Twitter Rape Victim Punished!?

  • 0:03 - 0:05
Hey! Welcome back to 20 Minutes Or Less,
  • 0:05 - 0:06
    my name is Elliot Morgan,
  • 0:06 - 0:07
    I'm Trisha Hershberger.
  • 0:07 - 0:10
So 17 year old Savannah Dietrich was sexually assaulted in 2011
  • 0:10 - 0:12
by 2 boys after she passed out from drinking at a party.
  • 0:12 - 0:14
Months after the party she learned that those 2 boys
  • 0:14 - 0:16
had taken pictures and shared them with people.
  • 0:16 - 0:19
Then news of the assault spread around her Louisville high school.
  • 0:19 - 0:20
Last month the boys who attacked her struck a plea deal.
  • 0:21 - 0:25
They plead guilty and were charged with felony sexual abuse and misdemeanor voyeurism.
  • 0:25 - 0:27
Dietrich felt this was not an appropriate punishment
  • 0:27 - 0:30
and that it amounted to a "slap on the wrist".
  • 0:30 - 0:33
Then the court added an order for the victim herself:
  • 0:33 - 0:35
don't talk about it, or go to freakin' jail.
  • 0:35 - 0:37
Because nothing sends a better message to victims of sexual assault
  • 0:37 - 0:39
than telling them not to talk about it.
  • 0:39 - 0:42
When Savannah heard this, she cried, logged onto Twitter and tweeted:
  • 0:42 - 0:43
"There you go, lock me up."
  • 0:43 - 0:46
And then proceeded to give the names of the little worthless pieces of trash,
  • 0:46 - 0:47
and then finished the tweet up with:
  • 0:47 - 0:50
"I'm not protecting anyone that made my life a living hell."
  • 0:50 - 0:53
She immediately violated the stipulation that she not say anything.
  • 0:53 - 0:56
The attacker's attorneys then asked a Jefferson District court judge
  • 0:56 - 0:59
to hold Dietrich in contempt for lashing out on Twitter.
  • 0:59 - 1:03
She could face up to 100 days in jail and a $500 fine if convicted.
  • 1:03 - 1:04
    So to summarize:
  • 1:04 - 1:06
the boys who violated this girl got to have it both ways.
  • 1:06 - 1:10
They were able to make what they did public to whoever they wanted to know,
  • 1:10 - 1:12
and then they were able to tell a court to keep it quiet.
  • 1:12 - 1:14
Dietrich stated on a note on her Facebook wall:
  • 1:14 - 1:19
"If reporting a rape only got me to the point that I'm not allowed to talk about it, then I regret it. I regret reporting it."
  • 1:19 - 1:22
But, one good thing that has come out of this
  • 1:22 - 1:25
is that Savannah recently opened her Facebook page to the public,
  • 1:25 - 1:29
allowing hundreds of random friend requests from people offering financial support
  • 1:29 - 1:30
    and petitions in her cause.
  • 1:30 - 1:32
And with her Facebook page and Twitter account,
  • 1:32 - 1:35
Savannah Dietrich gets to control what people see of her, for once.
  • 1:35 - 1:37
    It's ironic that technology,
  • 1:37 - 1:38
    which helped humiliate her previously,
  • 1:38 - 1:40
is now allowing her to put her best foot forward.
  • 1:40 - 1:44
The judge behind the ruling is named Judge Deana "Dee" McDonald.
  • 1:44 - 1:45
The defense attorneys for her rapists are
  • 1:45 - 1:48
    Chris Klein and David Mejia.
  • 1:48 - 1:50
Oh! And her rapists, the boys who decided to violate this girl
  • 1:50 - 1:52
and spread that violation throughout her highschool,
  • 1:52 - 1:53
    potentially ruining her youth,
  • 1:53 - 1:55
    their names are Will Frey
  • 1:55 - 1:57
and uh I'll spell this for you if you want to write it down,
  • 1:57 - 1:58
    that's Will, like Will,
  • 1:58 - 1:59
    and then Frey.
  • 1:59 - 2:00
    F. R. E. Y.
  • 2:00 - 2:03
And the other rapist is Austin Zehnder,
  • 2:03 - 2:04
    that's Z.E.H.N.D.E.R.
  • 2:04 - 2:06
Please do not share this information or let anyone know
  • 2:06 - 2:10
that there are two rapists in Kentucky named Will Frey and Austin Zehnder.
  • 2:10 - 2:12
Because Judge Deana McDonald doesn't want you to.
  • 2:12 - 2:14
Nor do their lawyers David Mejia and Chris Klein.
  • 2:14 - 2:15
That's David Majia and Chris Klein,
  • 2:15 - 2:17
    uh, Will Frey
  • 2:17 - 2:17
    Austin Zehnder
  • 2:17 - 2:18
    Austin Zehnder
  • 2:18 - 2:19
    and Will Frey
  • 2:19 - 2:20
    Perfect!
  • 2:20 - 2:21
Now of course there are two sides to every story.
  • 2:21 - 2:26
For example, Will Frey and Austin Zehnder "allegedly" raped Savannah Dietrich.
  • 2:26 - 2:27
    Oh! Wait. Sorry. No.
  • 2:27 - 2:31
They plead guilty, so yeah, they definitely raped her.
  • 2:31 - 2:33
The thing is it's important that we protect the identities of Will Frey and Austin Zehnder,
  • 2:33 - 2:37
because, like, this could look really bad for Will Frey and Austin Zehnder.
  • 2:37 - 2:38
    Like, real bad.
  • 2:38 - 2:40
    Cuz they're rapists.
  • 2:40 - 2:41
It's insane to me that a court system
  • 2:41 - 2:44
would allow a victim of sexual assault to be silenced.
  • 2:44 - 2:45
    That's counter to justice,
  • 2:45 - 2:48
I mean, that's counter to common sense!
  • 2:48 - 2:51
Apparently Judge Deana McDonald isn't aware of the thing called the internet,
  • 2:51 - 2:56
where names like Will Frey and Austin Zehnder can be spread very very quickly.
  • 2:56 - 2:58
I would call the judge and defense attorneys behind these actions disgusting,
  • 2:58 - 3:00
but that wouldn't be an appropriate enough word.
  • 3:00 - 3:01
    So I'll use these words:
  • 3:01 - 3:03
    WILL FREY AND AUSTIN ZEHNDER.
  • 3:03 - 3:06
Look, bottom line, in a world where half of rape victims don't say a word,
  • 3:06 - 3:09
we have a justice system that's encouraging girls to keep their mouth shut,
  • 3:09 - 3:10
    at least one specific girl.
  • 3:10 - 3:13
That's completely counter to what we need to have happen in this country.
  • 3:13 - 3:15
It's beyond offensive, it's freakin' wrong.
  • 3:15 - 3:18
So tell us what you think of Will Frey and Austin Zehnder,
  • 3:18 - 3:20
    Judge Deana McDonald
  • 3:20 - 3:22
and defense attorneys Chris Klein and David Majia
  • 3:22 - 3:23
    in the comments down below.
