    And I have been working in disability rights
  • 0:23 - 0:26
    For my whole adult life,
  • 0:26 - 0:32
    And actually, since I was a freshman in high school
  • 0:32 - 0:42
    I am currently the executive director and CEO of the World Institute on Disability
  • 0:43 - 0:53
    And I have been working over the years in services
  • 0:53 - 0:59
    for people living in residential programs early
  • 0:59 - 1:05
    in my career with people in,
  • 1:06 - 1:08
    Children in school settings,
  • 1:10 - 1:14
    people in vocational rehabilitation,
  • 1:15 - 1:23
    and then people in community living environments,
  • 1:23 - 1:30
    then along the way, I became very involved in disability rights
  • 1:31 - 1:41
    and very involved in the early days of advocacy
  • 1:41 - 1:45
    before the ADA was introduced.
  • 1:46 - 1:55
    And then I worked for disability advocacy organizations almost ever since.

    In addition to my own disability,
  • 1:58 - 2:03
    I'm also the parent of two now adults with
  • 2:03 - 2:09
    disabilities. My husband also has a disability,
  • 2:09 - 2:17
    and much of my family also happen to be people with disabilities
  • 2:17 - 2:27
    so disability rights is just a part of everything I am and most everything I do.

    I did spend from 2001 and onward focusing very much
  • 2:41 - 2:44
    on what happens for people with disabilities
  • 2:45 - 2:47
    before, during, and after disasters.
  • 2:47 - 2:54
    And that's been a real particular laser focus of mine ever since,
  • 2:55 - 2:57
    and in fact, I've had the opportunity
  • 2:58 - 3:02
    as an appointee in the Obama administration
  • 3:02 - 3:08
    to spend just about 8 years at FEMA,
  • 3:09 - 3:14
    establishing FEMA's Office of Disability Integration Coordination,
  • 3:14 - 3:23
    and building a cadre of disability experts
  • 3:23 - 3:27
    focusing on supporting governors
  • 3:27 - 3:35
    and emergency managers and most particularly
  • 3:35 - 3:39
    engaging people with disabilities and disability organizations
  • 3:39 - 3:42
    in emergency preparedness
  • 3:43 - 3:47
    and throughout disaster response recover and mitigation.
  • 3:48 - 3:54
    So one last piece since I've been with
  • 3:54 - 3:59
    the World Institute on Disabilities since last September,

    my ongoing focus on global disability rights

    has really been something that I've had

    much more opportunity to be actively

    involved in and I have spent the time since joining
  • 4:26 - 4:32
    with building a strategic planning process
  • 4:32 - 4:43
    and supporting the organization to establish new priorities

    taking a look at the organizations mission
  • 4:47 - 4:54
    and very recently establishing four particular areas of focus

    for the organization as we move forward.

    So tell your first memory realizing that there were

    accessibility issues, discrimination, or lack of inclusion.

    I first became aware of disability at a very young age.
  • 5:56 - 6:02
    I had a best friend in first grade, his name was Gregory,
  • 6:02 - 6:10
    and he and I were just wonderful friends
  • 6:10 - 6:13
    We spent a lot of time together, and then
  • 6:13 - 6:16
    all of the sudden one day, Gregory was gone,
  • 6:17 - 6:24
    and I didn't know what happened to him or where he went
  • 6:24 - 6:27
    and it wasn't until many years later
  • 6:27 - 6:33
    that I found out that Gregory had Down Syndrome,
  • 6:33 - 6:37
    and he had been removed from my Kindergarten class,
  • 6:37 - 6:40
    and first grade I think it was at that point,
  • 6:41 - 6:47
    and apparently he had been sent to some other school somewhere.
  • 6:48 - 6:58
    And the loss of his friendship was pretty surprising
  • 6:59 - 7:04
    and I didn't understand, you know, where he went.
  • 7:05 - 7:10
    Looking back on it it's kind of peculiar that we didn't get to still be friends
  • 7:10 - 7:15
    cause he didn't move away, he just stopped going to my school.
  • 7:16 - 7:20
    But, I...
  • 7:22 - 7:32
    I remember just being confused and then over the next number of years,
  • 7:33 - 7:41
    I lived in a town that was also the home of Save the Children.
  • 7:41 - 7:47
    And I was always very interested in the work
  • 7:47 - 7:51
    that Save the Children was doing, and I am
  • 7:52 - 7:55
    embarrassed to admit that my earliest
  • 7:56 - 8:07
    involvement in humanitarian work was from a, you know a very charity-model approach.
  • 8:08 - 8:14
    I spent a lot of my childhood raising
  • 8:14 - 8:18
    money for Save the Children, and getting
  • 8:18 - 8:26
    involved in other activities that were very
  • 8:26 - 8:35
    much following the charity-pity model and certainly not a model
  • 8:40 - 8:46
    of making space for and supporting and lifting up
  • 8:47 - 8:50
    other people with disabilities.
  • 8:52 - 8:59
    The on set of my disability wasn't until many years later,
  • 8:59 - 9:03
    but when I was in high school, I had a
  • 9:05 - 9:17
    requirement to do community service and I
  • 9:17 - 9:21
    had an opportunity to do, had an obligation
  • 9:22 - 9:24
    to do community service and we started off.
  • 9:25 - 9:30
    This was the year of the first Earth Day
  • 9:30 - 9:34
    and I started crushing glass at the local
  • 9:34 - 9:38
    recycling center. It turned out that it
  • 9:38 - 9:45
    was really boring but lots of my classmates
  • 9:45 - 9:52
    were volunteering at a state institution
  • 9:52 - 9:59
    for people with disabilities and I joined them
  • 9:59 - 10:06
    once a week, looking back on it again it was
  • 10:06 - 10:11
    pretty shocking at 13 years old I was
  • 10:11 - 10:15
    assigned as the teacher of a classroom
  • 10:15 - 10:18
    of 30 adults who had never had the
  • 10:18 - 10:23
    opportunity to attend school and now had
  • 10:23 - 10:27
    a 13 year old teacher once a week.
  • 10:28 - 10:32
    Needless to say, I learned way more from them
  • 10:32 - 10:36
    then they learned from me, but we had a lot of fun
  • 10:36 - 10:47
    and many of them became friends, you know, very much along the rest of my path.
  • 10:48 - 10:52
    Unfortunately, some of them are no longer alive
  • 10:52 - 10:56
    but there are a couple of people who are
  • 10:56 - 11:00
    still very much apart of my life, and
  • 11:01 - 11:06
    fortunately they were successful in
  • 11:06 - 11:09
    liberating themselves from that state
  • 11:09 - 11:14
    institution and so, they and many others
  • 11:14 - 11:21
    taught me a lot but the real pivotal
  • 11:21 - 11:26
    experience for me, I was working back at
  • 11:26 - 11:32
    that state institution. This was my first paid job
  • 11:33 - 11:36
    in disability services and I had been
  • 11:36 - 11:42
    hired to work in what was called a cottage, for
  • 11:42 - 11:46
    40 women with intellectual disabilities.
  • 11:46 - 11:54
    This cottage was on beautiful ground, but
  • 11:54 - 11:57
    the women lived in a building with 20 on
  • 11:57 - 11:59
    one side and 20 on the other side.
  • 12:00 - 12:04
    My responsibilities included assisting them
  • 12:05 - 12:10
    in bathing and getting dressed and eating
  • 12:10 - 12:17
    many of them were unable to feed themselves
  • 12:20 - 12:22
    some because they never been given
  • 12:22 - 12:24
    the opportunity and others because of
  • 12:24 - 12:28
    their physical disability and a lack of any
  • 12:28 - 12:40
    supportive or adaptive utensils or other equipment,
  • 12:40 - 12:49
    so as I was feeding people it was the same every day.
  • 12:49 - 12:58
    A plate would come out and there were 3 mounds of food on the plate. One mound was always brown
  • 12:58 - 13:00
    One mound was always green
  • 13:00 - 13:07
    One mound was always white, you know the meat
  • 13:07 - 13:18
    the vegetable, and the starch, and I know that
  • 13:18 - 13:24
    people like to eat their meals different ways, there would
  • 13:24 - 13:31
    also be a dessert everyday, a jello, ice cream again in a mound.
  • 13:31 - 13:40
    I would spend time with each of the individuals
  • 13:40 - 13:47
    who were having their meal, and would sort of be kind of working
  • 13:47 - 13:50
    together trying to figure out, did they
  • 13:50 - 13:55
    prefer to eat their desert first?
  • 13:55 - 13:59
    And people like to do that, did they prefer
  • 13:59 - 14:02
    a little bit of brown and a little bit of white
  • 14:02 - 14:04
    all on the same fork? Did they not want
  • 14:04 - 14:09
    them touching, and you know I would sort of
  • 14:09 - 14:11
    work back and forth with them to try to
  • 14:11 - 14:15
    figure out what their preference was and
  • 14:15 - 14:18
    I got in trouble because I was spending
  • 14:18 - 14:26
    to much time and ultimately, I was moved
  • 14:26 - 14:31
    to a different position because I was taking
  • 14:31 - 14:33
    to much time giving people and
  • 14:33 - 14:37
    opportunity to make some choices and
  • 14:37 - 14:42
    express some preferences. That was extremely
  • 14:42 - 14:47
    pivotal and in many ways, you know, those early
  • 14:47 - 14:57
    early experiences, have really, totally driven who I am
  • 14:57 - 15:01
    and what I believe all of these years later.

    In terms of the American's with Disabilities Act
  • 15:07 - 15:13
    I had very close personal experience with
  • 15:13 - 15:19
    what was then called public law 94142:
  • 15:19 - 15:24
    The Education of All Handicaps Act,
  • 15:24 - 15:28
    later on renamed The Individuals with
  • 15:28 - 15:33
    Disabilities Act, IDEA and I had a very personal
  • 15:33 - 15:39
    family experience with IDEA and became aware
  • 15:39 - 15:49
    of legislative initiatives, and how the IDEA had just been passed.
  • 15:49 - 15:58
    Then I started to become more aware of the work
  • 15:58 - 16:03
    being done, this was back int he 70's. Working
  • 16:03 - 16:11
    being done on some other legislative initatives, the 504
  • 16:11 - 16:20
    The Passage of Rehabilitation Act, followed by the 504
  • 16:20 - 16:25
    sit-in in San Francisco to get the
  • 16:25 - 16:33
    regulations put in place. That really caught my attention,
  • 16:33 - 16:42
    between the little bits of information I was getting there
  • 16:42 - 16:50
    and the work I was doing and then becoming a full time
  • 16:50 - 16:53
    advocate, going to work for an independent
  • 16:53 - 17:00
    living center in 1982, I then became extremely
  • 17:00 - 17:10
    involved in systems change and how to develop
  • 17:10 - 17:14
    policy, how to organize, how to support
  • 17:14 - 17:21
    the rights, voices and preferences of other
  • 17:21 - 17:28
    people and because I lived in Connecticut and the
  • 17:28 - 17:33
    original author of the American's with
  • 17:33 - 17:36
    Disabilities Act, the first time the bill
  • 17:36 - 17:39
    was introduced was senator Will Weiker
  • 17:39 - 17:45
    of Connecticut and Senator Weiker, father
  • 17:45 - 17:51
    of a great young man who had Down Syndrome
  • 17:51 - 17:59
    Senator Welker was very involved with
  • 17:59 - 18:04
    the disability advocacy community in Connecticut
  • 18:04 - 18:10
    and I then had the incredible opportunity to
  • 18:10 - 18:16
    go to Boston and testify and on of the
  • 18:16 - 18:23
    Congressman Major Owens field of hearings
  • 18:23 - 18:26
    on the American's with Disabilities Act so
  • 18:26 - 18:30
    of course that first time around the bill
  • 18:30 - 18:37
    didn't pass. But boy oh boy, were we revved up
  • 18:37 - 18:47
    in the passage of the ADA, in the period of which
  • 18:47 - 18:50
    once the bill was reintroduced
  • 18:50 - 18:56
    and folks were organizing, I remember that we had
  • 18:56 - 19:02
    stacks and stacks and stacks of bright pink
  • 19:02 - 19:09
    post cards, and we were organizing folks across the state
  • 19:09 - 19:16
    to develop, to sign those post cards supporting
  • 19:16 - 19:27
    passage of the ADA and then, this was sort
  • 19:27 - 19:33
    of a wonderful but maybe a miss leading experience
  • 19:33 - 19:37
    we actually were successful! The bill got
  • 19:37 - 19:44
    passed, I remember thinking oh well this wasn't that hard,
  • 19:44 - 19:49
    we had to go at it twice but this wasn't so hard!
  • 19:49 - 19:52
    Let's take on some more legislation. So
  • 19:52 - 19:58
    turns out it wasn't as easy as it looked to me
  • 19:58 - 20:05
    It wasn't just about hot pink post cards, and meetings, and marches
  • 20:05 - 20:10
    that all helped but even that sometimes
  • 20:10 - 20:18
    these days doesn't seem to be enough to change policy.
  • 20:18 - 20:29
    That's my earliest journey to 1990.
  • 20:30 - 20:34

    The present, the future and the call to

    action, so just to pace yourself within those

    So the present, has the ADA made a difference?

    Tell us about your "Aha" moment that told you

    that the ADA is or is not making a difference
  • 20:59 - 21:02
    and to what extent based on your passions

    and area of expertise, where you see or
  • 21:05 - 21:08
    not see the impact of the ADA.

    So the ADA has had a huge and sweeping impact
  • 21:19 - 21:27
    and I... Its important for me to begin as I talk about
  • 21:27 - 21:32
    the present day as were embarking on ADA 30.
  • 21:32 - 21:37
    Its really important to start with, how
  • 21:37 - 21:47
    much things absolutely have changed, and certainly some
  • 21:47 - 21:51
    of the architectural barrier removal efforts
  • 21:51 - 21:56
    some of the significant improvements in
  • 21:56 - 22:01
    effective, equally effective communication
  • 22:01 - 22:05
    some of the requirements around programs
  • 22:05 - 22:14
    All of those have significantly changed
  • 22:14 - 22:19
    most, I can't even say most of the time... often.
  • 22:19 - 22:22
    There have been many great initiatives
  • 22:22 - 22:30
    over the years, but we always had to
  • 22:30 - 22:38
    maintain a relentless battle to, to not let
  • 22:38 - 22:44
    anything slip, to not lose and sort of momentum,
  • 22:44 - 22:54
    towards accessibility. If we look away for
  • 22:54 - 22:58
    a minute, our rights will be swept away
  • 22:58 - 23:02
    from us, I can certainly talk about the
  • 23:02 - 23:10
    very present day, and what I have to say
  • 23:10 - 23:16
    about where we are today, is not
  • 23:16 - 23:20
    great, so I do want to take a little bit
  • 23:20 - 23:25
    more time to call out the significant
  • 23:25 - 23:37
    progress in so many aspects of daily life,
  • 23:37 - 23:47
    in which we can call out failures of ADA
  • 23:47 - 23:53
    compliance, enforcement of the law.
  • 23:53 - 24:02
    But it is often times in comparison to
  • 24:02 - 24:06
    the examples of where it's working.
  • 24:06 - 24:10
    So when transportation is not accessible
  • 24:10 - 24:18
    we're calling it out because we know the
  • 24:18 - 24:23
    good and the promising practices that have
  • 24:23 - 24:28
    been in place for transportation accesabilty
  • 24:28 - 24:35
    Make the failures so much more egregious.
  • 24:35 - 24:42
    In housing, in employment, in the kinds
  • 24:42 - 24:49
    of assistive devices that are available
  • 24:49 - 24:56
    the universal design of places and things,
  • 24:56 - 25:09
    all of that points to the examples of where
  • 25:09 - 25:14
    we are getting it right, In stark contrast
  • 25:14 - 25:18
    the areas where we are getting it egreigously
  • 25:18 - 25:22
    getting it wrong. I have to say that
  • 25:22 - 25:35
    just very recently, I have lead my
  • 25:35 - 25:41
    organization involvement in a petition to
  • 25:41 - 25:45
    the U.S Department of Health and Human
  • 25:45 - 25:49
    Services, demanding that people with
  • 25:49 - 25:53
    disabilities be immediately located
  • 25:53 - 25:59
    out of nursing homes and other congregate
  • 25:59 - 26:08
    settings due to the horrific circumstances
  • 26:08 - 26:15
    in those congregate settings, to Covid-19
  • 26:15 - 26:22
    and the failure to provide appropriate
  • 26:22 - 26:26
    protections for people with disabilities
  • 26:26 - 26:35
    and institutional settings. The ADA back in 1990
  • 26:35 - 26:42
    very clearly gave people with disabilities
  • 26:42 - 26:53
    significant rights, and even when
  • 26:53 - 27:07
    challenged in 1999, the homestead case
  • 27:07 - 27:13
    which was a Georgia case, and two women
  • 27:13 - 27:19
    who Lois and Elaine, Lois Curtis an
  • 27:19 - 27:21
    incredible woman, I have had the
  • 27:21 - 27:25
    pleasure of being with on a number of
  • 27:25 - 27:33
    occasions. The two of them demanded that
  • 27:33 - 27:37
    they had a right to live in the most intergraded
  • 27:37 - 27:40
    setting appropriate to their needs.
  • 27:40 - 27:46
    The decision, the case went all the way to
  • 27:46 - 27:53
    the Supreme Court, and I was among
  • 27:53 - 27:57
    those who slept out on the steps of
  • 27:57 - 28:00
    the Supreme Court on the night before
  • 28:00 - 28:04
    their case was heard. I was among the
  • 28:04 - 28:08
    folks who celebrated out in front of the
  • 28:08 - 28:11
    Supreme Court on the day that decision
  • 28:11 - 28:15
    came down in favor of Lois and Elaine
  • 28:15 - 28:19
    right and the rights of thousands, tens of
  • 28:19 - 28:23
    thousands, millions of people with
  • 28:23 - 28:28
    disabilities to be, to live in the most
  • 28:28 - 28:30
    intergraded setting appropriate to their
  • 28:30 - 28:36
    needs. Given that we are 21 years after
  • 28:36 - 28:41
    that decision, yesterday the American
  • 28:41 - 28:46
    Civil Liberties Union submitted a petition
  • 28:46 - 28:49
    and the World Institute on Disability joined
  • 28:49 - 28:53
    a number of disability organizations
  • 28:53 - 28:59
    in a bringing that petition, demanding
  • 28:59 - 29:04
    that people with disabilities be immediately
  • 29:04 - 29:10
    relocated out of these congregate settings.
  • 29:10 - 29:15
    Tens of thousands of people have died
  • 29:15 - 29:20
    in the last hundred days, the genocide of
  • 29:20 - 29:24
    people with disabilities because of the
  • 29:24 - 29:28
    failures of implementation of that
  • 29:28 - 29:34
    homestead decision and the failures of our
  • 29:34 - 29:40
    government to provide that kind of support
  • 29:40 - 29:44
    and services that enable people with disabilities
  • 29:44 - 29:49
    to live safely and and with the support
  • 29:49 - 29:51
    they need in place in the community,
  • 29:51 - 30:03
    very infuriatingly, our continued persistent
  • 30:03 - 30:09
    call for people with disabilities to be
  • 30:09 - 30:15
    adequately served in these disasters
  • 30:15 - 30:19
    have been ignored and the bottom line
  • 30:19 - 30:26
    has been that again, over the last hundred days
  • 30:26 - 30:30
    tens of thousands of people with disabilities
  • 30:30 - 30:33
    have died, and when I was called on
  • 30:33 - 30:37
    saying that those were people with disabilities
  • 30:37 - 30:40
    I have had conversations with a number of
  • 30:40 - 30:44
    senior government officials who,
  • 30:44 - 30:49
    "why are you saying people with disabilities"
  • 30:49 - 30:56
    these were old people with underlying conditions
  • 30:56 - 31:01
    living in nursing homes, and long term care
  • 31:01 - 31:04
    facilities, look you don't go to a nursing home
  • 31:04 - 31:07
    because you are old. You go to a nursing home because
  • 31:07 - 31:09
    you have a disability and the supports and
  • 31:09 - 31:13
    services you need to stay in the community
  • 31:13 - 31:17
    have not been given to you, and that majority
  • 31:17 - 31:23
    of some would say of all those deaths in
  • 31:23 - 31:27
    congregate facilites are people with disabilities.
  • 31:27 - 31:33
    Most of them black and brown and people
  • 31:33 - 31:40
    living in poverty, and the failures of
  • 31:40 - 31:46
    American's with Disabilities Act, the homestead decision and
  • 31:46 - 31:53
    our governments will to monitor and force
  • 31:53 - 31:58
    this law and the rehabilitation act have a
  • 31:58 - 32:03
    devastating impact on where we are today
  • 32:03 - 32:07
    and the depth of many of our siblings,
  • 32:07 - 32:10
    Without out end in sight.

    future. With the work you have been doing

    you have seen a lot in terms of progress and barriers.

    If you could pick one thing to change or that needs
  • 32:26 - 32:28
    to occur to have access and equality,
  • 32:28 - 32:32
    I know that is hard, one thing. To have
  • 32:32 - 32:34
    access and equality present in the lives
  • 32:34 - 32:38
    of people with disabilities, what would that be?
  • 32:38 - 32:45
    The one thing that must happen
  • 32:45 - 32:50
    people with disabilities have civil rights
  • 32:50 - 32:57
    protections by law. The one thing that must happen
  • 32:57 - 33:05
    is that their rights are monitored and enforced
  • 33:05 - 33:12
    without exception. Following the law is not
  • 33:12 - 33:18
    enough, we need universal designs to be
  • 33:18 - 33:22
    the standard, we need accessibility
  • 33:22 - 33:27
    and the accommodation to be readily available.
  • 33:27 - 33:34
    But we must have monitoring and enforcement.
  • 33:34 - 33:39
    Every federal dollar is supposed to be
  • 33:39 - 33:41
    spent in compliance with the rehabilitation act
  • 33:41 - 33:47
    and between the rehab act and what the ADA require.
  • 33:47 - 33:55
    There should be no room for people with
  • 33:55 - 34:00
    those civil rights protections to be repeatedly denied
  • 34:00 - 34:10
    and unable to fully participate in home
  • 34:10 - 34:16
    and community life. Monitoring and enforcement
  • 34:16 - 34:26
    must be the floor, the ceiling. But enforcing
  • 34:26 - 34:30
    these civil rights laws is absolutely
  • 34:30 - 34:32
    the floor. Thank you

    So what can we do? What steps can we as community members

    take right now?
  • 34:38 - 34:43
    So what we can do right now is
  • 34:43 - 34:47
    one of my favorite sayings is

    "never give up, never give in"

    continue relentlessly to work towards

    the realization of the goal that the ADA

    was written around and so many

    of our siblings have fought so very hard

    for, we've lost a bunch of those hard working

    visionary leaders, many of them have been

    lost in recent years, some have been lost

    along the way. We have an incredible

    legacy to care for, we have huge

    opportunities to work towards. Technology

    has the potential of leveling the
  • 37:04 - 37:08
    playing field if in fact people have real access
  • 37:08 - 37:14
    and the World Institute on Disability
  • 37:14 - 37:18
    and our commitment to work in partnership

    with other disability lead organizations and our allies

    to make communities stronger, more resilient for

    the whole community. When we get it right

    for people with disabilities, I think the

    whole community not only benefits is stronger

    for our leadership, our contributions,

    our expertise in what it takes to make daily life

    work for everybody.
