottom laughs we start
  • 28:52 - 28:56
    to zoom in a little bit more and you can
  • 28:54 - 28:58
    still see those two parts of the wall
  • 28:56 - 29:01
    and the top left you can see the sign
  • 28:58 - 29:03
    that the tow truck driver had referenced
  • 29:01 - 29:06
    that says towed vehicles can be redeemed
  • 29:03 - 29:08
    at such-and-such location so on that
  • 29:06 - 29:09
    entire wall the sign that they chose
  • 29:08 - 29:16
    supposed was that one the fair
  • 29:09 - 29:19
    for bottom right hand corner of that
  • 29:16 - 29:21
    fairly large wall so I went to the lot
  • 29:19 - 29:22
    the next morning I had a friend drive me
  • 29:21 - 29:25
    home that night my wife and my wife
  • 29:22 - 29:26
    brought me there the next day and I
  • 29:25 - 29:30
    challenged the owner and I said you know
  • 29:26 - 29:33
    I'm not sure that this is a very
  • 29:30 - 29:35
    upstanding way to conduct business they
  • 29:33 - 29:36
    basically gave me two choices you said
  • 29:35 - 29:38
    you can either pay to get your car back
  • 29:36 - 29:39
    today and take me to court feel like
  • 29:38 - 29:42
    you've been wronged to get your money
  • 29:39 - 29:44
    back or you can leave and if you don't
  • 29:42 - 29:47
    want to do either of those things I will
  • 29:44 - 29:49
    call the cops on you for trespassing
  • 29:47 - 29:51
    while I was standing there and had the
  • 29:49 - 29:53
    opportunity to see three other people
  • 29:51 - 29:55
    that were in front of me in line deal
  • 29:53 - 29:57
    with this same owner and it seemed like
  • 29:55 - 30:01
    they were in situations that were fairly
  • 29:57 - 30:06
    similar to the one that I was in towing
  • 30:01 - 30:07
    under maybe suspect conditions but what
  • 30:06 - 30:09
    was different about their interactions
  • 30:07 - 30:12
    was you know I was talking about
  • 30:09 - 30:14
    ordinances and statutes and an in due
  • 30:12 - 30:16
    process and the people in front of you
  • 30:14 - 30:18
    were talking about how they had to call
  • 30:16 - 30:20
    in to miss their shift that day because
  • 30:18 - 30:21
    they didn't have their car or how they
  • 30:20 - 30:24
    did not have the money to get their car
  • 30:21 - 30:26
    out that day so unfortunately I have a
  • 30:24 - 30:27
    salaried position it was fairly easy for
  • 30:26 - 30:30
    me to just say hey boss me to be in a
  • 30:27 - 30:33
    couple hours late while I get my car the
  • 30:30 - 30:36
    fee I had to pay was you know more of a
  • 30:33 - 30:37
    nuisance than a financial hardship
  • 30:36 - 30:41
    clearly not the case for everybody that
  • 30:37 - 30:43
    was there that day so I could very
  • 30:41 - 30:47
    easily take them to small claims courts
  • 30:43 - 30:48
    try to try to get my money back that
  • 30:47 - 30:49
    would solve my problem but this is
  • 30:48 - 30:53
    something that happens
  • 30:49 - 30:55
    dozens of times every day and that would
  • 30:53 - 30:58
    go and change the ball I did was was
  • 30:55 - 30:58
    taking the small plane sports
  • 30:58 - 31:02
    I just want to talk to this part
  • 30:59 - 31:03
    proposed ordinances so what I think we
  • 31:02 - 31:05
    could do to address this there's really
  • 31:03 - 31:08
    three things required posted signage and
  • 31:05 - 31:10
    lots it's clearly visible limit the fees
  • 31:08 - 31:12
    that can be charged and imposed
  • 31:10 - 31:15
    penalties on towing companies who
  • 31:12 - 31:16
    violate those rules this last slide that
  • 31:15 - 31:20
    I'll touch on I looked at what other
  • 31:16 - 31:22
    cities in the Midwest do to address this
  • 31:20 - 31:25
    situation and it turns out that many of
  • 31:22 - 31:27
    them have rules on the books I through
  • 31:25 - 31:30
    statute or ordinance that address these
  • 31:27 - 31:33
    three issues so there's a lot of
  • 31:30 - 31:34
    precedents to look to and they seem to
  • 31:33 - 31:37
    have found ways to effectively deal with
  • 31:34 - 31:38
    this matter so thank you for your time

    clearly do not want people to park there

    really didn't want people to park there
