The Panama Papers exposed a huge global problem. What's next?

0:21 - 0:26This week, there have been
a whole slew and deluge of stories -
0:26 - 0:29coming out from the leak
of 11 million documents -
0:29 - 0:34from a Panamanian-based law firm
called Mossack Fonseca. -
0:34 - 0:39The release of these papers from Panama
lifts the veil on a tiny piece -
0:39 - 0:42of the secretive offshore world.
-
0:42 - 0:47We get an insight into how clients
and banks and lawyers -
0:47 - 0:49go to companies like Mossack Fonseca
-
0:49 - 0:52and say, "OK, we want
an anonymous company, -
0:52 - 0:53can you give us one?"
-
0:53 - 0:55So you actually get to see the emails,
-
0:55 - 0:57you get to see the exchanges of messages,
-
0:57 - 1:00you get to see the mechanics
of how this works, -
1:00 - 1:01how this operates.

1:01 - 1:05Now, this has already started
to have pretty immediate repercussions. -
1:05 - 1:08The Prime Minister
of Iceland has resigned. -
1:08 - 1:09We've also had news
-
1:09 - 1:14that an ally of the brutal
Syrian dictator Bashar Al-Assad -
1:14 - 1:17has also got offshore companies.

1:17 - 1:22There's been allegations
of a $2 billion money trail -
1:22 - 1:26that leads back to President
Vladimir Putin of Russia -
1:26 - 1:29via his close childhood friend,
-
1:29 - 1:31who happens to be a top cellist.
-
1:31 - 1:33And there will be a lot
of rich individuals out there -
1:33 - 1:38and others who will be nervous
about the next set of stories -
1:38 - 1:40and the next set of leaked documents.
-
1:40 - 1:45Now, this sounds like the plot
of a spy thriller -
1:45 - 1:46or a John Grisham novel.
-
1:46 - 1:50It seems very distant
from you, me, ordinary people. -
1:50 - 1:53Why should we care about this?
-
1:53 - 1:57But the truth is that if rich
and powerful individuals -
1:57 - 2:00are able to keep their money offshore
-
2:00 - 2:02and not pay the taxes that they should,
-
2:02 - 2:06it means that there is less money
for vital public services -
2:06 - 2:10like healthcare, education, roads.
-
2:10 - 2:12And that affects all of us.
-
2:12 - 2:15Now, for my organization Global Witness,
-
2:15 - 2:19this exposé has been phenomenal.
-
2:19 - 2:23We have the world's media
and political leaders -
2:23 - 2:28talking about how individuals
can use offshore secrecy -
2:28 - 2:31to hide and disguise their assets --
-
2:31 - 2:35something we have been talking about
and exposing for a decade. -
2:35 - 2:40Now, I think a lot of people find
this entire world baffling and confusing, -
2:40 - 2:45and hard to understand how
this sort of offshore world works. -
2:45 - 2:47I like to think of it a bit
like a Russian doll. -
2:47 - 2:51So you can have one company
stacked inside another company, -
2:51 - 2:53stacked inside another company,
-
2:53 - 2:57making it almost impossible
to really understand -
2:57 - 3:00who is behind these structures.
-
3:00 - 3:03It can be very difficult
for law enforcement -
3:03 - 3:06or tax authorities,
journalists, civil society -
3:06 - 3:08to really understand what's going on.
-
3:08 - 3:10I also think it's interesting
-
3:10 - 3:13that there's been less coverage
of this issue in the United States. -
3:13 - 3:17And that's perhaps because
some prominent US people -
3:17 - 3:21just haven't figured
in this exposé, in this scandal. -
3:21 - 3:25Now, that's not because
there are no rich Americans -
3:25 - 3:28who are stashing their assets offshore.
-
3:28 - 3:32It's just because of the way
in which offshore works, -
3:32 - 3:35Mossack Fonseca has fewer
American clients. -
3:36 - 3:39I think if we saw leaks
from the Cayman Islands -
3:39 - 3:42or even from Delaware
or Wyoming or Nevada, -
3:42 - 3:48you would see many more cases
and examples linking back to Americans. -
3:48 - 3:54In fact, in a number of US states
you need less information, -
3:54 - 3:58you need to provide less
information to get a company -
3:58 - 4:01than you do to get a library card.
-
4:01 - 4:07That sort of secrecy in America
has allowed employees of school districts -
4:07 - 4:09to rip off schoolchildren.
-
4:09 - 4:14It has allowed scammers
to rip off vulnerable investors. -
4:14 - 4:18This is the sort of behavior
that affects all of us. -
4:18 - 4:20Now, at Global Witness,
-
4:20 - 4:23we wanted to see what this
actually looked like in practice. -
4:23 - 4:26How does this actually work?
-
4:26 - 4:27So what we did
-
4:27 - 4:33is we sent in an undercover investigator
to 13 Manhattan law firms. -
4:34 - 4:38Our investigator posed
as an African minister -
4:38 - 4:42who wanted to move suspect funds
into the United States -
4:42 - 4:45to buy a house, a yacht, a jet.
-
4:45 - 4:50Now, what was truly shocking
was that all but one of those lawyers -
4:50 - 4:55provided our investigator with suggestions
-
4:55 - 4:57on how to move those suspect funds.
-
4:57 - 4:59These were all preliminary meetings,
-
4:59 - 5:01and none of the lawyers
took us on as a client -
5:01 - 5:03and of course no money moved hands,
-
5:03 - 5:07but it really shows the problem
with the system. -
5:07 - 5:09It's also important
-
5:09 - 5:12to not just think about this
as individual cases. -
5:12 - 5:14This is not just about
an individual lawyer -
5:14 - 5:18who's spoken to our undercover
investigator and provided suggestions. -
5:18 - 5:21It's not just about
a particular senior politician -
5:21 - 5:23who's been caught up in a scandal.
-
5:23 - 5:26This is about how a system works,
-
5:26 - 5:32that entrenches corruption,
tax evasion, poverty and instability. -
5:32 - 5:34And in order to tackle this,
-
5:34 - 5:35we need to change the game.
-
5:35 - 5:38We need to change the rules of the game
-
5:38 - 5:40to make this sort of behavior harder.
-
5:40 - 5:43This may seem like doom and gloom,
-
5:43 - 5:45like there's nothing we can do about it,
-
5:45 - 5:47like nothing has ever changed,
-
5:47 - 5:50like there will always be rich
and powerful individuals. -
5:50 - 5:52But as a natural optimist,
-
5:52 - 5:56I do see that we are starting
to get some change. -
5:56 - 5:58Over the last couple of years,
-
5:58 - 6:01we've seen a real push towards
greater transparency -
6:02 - 6:03when it comes to company ownership.
-
6:04 - 6:06This issue was put on the political agenda
-
6:06 - 6:09by the UK Prime Minister David Cameron
-
6:09 - 6:13at a big G8 Summit that was held
in Northern Ireland in 2013. -
6:14 - 6:18And since then, the European Union
is going to be creating -
6:18 - 6:20central registers at a national level
-
6:20 - 6:24of who really owns and controls
companies across Europe. -
6:24 - 6:29One of the things that is sad is that,
actually, the US is lagging behind. -
6:29 - 6:32There's bipartisan legislation
that had been introduced -
6:32 - 6:34in the House and the Senate,
-
6:34 - 6:37but it isn't making as much progress
as we'd like to see. -
6:37 - 6:40So we'd really want to see
the Panama leaks, -
6:40 - 6:44this huge peek into the offshore world,
-
6:44 - 6:49be used as a way of opening up
in the US and around the world. -
6:49 - 6:54For us at Global Witness,
this is a moment for change. -
6:54 - 6:58We need ordinary people to get angry
-
6:58 - 7:01at the way in which people
can hide their identity -
7:01 - 7:03behind secret companies.

7:03 - 7:07We need business leaders
to stand up and say, -
7:07 - 7:10"Secrecy like this is not
good for business." -
7:10 - 7:14We need political leaders
to recognize the problem, -
7:14 - 7:19and to commit to changing the law
to open up this sort of secrecy. -
7:20 - 7:23Together, we can end the secrecy

7:23 - 7:26that is currently allowing tax evasion,
-
7:26 - 7:29corruption, money laundering to flourish.
