Hi there, I’m Marcie Roth
And I have been working in
disability rights
For my whole adult life,
And actually, since I was a
freshman in high school.
I am currently the executive director and
CEO of the World Institute on Disability
And I have been working over the years in services
for people living in residential programs early
in my career with people in,
children in school settings,
people in vocational rehabilitation,
and then people in community living environments,
that along the way, I became very involved in disability rights
and very involved in the early days of advocacy
before the ADA was introduced.
And then I worked for disability advocacy organizations almost ever since.
In addition to my own disability,
I’m also the parent of two
now adults with disabilities.
My husband also has a disability,
and much of my family also happen to be people with disabilities
so disability rights is just a part of
everything I am and most everything I do.
I did spend from 2001 and onward
focusing very much on what happens for people with disabilities
before, during, and after disasters.
And that’s been a real particular laser focus of mine ever since,
and in fact, I’ve had the opportunity
as an appointee in the Obama administration
to spend just about 8 years at FEMA,
establishing FEMA’s Office of Disability Integration Coordination,
and building a cadre of disability experts
of the same pond, supporting governors
and emergency managers and most particularly
engaging people with disabilities and disability organizations
in emergency preparedness
and throughout disaster response recovery and mitigation.
So one last piece since I’ve been with
the World Institute on Disability since last September,
my ongoing focus on global disability rights has really been
something that I’ve had much more opportunity to e actively involved in
and I have spent the time since joining
WID building a strategic planning process
and supporting the organizations to establish new priorities,
taking a look at the organization’s mission
and very recently establishing four particular areas of focus
for the organization as we move forward.

I apologize that my neighbor is chipping a lot of brush today,
so it’s making extra sound whenever I unmute
but don’t worry, it won’t interfere with your recording.
Okay, so the first question is about the past.
So tell of your first memory realizing that there were
accessibility issues, discrimination, or lack of inclusion.
What is your personal story or connection
to the American’s with Disabilities Act? What do you remember
about the day that it was signed, if applicable?
And what was the impact on you and on others?

I first became aware of disability at a very young age.
I had a best friend in first grade, his name was Gregory,
and he and I were just wonderful friends.
We spent a lot of time together,
and then all of the sudden one day, Gregory was gone,
and I didn’t know what happened to him or where he went
and it wasn’t until many years later
that I found out that Gregory had Down Syndrome,
and he had been removed from my Kindergarten class,
and first grade I think it was at that point,
and apparently he had been sent to some other school somewhere.
And the loss of his friendship was pretty surprising
and I didn’t understand, you know, where he went.
Looking back on it it’s kind of peculiar that we didn’t get to still be friends
‘cause he didn’t move away, he just stopped going to my school.
But, I...
I remember just being confused and then over the next number of years,
I lived in a town that was also the home of Save the Children,
and I was always very interested in the work that Save the Children was doing,
and I am embarrassed to admit that my earliest involvement
in humanitarian work was from a, you know, very charity-model approach,
and I spent a lot of my childhood raising money for Save the Children,
and getting involved in other activities that were very much following
the charity-pity model and certainly not a model of
making space for and supporting and lifting up other people with disabilities.
the onset of my disability wasn't until
many years later,
but when I was in highschool I had a requirement
to do community service I had and opportunity to do
or had an obligation to do community service
And I started off...this was the year of the
first Earth Day and I started crushing glass
at the local recycling center. I turned out
that was really boring but lots of my
classmates were volunteering at a state institution
for people with disabilities and I joined them
once a week and looking back on it again it was
pretty shocking that at 13 years old I was assigned
as the teacher of a classroom of 30 adults
who had never had the opportunity to attend
school and they now had a 13 year old teacher
once a week. Needless to say, I learned
way more from them than they learned
from me bug we had a lot of fun and many of them became
friends very much along the rest of my path
unfortunately, some of them are no longer alive
but there are a couple of people who are
very much a part of my life and fortunately
they were successful in liberating themselves
from that state institution, so they and
many others taught me a lot but the real
pivotal experience for me, I was working back
at that state institution. This was my first
paid job in disability services and I had been
hired to work in what was called a cottage
for 40 women with intellectual disabilities
and this cottage was on beautiful grounds but the women lived in a building with 20 on one side 20 on the other side
and my responsibilities included assisting them in bathing and getting dressed
and in eating. many of them were unable to
feed themselves. Some because they had
never been given the opportunity and others
because of their physical disability and
a lack of any sort of adaptive utensils or adaptive equipment
as I was feeding people it was the same every
day. A plate would come out and there were
3 mounds of food on the plate. One mound
was alway brown one mound was always green
and one mound was always white. The meat
the vegetable and the starch, and I know that
people like to eat their meal different
ways. There would also be a desert every
day, a jello or ice cream, again in a
mound.and I would spend time with each of
the individuals who were having their meal
and we'd be working together trying to
figure out, did they prefer to eat their desert first?
Did they prefer
a little bit of the brown and a little
bit of the white on the fork? Did they not
want their food touching? And so I would
work back and forth with them to try to
figure out what their preference was and
I got in trouble 'cause I was spending too
much time and ultimately I was moved
to a different position because I was
taking too much time giving people an
opportunity to make some choices and
express preferences.
So that was extremely pivitol, and in many ways,
those early experiences have really totally
driven who I am and what
I believe all these years later.
In terms of the Americans with Disabilities Act
I had a very close personal experience with
what was then called Public Law 94142:
The Education of All Handicapped Act,
later on renamed The Individuals with Disabiities Act
IDEA, and I had a very personal family experience
with IDEA and became aware of legislative initiatives
and how the IDEA had just been passed
and then I started to become more aware
of the work being done, back in the 70's.
Work being done on some other legislative
initiatives, the 504, the passage of the
Rehabilitation Act, followed by the 504
sit-in in San Francisco to get the
regulations put in place. That really
caught my attention. And between the
little bits of information I was getting
there and the work that I was doing
and then becomming a full-time
advocate. Going to work for an
independent living center in 1982.
I then became extremely involved in
systems change and how to develop
policy, how to organize and support the
rights, voices and preferences of other
people and because I lived in Connecticut and
the original author of the Americans with
Disabilities Act, the first time the bill
was introduced was Senator Will Weiker
of Connecticut and Senator Weiker,
father of a great young man who
had Down Syndrome, Senator Weiker
was very involved with the disability
advocacy community in Connecticut and
I then had the incredible opportunity to
go to Boston and testify at one of
the, Congressman Major Owens feild hearings
on the Americans with Disabiities Act so
of course that first time around
the bill didn't pass.
But boy oh boy, were we revved up
and in the passage of the ADA
...
In the period in which, once the bill
was reintroduced and folks were organizing
I remember that we had stacks and stacks
of bright pink postcards and we were
organizing folks across the state to sign
those postcards supporting passage
of the ADA and then...
This was sort of a wonderful
but maybe a little bit misleading experience
we actually were successful! The bill got
passed! And I remember thinking
well this wasn't that hard, we had to
go at it twice but, this wasn't so hard;
lets take on some more legislation so
turns out it wasn't as easy as it looked to me
is wasn't just about hot pink post cards
and meetings and marches.
That all helped but even that, sometimes
these days, doesn't seem to be enough
to change policy.
That said, that's my earliest journey
to 1990.
Thank you Marcie. Ok, were's going to the present now
Just so you know, I have another interview at
2, so we're gonna have 3 more sections
the present, the future
and the call to action so just to
pace yourself within that.
So, the present: Has the ADA made a
difference. Tell us about your "aha moment"
that told you that the ADA is or isn't making
a difference and to what extent
based on your areas of passions and
expertise where you see or not see the impact of the ADA
Marcie: So the ADA has had a huge and sweeping
impact and it's important for me to begin, as
I talk about the present day, as we're embarking
on ADA30, it's really important to start with
how much things absolutely things have changed
so certainly some of the architectural
barrier removal efforts.
some of the significant
improvements in effective
equally effective communication
some of the requirements around programs.
All of those
have significantly changed...often.
There have been many
great initiatives.
Over the years
But we always had to maintain a relentess
battle to not let anything slip
to no lose any sort of momentum
towards accessibility.
If we look away for a minute
our rights will be swept away from us
and I can certainly talk about the very
present day...and what I have to say about
where we are today...
is not great. So I do want to take
a little bit more time to call out the
significant progress in so many aspects of
daily life, in which,
we can call out failures of ADA compliance,
enforcement of the law, but it is
often times in comparrison
to examples where it's working so
when transportation is not accessible
we're calling it out because we know the good
and promising practices
that have been in place
for transportation accessiblity
make the failures so much more egregious... in housing
in employment, in the kinds of assistive devices
that are available. The universal design
of places and things...all of that
points to the examples of where we are
getting it right and in stark contrast the areas
where we are egregiously getting it wrong.
And I have to say that it's just very recently, I
have lead my organization's involvement in a
petition to the US department of Health and Human Services
demanding that people with disabilities be immediately relocated
out of nursing homes and other congregate settings
due to the horrific circumstances in those
congregate settings due to Covid-19
and the failure to provide
appropriate protections for people with
disabilities in institutional settings. The ADA
back in 1990, very clearly gave people with
disabilities significant rights and even when
challenged in 1999, the Olmstead Case
which was a Georgia case and two
women, Lois and Elaine, Lois Curtis,
an incredible woman
I've had the pleasure of being with on
a number of occasions. The two of them
demanded that they had a right
to live in the most integrated setting appropriate
to their needs and the decision, the case
went all the way to the supreme ccourt
and I was among those who
slept out on the steps of the Supreme Court
on the night before their
case was heard and I was
among the folks who celebrated
out in front of the Supreme Court on the day
that that decision came down in favor of
Lois and Elaine's right and the rights of tens
of thousands...millions of people with
disabilities to live in the most integrated setting
appropriate for their needs.
Given that we are 21 years after that
decision, yesterday the American Civil
Liberties Union submitted a petietion
and the World Insitute on Disability joined
a number of other disability organiations in
bringing that petition demanding that
people with disabilities
be immediately relocated out of these
congregate settings. Tens of thousands of people
have died in the last hundred days
the genocide of people with disabilities
because of the failures of implementation
of that Olmstead decision and the
failures of our government to provide
the kinds of supports and services that
enable people with disabilites
to live safely and with the
support they need in place
in the community and very infuriatingly
our continued persistent calls for
people with disabilities to be adequately
served in these
in disasters, have been ignored
and the bottom line has been
that, again, over the last hundred days
tens of thousands of people with disabilities
have died. And when I was called on
saying that those were people
with disabilities. I've had conversations
with a number of senior government officials
who are like, "Why are you saying
people with disabilities... these were
old people with underlying conditions living
in nursing homes and long-term care facilities."
Well, you don't go to a nursing home because
you're old. You go to a nursing home because you
have a disability and the
supports and services you need to
stay in the community have not been given
to you and the vast majority, some would say,
all of those deaths in congregate facilities are
people with disabilities. Most of them
Black and Brown and people living
in poverty and the failures of the the
Americans with Disabilities Act and the
Olmstead decision and our government's will
to monitor and enforce this law
and the rehabilitation act have a
devastating impact on where we are today
and death of many of our siblings...
without end in sight.
Than you, Marcie. Ok, so next on to
the future with the work you've been doing
you've seen a lot of progress and barriers
If you could pick one thing to change,
or that needs to occur to have access and equality
I know that's hard, one thing
to have access and equality present in
the lives of people with disabilities what would that be?
Marcie: The one thing that must
happen: People with disabiites have civil
rights protections by law and the one thing
that must happen is that thier rights are
monitored and enforced without
exception. Following the law is not enough.
We need universal designs to
be the standard. We need accessibility and
accommodation to be readily available but
we must have monitoring and enforcement
every federal dollar is supposed to be spent
in compliance with the Rehabilitation Act
and between what the Rehab Act and
the ADA require. There should be no room
for people with those civil rights protections to
be repeatedly denied and unable to fully
participate in home and community life.
Monitoring and enforcement must be the
floor and the ceiling. But enforcing these civil rights
laws is absolutely the floor.
Thank you. So what can we do? What steps can
we as community members take right now?
Marcie: So what we can do right now is
one of my favorite sayings: "Never give up,
Never give in." Another of my favorites:
"Nothing about us without us!" We as
disability community leaders need to stick
together. We need to center our work around
people who are multiply marginalized, exluded
We need to be sure that we're not wasting
our time with infighting and the kind of
divisive, childish behavior that some folks are
still stuck on engaging in. We absolutely must
reach a hand forward and reach a hand back,
stick together and continue
relentlessly to work towards the realization of
the goal that the ADA was
written around and so many
of our siblings have fought so very hard for.
We've lost a bunch of those hard-working
visionary leaders. Many of them have been
lost in recent years. Some of them have been
lost along the way. We have an incredible
legacy to care for. We have huge opportunities to
work towards. Technology has the potential for
leveling the playing field if in fact people have
real access and the World Institute on
Disability and our commitment to
work in partnership with other
disabiity-led organizations and
our allys to make communities
stronger, more resilient for the whole
community. 'Cause when we get it right
for people with disabilities, I think
the whole community, not only benefits but
is stronger for our leadership
our contributions, our expertise
in what it takes to make daily life work for everybody.

ومؤخراً قمت بتأسيس اربعة مجالات
عملية للتركيز
من أجل المنظمة بينما نمضي للأمام.

أعتذر لأن جاري يقطع الكثير من

أخبرينا عن ذكرياتك الأولى حين أدركت
وجود

بقانون المعاقين الأمريكيين؟

تذكري النقر على شيء ما

قبل البدء.
في البداية تشكّل وعيي عن الإعاقة
في عمر مبكر جداً.
حيث كان لدي صديق في الصف الأول
كان اسمه غريغوري.
كنا أصدقاء مقربين.
قضينا الكثير من الوقت سوياً.
ثم وعلى حين غرة،
رحل غريغوري ذات يوم.
لم أعرف ما حصل معه أو
أين رحل.
وبعد عدة سنوات
اكتشفت أنه كان مصاباً بمتلازمة داون
وتم نقله من صفي
كنا في الصف الأول في ذلك الوقت
من الواضح أنه قد اُرسِل إلى
مدرسة أخرى بمكانٍ ما
وخسارة صداقته كانت مثيرة للدهشة
ولم أفهم، أين ذهب
وباسترجاع تلك القصة،
كان غريباً أننا لم نعد أصدقاء
لأنه لم ينتقل بعيداً، لكنه
توقف عن الذهاب للمدرسة.
لكن، أنا
أذكر أني كنت محتارة ثم
بعد العديد من السنين
عشت في مدينة كانت ايضاً مركزاً
لمؤسسة "أنقذوا الأطفال"
وكنت مهتمة بالعمل الذي يقوم
به.
وأنا محرجة للاعتراف أن مشاركتي المبكرة
بالعمل الإنساني كانت
على نهج النموذج الخيري،
وعشت الكثير من طفولتي أجمع تبرعات
لمركز "أنقذوا الطفولة"،
والمشاركة في نشاطات أخرى تتبع
نموذج الإحسان والشفقة وبالتأكيد
ليست نموذجاً
لإفساح المجال لدعم ورفع سوية المعاقين.
كانت إعاقتي بعد عدة سنوات لاحقة،
لكن عندما كنت في المرحلة الثانوية،
كان لزاماً علي القيام ب ..
حتى أني لا أذكر ما كان يُدعى الآن!
خدمة المجتمع! آسفة.
سنحت لي الفرصة، أو بالأحرى
كان لزاماً علي القيام بالخدمة المجتمعية،
بدأت، كان ذلك العام الأول
ليوم الأرض العالمي
وبدأت بتكسير الزجاج في مركز
التدوير المحلي،
واتضح أن العمل ممل جداً
لكن الكثيرين من زملائي في المدرسة تطوعوا
في المؤسسة الحكومية من أجل ذوي الإعاقات،
وانضممت إليهم مرة في الأسبوع
وبالنظر إليها مجدداً،
كان صادماً أنه في عمر الثالثة عشر
عُينتُ كمعلمة في صف يحتوي
على ثلاثين بالغاً
لم تسنح لهم الفرصة لارتياد مدرسة ابداً،
والآن لديهم
معلمة تبلغ من العمر 13 عاماً
مرة بالأسبوع.
ولا حاجة للقول، أني تعلمت منهم أكثر
مما تعلموا مني.
لكننا حظينا بالكثير من المرح،
وصار الكثير منهم أصدقائي
لكثير من الوقت اثناء مسيرتي
لسو الحظ، مات بعضهم،
لكن ما زال بعضاً منهم جزء من حياتي
ولحسن الحظ، كانوا ناجحين في
تحرير أنفسهم من المؤسسة الحكومية.
وهكذا، هم وآخرين علموني الكثير.
لكن التجربة المهمة بالنسبة لي،
أني كنت أعمل عندها في
المؤسسة الحكومية، وكان عملي المأجور الأول
في خدمات المعاقين.
وتم توظيفي للعمل في ما يطلق عليه اسم
"الكوخ".
الذي يحوي على أربعين امرأة من ذوات
الإعاقات العقلية.
وهذا "الكوخ" كان مبنياً على أرض جميلة،
وكانت النساء يعشن في بناء، 20 امرأة على جانب
والأخريات على الجانب الآخر.
وكانت مسؤولياتي تتضمن
مساعدتهن بالتحميم وارتداء الثياب
وتناول الطعام.
معظمهن كن غير قادرات
على إطعام أنفسهن.
البعض لأنهم لم تُفسح لهن الفرصة،
والبعض بسبب إعاقتهن الجسدية.
وانعدام اي نوع من معدات وأدوات التكيف.
وهكذا كنت أُطعم الناس، نوع من أنواع
الروتين اليومي .
حيث تأتي الأطباق ويكون عليها
ثلاثة كومات من الطعام.
كومة بنية اللون دائماً، وكومة خضراء
وكومة دائماً بيضاء.
أي اللحم، الخضار، والمادة النشوية.
وأنا أعرف أن الناس يحبون تناول الوجبات
بطريقة مختلفة.
كان هناك أيضاً حلوى يومياً.
جيليه، أو مثلجات، أو شيء آخر على شكل كومة.
وكنت أقضي الوقت مع كل
الأشخاص الذين يتناولون وجباتهم.
كنا نعمل معاً
في محاولة لاكتشاف إن كانوا يفضلون
تناول الحلوى أولاً؟
البعض يحب القيام بذلك.
هل يفضلوا
القليل من البني والقليل
من الأبيض على نفس الشوكة؟
هل يريدوا لمس الطعام؟
وكنت أمشي ذهاباً وإياباً
معهن أحاول وأكتشف ما هي
الأمور التي يفضلونها ووقعت في متاعب
بسبب قضاء الكثير من الوقت
وأخيراً، نُقلتُ إلى موقع
آخر لأني كنت أقضي الكثير من
الوقت وأنا أمنح الناس فرصة لاتخاذ
بعض الخيارات والتعبير عن الأشياء التي
يفضلونها.
لذلك كان الأمر بالغ الأهمية و في
عدة طرق، تلك التجارب
المبكرة، قادتني فعلياً إلى أن أكون
ما أنا عليه وشكلت قناعاتي فيما بعد.
فيما يتعلق بقانون المعاقين الأمريكيين
كان لدي تجربة شخصية لصيقة
بما كان يُسمى حينها
"القانون العام 94142" المتعلق بتعليم
كل المعاقين، وأعيدت تسميته لاحقاً
حيث أطلقوا عليه اسم قانون أصحاب الإعاقات
كان لدي تجربة عائلية خاصة
مع هذا القانون وأصبحت ملمة
بالمبادرات التشريعية وكيف أن القانون
قد تم تمريره. ثم بدأت
بالإلمام أكثر بكيفية إنجاز العمل.
كان هذا في السبعينيات
حيث يُنجز العمل وبعض المبادرات
التشريعية الأخرى و قانون 405، وإصدار
قانون إعادة التأهيل، تبعه
اعتصام 405 في سان فرانسيسكو كي
يتم تفعيل القوانين. وهذا حقاً
لفت انتباهي، وبين القليل
من المعلومات التي كنت أحصل عليها
والعمل الذي كنت اقوم به
ومن ثم أصبحت مناصرة بدوام كامل
أذهب للعمل في مركز العيش المستقل
في عام 1982، ثم أصبحت مهتمة للغاية
بكيفية تغيير الأنظمة، ووضع
السياسات، طريقة تنظيم وتأييد
حقوق وأصوات وتفضيلات
الآخرين ولأني عشت في
كونيكتيكت والمعد الأصلي
لقانون المعاقين الأمريكيين،
المرة الأولى التي قُدم بها مشروع القانون
كانت عن طريق السيناتور ويكر لكونتيكت
وهو، والد لشاب رائع
مصاب بمتلازمة داون،
السيناتور ويكر كان مهتماً
بمجتمع مناصرة المعاقين في
كونيكتيكت، ثم سنحت لي
الفرصة المذهلة للذهاب إلى
بوسطن وإدلاء شهادتي
بواحدة من جلسات الاستماع الرئيسية
في الكونغرس
كان موضوع الجلسة عن قانون
المعاقين. وتعلمين طبعاً بأن
الجولة الأولى، لم يتم
تمرير مشروع القانون
لكن كنا متحمسين وخلال
تمرير القانون، في الفترة التي
تم إعادة تقديم المشروع وعمليات التصويت
كانت منظمة، أذكر أنه كان لدينا
أكوام كثيرة من البطاقات
الزهرية اللامعة وكنا نقوم بتنظيم
الناس عبر الولاية لوضع،
لتوقيع تلك البطاقات لدعم
تمرير القانون وبعدها كان تلك
تجربة رائعة لكن ربما
مضللة قليلاً، كنا فعلياً
ناجحين، وتم تمرير المشروع! وأنا
أذكر أني قلت، "أوه، لم يكن الأمر صعباً"
اقصد، اضطررنا
للعمل عليه مرتين، لكن لك يكن بتلك
الدرجة من الصعوبة.
دعونا نقوم بالمزيد من التشريعات.
واتضح ان الأمر لم يكن سهلاً
كما بدا لي. لم يكن الأمر
يتعلق
بالبطاقات الزهرية واللقاءات
والمسيرات .. بالطبع كل ذلك ساعد
لكن حتى هذا
أحياناً في تلك الأيام، لا يبدو أنه
كان كافياً لتغيير السياسة.
هذه كانت رحلتي المبكرة إلى عام 1990.
شكراً مارس. حسناً سوف نتجه
للوقت الحاضر الآن. لكن تذكري
أنه لدي مقابلة ثانية في الساعة الثانية،
لذلك سوف
نتكلم في ثلاث أقسام: الحاضر
المستقبل، والدعوة للعمل.
لذلك تقيدي بهذه الخطوات، شكراً.
حسناً، خلال المرحلة الراهنة، هل
صنع قانون المعاقين اختلافاً؟ أخبرينا عن
اللحظة التي علمتِ بأن القانون أحدث
أو لم يحدث فرقاً وإلى أي
مدى، استناداً إلى شغفك ومجال
خبرتك، أين تلحظي أو لا تلحظي
تأثير القانون؟
كان للقانون أثراً
هائلاً وشاملاً.
ومن المهم بالنسبة لي
أن أبدأ بالحديث عن
اليوم الراهن حيث كنا نعمل
على القانون 30، مهم جداً أن نبدأ
بالطريقة التي تغيرت بها الأمور،
تعرفين بالتأكيد بعضاً
جهود إزالة الحواجز المعمارية،
بعض التحسينات المهمة
بالتواصل الفعال المتساوي،
بعض المتطلبات بشأن البرامج
تعرفين أن كل تلك الأمور تغيرت
بشكل كبير، لا أستطيع القول أنها تغيرت
معظم الوقت.. لكن غالياً
كانت هناك عدة مبادرات رائعة خلال
الأعوام لكن كان علينا دائماً المحافظة
على معركة لا هوادة فيها لعدم
السماح بانزلاق أي شيء، كي لا نخسر
أي نوع من الزخم باتجاه الوصول.
إن أشحنا بنظرنا قليلاً
ستنجرف حقوقنا بعيداً عنا.
وبإمكاني بالتأكيد الحديث عن
الفترة الحالية
وما علي قوله عن الموقعبأن المكان الذي
وصلنا إليه
اليوم ليس رائعاً
لذلك أريد أخذ المزيد من الوقت
لاستدعاء التقدم الملموس،
بنواحي عديدة في الحياة اليومية
حيث نستطيع
اكتشاف حالات الإخفاق توافق
القانون.
وتنفيذ القانون ، لكن في أغلب الأوقات
بالمقارنة مع الأمثلة حيث
يكون قيد العمل، لذا، عندما
تكون المواصلات غير متاحة، نستدعي القانون
لأننا نعرف الممارسات الواعدة
والجيدة التي تمت.
لأن إتاحة وسائل النقل
تجعل الفشل أكثر فظاعة
في السكن، التوظيف، في أنواع
الوسائل المساعدة المتوفرة،
التصميم العالمي للأماكن والأشياء
كل ذلك يشير إلى الأمثلة التي
نفهمها بشكل صحيح وفي تناقض صارخ
مع المجالات التي نحصل عليها بطريقة خاطئة
وعلي القول أنني مؤخراً
دفعت منظمتي للمشاركة
في عريضة لقسم الصحة والخدمات الإنسانية
في الأمم المتحدة
للمطالبة بنقل أصحاب
الإعاقات فوراً
خارج دور الرعاية تجمعات أخرى
بسبب الظروف المخيفة
في تلك التجمعات
بسبب وباء كورونا
والفشل في توفير الحماية اللازمة
لأصحاب الإعاقات
في مؤسسات الرعاية
وكان قانون المعاقين في عام 1990
قد اعطى بوضوح لأصحاب الإعاقات
حقوق ملموسة،
وحتى عند التعرض للتحديات في 1999
بقضية أولمستيد
التي كانت قضية جورجيا، والسيدتين
لويس وإيلين، لويس كيرتيس
وهي امرأة مذهلة كان لي
شرف مقابلتها بعدة
مناسبات، طالبت كلتاهما
بأن لديهما الحق بالسكن
في بيئة تجمع
مناسبة لاحتياجاتهما،
والقرار، وقد وصلت القضية
إلى المحكمة العليا
وكنت من ضمن الأشخاص الذين
ناموا خارج المحكمة العليا في الليلة
السابقة لسماع قضيتهما
وكنت من ضمن
الأشخاص الذين احتفلوا خارجاً أمام
المحكمة العليا في اليوم الذي صدر
به القرار
لصالح حق لويس وإيلين،
وحقوق الآلاف، عشرات الآلاف،
ملايين المعاقين
للعيش في التجمعات الأكثر
ملائمة لاحتياجاتهم.
وبعد 21 عاماً من إصدار ذلك القرار،
البارحة، نقابة الحريات المدنية الأمريكية
قدمت عريضة وضم المعهد العالمي
للمعاقين عدداً من منظمات
المعاقين الأخرى لإحضار العريضة
للمطالبة بنقل
المعاقين فوراُ
من التجمعات
الكثير من المعاقين قضوا نحبهم
خلال المئة يوم الأخيرة، إبادة جماعية
للمعاقين بسبب
الإخفاقات بتنفيذ
قرار أولمستيد وإخفاقات
حكومتنا بتقديم أنواع الدعم
والخدمات التي تُمكّن
المعاقين
من العيش الآمن وبالدعم الذي
يحتاجونه في المجتمع،
والمثير للغضب هو دعواتنا
المستمرة الملحة من أجل
تقديم خدمات ملائمة
لأصحاب الإعاقات في تلك
الكوارث، تم تجاهلها.
والخلاصة انه تم مجدداً
خلال المئة يوم الأخيرة
عشرات الأشخاص من
ذوي الإعاقات قد ماتوا. وعندما كنت
أدعو لذلك، وأقول أن أولئك كانوا
من ذوي الإعاقات، كانت لدي
محادثات مع عدد من كبار
المسؤولين الحكوميين الذين، قالوا، لماذا
تقولين أنهم معاقين؟
لقد كانوا مسنين
بظروف خاصة يعيشون في دور
الرعاية ومنشآت الرعاية طويلة الأمد
حسناً، أنت لا تذهبين إلى دار المسنين

رأيتِ الكثير من التقدم
والعراقيل. إن استطعت اختيار شيء واحد
لتغيريه، أو شيء ينبغي أن يحدث
من أجل الوصول والمساواة .. أعرف أنه صعب
شيء واحد كي تكون المساواة والوصول
حاضرة في حياة أصحاب
الإعاقات، ماذا ستكون؟
الشيء الوحيد الذي يجب أن يحدث:
أن يكون للمعاقين حماية حقوق مدنية
بالقانون والشيء الوحيد
الذي يجب أن يحدث
أن يتم مراقبة حقوقهم
وتنفيذها دون استثناء، يلي ذلك
أن القانون ليس كافياً، نحن بحاجة إلى
تصميم عالمي كي يكون مقياساً
نحتاج إلى الوصول والتكيف
لتكون متاحة بسهولة لكن يجب أن
يكون هناك مراقبة وتنفيذ.
يُفترض أن ينفق كل دولار
بالتوافق مع أعمال إعادة التأهيل
وبين إعادة التأهيل وقانون المعاقين
يجب، وينبغي أن،
لا يكون هناك أعذارللأشخاص
الذين يتمتعون بحماية الحقوق

بحاجة إلى التشبث ببعضنا، بحاجة إلى
نركز عملنا حول الناس
المهمشين والمبعدين
بحاجة إلى أن نحرص على عدم إهدار
وقتنا بالمشاحنات
والتصرفات الطفولية التي تسبب الانقسامات
والتي ما زال بعض الأشخاص عالقين بها
يجب أن نمد أيدينا للأمام ونتكاتف
أن نمسك بأيدي بعضنا ونلتحم سوياً
ونتابع العمل بلا هوادة
نحو إدراك الهدف
بأن قانون المعاقين قد كُتب

لقد فقدنا الكثير من أولئك
القادة المستبصرين المجدين، الكثير منهم

Hallo, mein Name ist Marcie Roth
und ich arbeite im Bereich
Rechte für Menschen mit Behinderungen,
seitdem ich Erwachsen wurde,
eigendlich sogar schon
seit Beginn der Mittelstufe.
Ich bin Geschäftsführerin und CEO
des World Institute on Disability (WID).
Über die Jahre hinweg
habe ich
mit Menschen in Wohnprogrammen gearbeitet,
früh in meiner Karriere,
mit Schulkindern,
mit Menschen in beruflicher Rehabilitation
und mit Menschen,
die in Gemeinschaftswohnungen leben.
So kam ich in Kontakt mit
den Rechten für Menschen mir Behinderung
und war sehr involviert in den Anfängen
der Eintretung für diese Rechte
bevor ADA (amerikanisches Gesetz zur
Gleichstellung von
Menschen mit Behinderung)
eingeführt wurde.
Seitdem habe ich
für Organisationen gearbeitet,
die für diese Rechte eintreten.
Zusätzlich zu meiner eigenen Behinderung
bin ich die Mutter von zwei,
mittlerweile erwachsenen,
Personen mit Behinderungen.
Mein Ehemann hat ebenfalls
eine Behinderung
und viele meiner Familienmitglieder
haben ebenfalls Behinderungen.
Rechte für Menschen mit Behinderungen
sind schlichtweg ein Teil
von allem was ich bin
und fast allem was ich tue.
Seit 2001
konzentriere ich mich stark auf das,
was Menschen mit Behinderungen
vor, während und nach Katastrophen
wiederfährt.
Seitdem ist das ein ganz besonderer
Interessensbereich für mich.
Ich hatte sogar die Möglichkeit,
während der Obama-Administration
als Beauftragte
8 Jahre lang bei FEMA (amerikanische
Bundesagentur für Katastrophenschutz)
ihr Büro zur Koodinierung
von Behinderten-Integration zu etablieren
und eine Gruppe von Experten
zum Thema Behinderungen zu bilden,
dessen Aufgabe es ist,
Gouverneure, Notfallmanager
und vor allem
Menschen mit Behinderungen
und Behindertenorganisationen
in Notfallvorbereitungen einzubinden
und zu unterstützen,
genauso wie bei Katastrophenhilfe,
-bewältigiung und -schutz.
Zum Schluß noch mal,
seitdem ich
seit letztem September,
bei dem World Institute on Disability bin,
hat mein Fokus
auf das weltweite Behindertenrecht
es mir erlaubt, viel aktiver
involviert zu sein
und seitdem ich dem WID beigetreten bin
habe ich einen strategischen
Planungsprozess aufgebaut
und unterstütze die Organisation,
neue Prioritäten zu etablieren,
die Mission der Organisation
zu betrachten

Hi there, I'm Marcie Roth
And I have been working in disability rights
For my whole adult life,
And actually, since I was a freshman in high school
I am currently the executive director and CEO of the World Institute on Disability
And I have been working over the years in services
for people living in residential programs early
in my career with people in,
Children in school settings,
people in vocational rehabilitation,
and then people in community living environments,
then along the way, I became very involved in disability rights
and very involved in the early days of advocacy
before the ADA was introduced.
And then I worked for disability advocacy organizations almost ever since.
In addition to my own disability,
I'm also the parent of two now adults with
disabilities. My husband also has a disability,
and much of my family also happen to be people with disabilities
so disability rights is just a part of everything I am and most everything I do.
I did spend from 2001 and onward focusing very much
on what happens for people with disabilities
before, during, and after disasters.
And that's been a real particular laser focus of mine ever since,
and in fact, I've had the opportunity
as an appointee in the Obama administration
to spend just about 8 years at FEMA,
establishing FEMA's Office of Disability Integration Coordination,
and building a cadre of disability experts
focusing on supporting governors
and emergency managers and most particularly
engaging people with disabilities and disability organizations
in emergency preparedness
and throughout disaster response recover and mitigation.
So one last piece since I've been with
the World Institute on Disabilities since last September,
my ongoing focus on global disability rights
has really been something that I've had
much more opportunity to be actively
involved in and I have spent the time since joining
with building a strategic planning process
and supporting the organization to establish new priorities
taking a look at the organizations mission
and very recently establishing four particular areas of focus
for the organization as we move forward.

I apologize that my neighbor is chipping a lot of brush today,
so it's making extra sound whenever I unmute
but don't worry, it won't interfere with your recording.
Okay, so the first question is about the past.
So tell your first memory realizing that there were
accessibility issues, discrimination, or lack of inclusion.
What is your personal story or connection
to the American's with Disabilities Act?
What do you remember about the day that it was signed, if applicable?
And what was the impact on you and on others?

I first became aware of disability at a very young age.
I had a best friend in first grade, his name was Gregory,
and he and I were just wonderful friends
We spent a lot of time together, and then
all of the sudden one day, Gregory was gone,
and I didn't know what happened to him or where he went
and it wasn't until many years later
that I found out that Gregory had Down Syndrome,
and he had been removed from my Kindergarten class,
and first grade I think it was at that point,
and apparently he had been sent to some other school somewhere.
And the loss of his friendship was pretty surprising
and I didn't understand, you know, where he went.
Looking back on it it's kind of peculiar that we didn't get to still be friends
cause he didn't move away, he just stopped going to my school.
But, I...
I remember just being confused and then over the next number of years,
I lived in a town that was also the home of Save the Children.
And I was always very interested in the work
that Save the Children was doing, and I am
embarrassed to admit that my earliest
involvement in humanitarian work was from a, you know a very charity-model approach.
I spent a lot of my childhood raising
money for Save the Children, and getting
involved in other activities that were very
much following the charity-pity model and certainly not a model
of making space for and supporting and lifting up
other people with disabilities.
The on set of my disability wasn't until many years later,
but when I was in high school, I had a
requirement to do community service and I
had an opportunity to do, had an obligation
to do community service and we started off.
This was the year of the first Earth Day
and I started crushing glass at the local
recycling center. It turned out that it
was really boring but lots of my classmates
were volunteering at a state institution
for people with disabilities and I joined them
once a week, looking back on it again it was
pretty shocking at 13 years old I was
assigned as the teacher of a classroom
of 30 adults who had never had the
opportunity to attend school and now had
a 13 year old teacher once a week.
Needless to say, I learned way more from them
then they learned from me, but we had a lot of fun
and many of them became friends, you know, very much along the rest of my path.
Unfortunately, some of them are no longer alive
but there are a couple of people who are
still very much apart of my life, and
fortunately they were successful in
liberating themselves from that state
institution and so, they and many others
taught me a lot but the real pivotal
experience for me, I was working back at
that state institution. This was my first paid job
in disability services and I had been
hired to work in what was called a cottage, for
40 women with intellectual disabilities.
This cottage was on beautiful ground, but
the women lived in a building with 20 on
one side and 20 on the other side.
My responsibilities included assisting them
in bathing and getting dressed and eating
many of them were unable to feed themselves
some because they never been given
the opportunity and others because of
their physical disability and a lack of any
supportive or adaptive utensils or other equipment,
so as I was feeding people it was the same every day.
A plate would come out and there were 3 mounds of food on the plate. One mound was always brown
One mound was always green
One mound was always white, you know the meat
the vegetable, and the starch, and I know that
people like to eat their meals different ways, there would
also be a dessert everyday, a jello, ice cream again in a mound.
I would spend time with each of the individuals
who were having their meal, and would sort of be kind of working
together trying to figure out, did they
prefer to eat their desert first?
And people like to do that, did they prefer
a little bit of brown and a little bit of white
all on the same fork? Did they not want
them touching, and you know I would sort of
work back and forth with them to try to
figure out what their preference was and
I got in trouble because I was spending
to much time and ultimately, I was moved
to a different position because I was taking
to much time giving people and
opportunity to make some choices and
express some preferences. That was extremely
pivotal and in many ways, you know, those early
early experiences, have really, totally driven who I am
and what I believe all of these years later.
In terms of the American's with Disabilities Act
I had very close personal experience with
what was then called public law 94142:
The Education of All Handicaps Act,
later on renamed The Individuals with
Disabilities Act, IDEA and I had a very personal
family experience with IDEA and became aware
of legislative initiatives, and how the IDEA had just been passed.
Then I started to become more aware of the work
being done, this was back int he 70's. Working
being done on some other legislative initatives, the 504
The Passage of Rehabilitation Act, followed by the 504
sit-in in San Francisco to get the
regulations put in place. That really caught my attention,
between the little bits of information I was getting there
and the work I was doing and then becoming a full time
advocate, going to work for an independent
living center in 1982, I then became extremely
involved in systems change and how to develop
policy, how to organize, how to support
the rights, voices and preferences of other
people and because I lived in Connecticut and the
original author of the American's with
Disabilities Act, the first time the bill
was introduced was senator Will Weiker
of Connecticut and Senator Weiker, father
of a great young man who had Down Syndrome
Senator Welker was very involved with
the disability advocacy community in Connecticut
and I then had the incredible opportunity to
go to Boston and testify and on of the
Congressman Major Owens field of hearings
on the American's with Disabilities Act so
of course that first time around the bill
didn't pass. But boy oh boy, were we revved up
in the passage of the ADA, in the period of which
once the bill was reintroduced
and folks were organizing, I remember that we had
stacks and stacks and stacks of bright pink
post cards, and we were organizing folks across the state
to develop, to sign those post cards supporting
passage of the ADA and then, this was sort
of a wonderful but maybe a miss leading experience
we actually were successful! The bill got
passed, I remember thinking oh well this wasn't that hard,
we had to go at it twice but this wasn't so hard!
Let's take on some more legislation. So
turns out it wasn't as easy as it looked to me
It wasn't just about hot pink post cards, and meetings, and marches
that all helped but even that sometimes
these days doesn't seem to be enough to change policy.
That's my earliest journey to 1990.

The present, the future and the call to
action, so just to pace yourself within those
So the present, has the ADA made a difference?
Tell us about your "Aha" moment that told you
that the ADA is or is not making a difference
and to what extent based on your passions
and area of expertise, where you see or
not see the impact of the ADA.
So the ADA has had a huge and sweeping impact
and I... Its important for me to begin as I talk about
the present day as were embarking on ADA 30.
Its really important to start with, how
much things absolutely have changed, and certainly some
of the architectural barrier removal efforts
some of the significant improvements in
effective, equally effective communication
some of the requirements around programs
All of those have significantly changed
most, I can't even say most of the time... often.
There have been many great initiatives
over the years, but we always had to
maintain a relentless battle to, to not let
anything slip, to not lose and sort of momentum,
towards accessibility. If we look away for
a minute, our rights will be swept away
from us, I can certainly talk about the
very present day, and what I have to say
about where we are today, is not
great, so I do want to take a little bit
more time to call out the significant
progress in so many aspects of daily life,
in which we can call out failures of ADA
compliance, enforcement of the law.
But it is often times in comparison to
the examples of where it's working.
So when transportation is not accessible
we're calling it out because we know the
good and the promising practices that have
been in place for transportation accesabilty
Make the failures so much more egregious.
In housing, in employment, in the kinds
of assistive devices that are available
the universal design of places and things,
all of that points to the examples of where
we are getting it right, In stark contrast
the areas where we are getting it egreigously
getting it wrong. I have to say that
just very recently, I have lead my
organization involvement in a petition to
the U.S Department of Health and Human
Services, demanding that people with
disabilities be immediately located
out of nursing homes and other congregate
settings due to the horrific circumstances
in those congregate settings, to Covid-19
and the failure to provide appropriate
protections for people with disabilities
and institutional settings. The ADA back in 1990
very clearly gave people with disabilities
significant rights, and even when
challenged in 1999, the homestead case
which was a Georgia case, and two women
who Lois and Elaine, Lois Curtis an
incredible woman, I have had the
pleasure of being with on a number of
occasions. The two of them demanded that
they had a right to live in the most intergraded
setting appropriate to their needs.
The decision, the case went all the way to
the Supreme Court, and I was among
those who slept out on the steps of
the Supreme Court on the night before
their case was heard. I was among the
folks who celebrated out in front of the
Supreme Court on the day that decision
came down in favor of Lois and Elaine
right and the rights of thousands, tens of
thousands, millions of people with
disabilities to be, to live in the most
intergraded setting appropriate to their
needs. Given that we are 21 years after
that decision, yesterday the American
Civil Liberties Union submitted a petition
and the World Institute on Disability joined
a number of disability organizations
in a bringing that petition, demanding
that people with disabilities be immediately
relocated out of these congregate settings.
Tens of thousands of people have died
in the last hundred days, the genocide of
people with disabilities because of the
failures of implementation of that
homestead decision and the failures of our
government to provide that kind of support
and services that enable people with disabilities
to live safely and and with the support
they need in place in the community,
very infuriatingly, our continued persistent
call for people with disabilities to be
adequately served in these disasters
have been ignored and the bottom line
has been that again, over the last hundred days
tens of thousands of people with disabilities
have died, and when I was called on
saying that those were people with disabilities
I have had conversations with a number of
senior government officials who,
"why are you saying people with disabilities"
these were old people with underlying conditions
living in nursing homes, and long term care
facilities, look you don't go to a nursing home
because you are old. You go to a nursing home because
you have a disability and the supports and
services you need to stay in the community
have not been given to you, and that majority
of some would say of all those deaths in
congregate facilites are people with disabilities.
Most of them black and brown and people
living in poverty, and the failures of
American's with Disabilities Act, the homestead decision and
our governments will to monitor and force
this law and the rehabilitation act have a
devastating impact on where we are today
and the depth of many of our siblings,
Without out end in sight.
Thank you Marcie, okay so next onto the
future. With the work you have been doing
you have seen a lot in terms of progress and barriers.
If you could pick one thing to change or that needs
to occur to have access and equality,
I know that is hard, one thing. To have
access and equality present in the lives
of people with disabilities, what would that be?
The one thing that must happen
people with disabilities have civil rights
protections by law. The one thing that must happen
is that their rights are monitored and enforced
without exception. Following the law is not
enough, we need universal designs to be
the standard, we need accessibility
and the accommodation to be readily available.
But we must have monitoring and enforcement.
Every federal dollar is supposed to be
spent in compliance with the rehabilitation act
and between the rehab act and what the ADA require.
There should be no room for people with
those civil rights protections to be repeatedly denied
and unable to fully participate in home
and community life. Monitoring and enforcement
must be the floor, the ceiling. But enforcing
these civil rights laws is absolutely
the floor. Thank you
So what can we do? What steps can we as community members
take right now?
So what we can do right now is
one of my favorite sayings is
"never give up, never give in"
another favorites is
"nothing about us, without us"
We as disability community leaders, need
to stick together, we need to center our work
around people who are multiple marginalized
excluded, we need to be sure that
we are not wasting our time with in fighting
and with the kind of divisive childish behavior
that some folks are still stuck on engaging in.
We absolutely must reach a hand forward,
reach a hand back, stick together and
continue relentlessly to work towards
the realization of the goal that the ADA
was written around and so many
of our siblings have fought so very hard
for, we've lost a bunch of those hard working
visionary leaders, many of them have been
lost in recent years, some have been lost
along the way. We have an incredible
legacy to care for, we have huge
opportunities to work towards. Technology
has the potential of leveling the
playing field if in fact people have real access
and the World Institute on Disability
and our commitment to work in partnership
with other disability lead organizations and our allies
to make communities stronger, more resilient for
the whole community. When we get it right
for people with disabilities, I think the
whole community not only benefits is stronger
for our leadership, our contributions,
our expertise in what it takes to make daily life
work for everybody.

estableciendo su Oficina de Coordinación

enfocados en apoyar a gobernadores...
...y a la Administración de Desastres.
Y, más particularmente, comprometiendo
a las personas con discapacidad
y organizaciones de discapacidad
en la preparación ante emergencias,
y a través de la respuesta, recuperación
y mitigación ante desastres.
Entonces, una última parte,
desde que estoy con el Instituto
Mundial de Discapacidad,

Antes de empezar recuerda dar un golpecito

Comencé a tomar consciencia
sobre la discapacidad...
siendo aún muy joven.
Tenía un buen amigo en primer grado,
su nombre era Gregory,
y ambos éramos grandes amigos.
Pasábamos mucho tiempo juntos.
Luego, un día, Gregory se marchó.
Yo no sabía qué le había ocurrido
o a dónde se había ido.
Y no fue hasta muchos años después
que descubrí que Gregory
tenía Síndrome de Down,
y que lo habían retirado
de mi clase en jardín de infantes.
En primer grado, creo que fue
en ese momento.
Aparentemente, lo habían enviado
a otra escuela, no sabría en dónde.
La pérdida de su amistad fue bastante...
...sorpresiva.
Yo no podía comprender
a dónde se había ido.
Mirando hacia atrás, es un poco extraño
no haber podido seguir siendo amigos,
porque él no se había mudado,
simplemente dejó de asistir a mi escuela.
Sin embargo...
...recuerdo haberme sentido confundida.
Luego, durante los siguientes años,
viví en una ciudad que era también hogar
de Save the Children.
Yo siempre estuve muy interesada
en el trabajo que estaba haciendo
Save the Children.
Me avergüenza admitir
que mi primera participación
en trabajos humanitarios,

a otras personas con discapacidades.
El comienzo de mi discapacidad
no sucedió hasta muchos años más tarde.
Cuando estaba en la escuela secundaria,
me requerían llevar a cabo...
No puedo recordar cómo lo llaman...
¡Servicio comunitario! Disculpen.
Tuve la oportunidad,
o mejor dicho, la obligación
de hacer servicio comunitario.
Y comencé...
Fue el año del primer Día de la Tierra,
y comencé triturando vidrio
en el centro de reciclaje local.
Resultó ser muy aburrido.
Pero muchos de mis compañeros de clase
estaban trabajando como voluntarios
en una institución estatal
para personas con discapacidades.
Yo me uní a ellos
una vez a la semana.
Mirando hacia atrás otra vez,
era bastante impactante que a mis 13 años
fuera asignada como enseñante
en una clase con 30 adultos,
quienes nunca habían tenido la oportunidad
de asistir a la escuela.
Ahora tenían una maestra de 13 años
una vez a la semana.
No hace falta decir que aprendí
mucho más de ellos
que ellos de mí,
pero nos divertimos mucho.
Me convertí en amiga de muchos de ellos
por mucho tiempo a lo largo de mi camino.
Desafortunadamente, algunos de ellos
han fallecido,
pero un par de personas continúan siendo
parte importante de mi vida.
Y, por fortuna,
han podido liberarse con éxito
de esa institución estatal.
Así fue que ellos y muchos otros más
me enseñaron tanto.
La experiencia más significante para mí
fue cuando trabajaba en aquella
institución estatal.
Era mi primer trabajo remunerado
en servicios para discapacitados,
y me habían contrataron para trabajar
en lo que llamaban una "cabaña"
para 40 mujeres
con discapacidades intelectuales.
Esta "cabaña" se encontraba
en medio de parques hermosos,
pero las mujeres vivían en un edificio,
20 de un lado y 20 del otro lado.
Mis responsabilidades incluían asistirlas
en el aseo,
en vestirse y en alimentarse.
Muchas de ellas eran incapaces
de alimentarse por sí mismas.
Algunas, porque nunca habían tenido
esa oportunidad,
y otras, debido a su discapacidad física
y la falta de...
...utensilios
u otros equipamientos adaptados.
Mientras alimentaba a las personas,
la rutina era la misma todos los días.
Si salía un plato, en él habría
tres montículos de comida.
Un montículo sería siempre marrón,
un montículo sería siempre verde,
y un montículo sería siempre blanco.
La carne, la verdura y la fécula.
Yo sé que...
...a la gente le gusta comer
sus comidas de formas diferentes.
También había postres todos los días.
Gelatina, helado, o lo que fuera
siempre en un montículo.
De este modo, yo pasaba tiempo
con cada uno de los individuos
mientras se alimentaban,
y estábamos trabajando juntos
intentando descifrar si preferirían
comer primero el postre,
a algunos les gusta hacer eso,
o si preferirían un poco de lo marrón
y un poco de lo blanco
todo junto en el mismo tenedor,
si no querrían que se toque su comida.
Trabajaba incansablemente con ellos
para intentar descifrar sus preferencias.
Y me metí en problemas
porque desperdiciaba mucho tiempo.
Al final, me transfirieron a otro puesto,
porque me estaba tomando
demasiado tiempo
dándole a las personas la oportunidad
de tomar algunas decisiones
y de expresar sus preferencias.
Eso fue extremadamente crucial,
y en muchos aspectos,
esas experiencias tan tempranas
han realmente impulsado
quien soy y lo que defiendo
tantos años después.
En cuanto a la Ley para Estadounidenses
con Discapacidad,
tuve una experiencia personal muy cercana
con la que en ese entonces era llamada
"Ley Pública 94142",
Ley de Educación
para todos los Discapacitados,
que más tarde fue renombrada
Ley de Educación
para Individuos con Discapacidad,
IDEA por sus siglas en inglés.
Tuve una experiencia familiar muy cercana
con la IDEA,
y tomé consciencia
sobre las inciciativas legislativas
y sobre cómo la IDEA
acababa de ser aprobada.
Luego comencé a tomar más consciencia
del trabajo que se estaba llevado a cabo.
Esto fue en los años '70,
se estaba trabajando
en otras iniciativas legislativas.
La 504, la aprobación de la Ley
de Rehabilitación,
seguido por la sentada
en señal de protesta 504,
en San Francisco,
para lograr establecer las regulaciones.
Aquello llamó enormemente mi atención,
y entre la pequeña cantidad de información
que recibía allí,
y el trabajo que yo hacía,
y más tarde convertirme
en abogada defensora a tiempo completo
que trabajaba
para un centro de vida independiente
en 1982, fue entonces
cuando me comprometí por completo
en el cambio del sistema
y en cómo desarrollar políticas,
cómo organizar, cómo apoyar...
los derechos, las voces y las preferencias
de otras personas.
Debido a que viví en Connecticut,
y el autor original
de la Ley para Estadounidenses
con Discapacidad...
Cuando se introdujo por primera vez,
estaba el Senador Weicker de Connecticut.
El Senador Weicker era el padre
de un gran joven que tenía
Síndrome de Down.
El Senador Wicker estaba muy involucrado
con la comunidad de defensa
de la discapacidad en Connecticut.
Más tarde tuve la increíble oportunidad
de viajar a Boston, y testificar
en una de las audiencias
llevadas a cabo fuera de Washington
más importantes del Congreso,
sobre la Ley para Estadounidenses
con Discapacidad.
La primera vez, el proyecto de ley
no fue aprobado.
Sin embargo, fuimos promovidos.
Cuando aprobaron la ADA,
en el período en el cual
se introdujo el proyecto de ley
y se estaban organizando los votos,
recuerdo que teníamos pilas y pilas
de postales color fucsia.
Estábamos organizando gente
a lo largo de todo el país
para firmar esas postales,
apoyando la aprobación de la ADA.
Luego, esto resultó ser
una experiencia maravillosa,
pero a la vez engañosa.
De hecho, tuvimos éxito.
¡El proyecto fue aprobado!
Recuerdo haber pensado:
"Esto no fue tan difícil".
"Tuvimos que intentarlo dos veces,
pero no fue tan difícil."
"Vayamos por más legislaciones".
Pero resultó que no era tan fácil
como me parecía,
no se trataba sólo de postales fucsia,
y reuniones y marchas.
Todo eso ayudó, pero...
incluso todo eso, a veces hoy en día
no es suficiente para cambiar la política.
Pues bien, ese fui mi primer viaje
a 1990.

Cuéntanos del momento
donde te diste cuenta
que la ADA está o no marcando el cambio
y hasta qué punto,
basándote en tus pasiones
y áreas de experiencia,
¿Dónde ves o no ves
el impacto de la ADA?
La ADA ha tenido
un gran y profundo impacto.
Es importante para mí
comenzar, al hablar del presente,
mientras nos embarcamos en la ADA 30.
Es muy importante comenzar
por cuánto han cambiado las cosas.
Algunos de los esfuerzos para eliminar
barreras arquitectónicas,
algunas de las significantes mejoras
en la comunicación eficaz
de manera igualitaria,
algunos de los requisitos
de los programas.
Todo eso ha cambiado significativamente,
La mayoría...no, no puedo decir mayoría.
Con frecuencia...
han habido grandes iniciativas
a lo largo de los años,
pero siempre hemos tenido que mantener
una batalla implacable...
...para impedir que nada se nos escape,
para no permitir que nada pierda
el impulso
hacia la accesibilidad.
Si apartamos la vista por un minuto,
nuestros derechos nos serán arrebatados.
Puedo hablar ciertamente
acerca de la actualidad...
Lo que puedo decir con respecto
a dónde nos encontramos hoy,
no es la situación ideal,
y lo que sí quiero
es tomar un poco más de tiempo
para señalar
el significante progreso...
...en muchos aspectos de la vida cotidiana
en los que podemos señalar
fallas en el cumplimiento de la ADA,
la ejecución de la ley, pero...
...sucede a menudo,
en comparación con los ejemplos
en donde sí está funcionando.
Cuando el transporte no es accesible,
lo señalamos, porque...
...conocemos las prácticas
buenas y prometedoras
que se han implementado
para la accesibilidad al transporte.
Hace que las fallas sean más graves,
en cuanto a vivienda, empleo,
en los tipos de dispositivos
de asistencia
que están disponibles,
el diseño universal
de los lugares y los objetos.
Todo eso apunta a...
...los ejemplos en donde
sí lo estamos haciendo bien,
y en un contraste marcado con las áreas
en las que nos estamos equivocando mucho.
Debo decir que...
...muy recientemente,
he llevado la participación
de mi organización
a una petición
al Departamento de Salud
y Servicios Humanos de EE. UU.,
para exigir que las personas
con discapacidades
sean reubicadas inmediatamente
fuera de los asilos de ancianos
y otros establecimientos comunitarios,
debido a las terribles...
...circunstancias
en dichos establecimientos
debido al COVID-19
y por no proporcionar
la protección adecuada
para las personas con discapacidades
en entornos institucionales.
La ADA, en el año 1990,
claramente le otorgó
a las personas con discapacidades
derechos significantes.
Incluso cuando se impugnó...
...en 1999...
...el caso Olmstead,
el cual era un caso de Georgia,
dos mujeres...
Lois and Elaine...
Lois Curtiss, una mujer increíble
con la que tuve el placer de estar
en varias ocasiones...
Ambas mujeres....
...demandaron tener el derecho
a vivir en el entorno más integrado
y adecuado a sus necesidades.
La desición... El caso llegó
hasta la Corte Suprema.
Yo estuve entre aquellas personas
que durmieron en las escaleras
de la Suprema Corte
la noche anterior
a que se supiera el veredicto,
y estuve entre los que celebraron
frente a la Corte Suprema
el día que el caso se resolvió a favor
de los derechos de Lois y Elaine,
y de los derechos de miles,
decenas de miles,
millones de personas con discapacidades
de vivir en el entorno más integrado
y adecuado a sus necesidades.
Debido a que ya han pasado
21 años desde aquella decisión,
el día de ayer, la Unión Estadounidense
por las Libertades Civiles
presentó una petición,
y el Instituto Mundial de Discapacidad
se unió a otras organizaciones
para discapacitados
para presentar esa petición, exigiendo
que las personas con discapacidades
sean reubicadas de forma inmediata
fuera de estos
establecimientos comunitarios.
Decenas de miles de personas
han fallecido
en los últimos 100 días.
El genocidio de personas
con discapacidades
debido a la falla
en la implementación
de aquella decisión de Olmstead,
y las fallas de nuestro gobierno
en proveer el tipo de apoyo y servicios
que permite a las personas
con discapacidades vivir seguras
y con el apoyo que necesitan
en la comunidad.
Y muy...
...exasperadamente, nuestros pedidos
continuos y persistentes
para que las personas con discapacidades
sean atendidas adecuadamente
en estos desastres
han sido ignorados.
La conclusión ha sido, nuevamente,
que a lo largo de los últimos 100 días
decenas de miles de personas
con discapacidades han fallecido.
Cuando fui llamada, diciendo que esas
eran personas con discapacidades...
He conversado con varios
altos funcionarios del gobierno
quienes me preguntaban: "¿Por qué hablas
de personas con discapacidades?",
"Se trataba de personas mayores
con afecciones subyacentes,
que vivían en asilos de ancianos
y en instalaciones de cuidado prolongado."
Bien, uno no va a un asilo de ancianos
porque sea viejo,
Vas a un asilo de ancianos
porque tienes una discapacidad
y los apoyos y servicios que necesitas
para permanecer en la comunidad
no te han sido proporcionados.
La gran mayoría, podría decirse,
de todas esas muertes
en instalaciones comunitarias
son de personas con discapacidades,
mayormente gente de color,
y gente viviendo en la pobreza.
Las fallas de la Ley para Estadounidenses
con Discapacidades,
la desición Olmstead,
y la voluntad de nuestro gobierno
de monitorear y hacer cumplir esta ley
y la ley de rehabilitación, tienen...
...un impacto devastador
sobre nuestra situación actual
y la muerte de nuestros hermanos.
Y no pareciera que vaya a acabar.

Bien, pasamos al futuro.
Con el trabajo que has estado haciendo,
has visto muchos progresos y obstáculos.
Si pudieras cambiar una cosa
o hacer que algo suceda
para tener acceso e igualdad...
Sé que es difícil...
Una cosa para brindarles acceso e igualdad
a las personas con discapacidad,
¿Qué cosa sería?
Una cosa que debe suceder...
Las personas con discapacidades
tienen protección de sus derechos civiles
contemplados por ley.
Y la única cosa que debe suceder
es que sus derechos sean monitoreados
y ejecutados sin excepción.
Seguir las leyes no es suficiente.
Necesitamos que el diseño universal
sea el estándar,
necesitamos que la accesibilidad
y la adaptación
estén fácilmente disponibles.
Pero debemos tener
monitoreo y ejecución.
Cada dólar de fondos federales
debe gastarse en cumplimiento
de la ley de rehabilitación
y entre lo que exigen
la Ley de Rehabilitación y la ADA.
No debería permitirse
que las personas con esas protecciones
de los derechos civiles
sean negadas repetitivamente
y sean incapacez
de participar plenamente
en la vida doméstica y comunitaria.

Uno de mis dichos preferidos es:

Otro de mis preferidos:
"Nada sobre nosotros, sin nosotros".
Nosotros, como líderes de la comunidad
de personas con discapacidad
necesitamos permanecer unidos.
Necesitamos...
...centrar nuestro trabajo
en torno a las personas
que se encuentran
sumamente marginadas y excluídas.
Necesitamos asegurarnos
de no estar desperdiciando nuestro tiempo
con peleas internas,
y con una especie de...
...comportamiento infantil y divisivo
en el que algunas personas
todavía están atrapadas.
Debemos, sin lugar a dudas,
extender una mano hacia adelante
y otra hacia atrás, permanecer unidos
y continuar sin descanso...
...trabajando para...
...lograr...
...la meta en torno a la cual
la ADA fue escrita,
y por la que muchos de nuestros hermanos
han luchado tan arduamente.
Hemos perdido un número...
...de esos líderes visionarios
que trabajaban muy duro.
Muchos de ellos se han ido
en los últimos años,
algunos se han ido a lo largo del camino.
Tenemos un legado increíble que cuidar.
Tenemos enormes oportunidades
en las cuales trabajar.
La tecnología tiene el potencial
de nivelar el campo de juego
si realmente las personas tuvieran
una accesibilidad verdadera.
El Instituto Mundial de Discapacidad
y nuestro compromiso de trabajar asociados
con otras organizaciones
orientadas a la discapacidad,
y nuestros aliados
para hacer que las comunidades
sean más fuertes

Además de mi propia discapacidad
también soy madre de dos
ya adultos con discapacidades.
Mi esposo tambien tiene discapacidad
y gran parte de mi familia también son personans con discapacidad
Así que los derechos de discapacidad son una gran parte de
todo lo que soy y casi todo lo que hago.
Pasé desde el 2001 en adelante

mis compañeros de clase eran voluntarios
en una institución estatal para personas
con discapacidad y me uní a ellos una vez por
semana y mirando hacia aras de nuevo fue bastante
impactante que a los trece años me asignaron como
profesora de una clase de treinta adultos
que nunca habían tenido la oportunidad de asistir a la escuela.
y ya tenía una maestra de trece años de edad. Una vez por semana. No hace falta decir que aprendí
más de ellos que aprendieron de mí y muchos de ellos y yo hicimos amigos
de mucho del resto de mi camino y
desfortunadamente algunos de ellos ya no estan vivos
pero hay un par de personas que son
un gran parte de mi vida y fortunadamente
ellos lograron liberarse
de esa instituto estatal, entonces ellos y
muchas personas me enseñaron mucho pero la verdadera
experiencia fundamental para mí, estaba trabajando de nuevo
en esa instituto estatal. Esto fue mi primero
trabajo que paga en los servicios de disibilidad
y me habían contratado para trabajar en lo que se llamaba una cabaña
para 40 mujeres con disibilidad intelecutal
y esta cabaña estaba en un terreno hermoso pero vivían in un edificio con 20 en un lado y 20 en el otro lado
y era mí responsibilidad incluso ayudarlos en bañarse y vestirse
y con la comida. Mucho de ellos no podían
alimentarse. Algunas porque nunca
habían tenido la oportunidad y algunas
por su discapacidad física y una falta
de habilidad. Entonces...
cuando estaba la hora de comer, era lo mismo todos
los días. Les sirvieron un plato con tres
montones de comida en el plato. Un monton
siempre fue marrón, un montón fue siempre verde

me metī en problemas porque pasaba demasiado
tiempo y al fin me trasladaron
a un puesto diferente porque pasaba
diemasiado tiempo dandoles una oportunidad
tomar sus propias decisiones
y expresar preferencias

e lavoro per i diritti dei disabili
da tutta la vita,
precisamente
da quando ero una studentessa del liceo.
Attualmente sono il direttore esecutivo
nonché CEO
dell'Istituto Mondiale della Disabilità.
Per anni all'inizio della mia carriera
ho lavorato
per persone che vivono
in programmi residenziali.
Con le persone,
bambini negli ambienti scolastici
persone con riabilitazione professionale,
e a quelle che vivono in comunità,
Lungo la strada,
mi sono interessata molto sui diritti dei disabili
ed ero molto coinvolta
nei primi giorni di avvocatura
prima che l'ADA fosse introdotta.
Ho lavorato per le organizzazioni
sulla disabilità quasi subito.
Oltre alla mia disabilità,

di due adulti con disabilità.
Anche mio marito è disabile,

Ho passato
dal 2001 in poi
concentrandomi molto su ciò che accadeva
alle persone con disabilità
prima, durante, e dopo i disastri.
E questo mi ha preso particolarmente
sin dall'inizio
e infatti, ho avuto l'opportunità
come incaricata nell'amministrazione
di Obama
di passare 8 anni al FEMA,

della FEMA,

la WID che stava costruendo un processo
di pianificazione strategica

riguardo al giorno in cui è
stata sottoscritta, se fosse applicabile?
E qual è l'impatto che ha avuto su te
e gli altri?
Ricordati di premere il tasto

prima di iniziare.
La prima volta che divenni
consapevole fu a un'età parecchio giovane.
Ho avuto un migliore amico nella prima
elementare, si chiamava Gregory,
e io e lui eravamo
dei bei amici.
Abbiamo trascorso un pò
di tempo insieme,
e poi all'improvviso
un giorno, Gregory era sparito,
e io non so cosa gli è accaduto o
dove è andato
e non l'ho saputo fino a molti
anni dopo
che ho scoperto che Gregory

Ma, io...
Ricordo di esser stata confusa e poi
nel corso degli anni successivi,
Ho vissuto in una cittadina che era
anche la casa di Save the Children,
ed ero sempre molto interessata al
lavoro che stava svolgendo,
e sono imbarazzata ad ammetterlo
ma il mio primo coinvolgimento
nell'attività umanitaria era,

e ho trascorso un pò della mia infanzia

Ho avuto l'opportunità di farlo,o ho avuto
l'obbligo di svolgere i servizi sociali,
e quando ho iniziato, questo era l'anno
con la prima giornata della terra
e ho iniziato a rompere il vetro
al centro locale di riciclo,
ed mi è sembrato
veramente noioso,
ma un pò di miei compagni di classe
erano volontari
all'istituzione statale per
persone con disabilità,
e mi sono unita a loro una volta
a settimana, ripensandoci ancora,
era quasi scioccante che a 13 anni,
Ero stata assegnata come insegnante di
una classe di 30 adulti
che non hanno mai avuto l'opportunità
di frequentare la scuola, e hanno avuto
un'insegnante di 13 anni una volta
alla settimana.
Inutile dire, che ho imparato più io
da loro che loro da me,
ma mi sono divertita, e molti di loro
sono diventati miei amici
nel mio lungo cammino.
Sfortunatamente, alcuni di loro
non hanno vissuto a lungo
ma c'è una coppia di persone che sono
una parte molto importante della mia vita
e fortunatamente, hanno avuto successo
liberandosi dall'istituzione statale.
E, molti altri mi provocavano un pò,
ma la vera esperienza cruciale per me,
è quando stavo lavorando
all'istituzione statale, era il mio primo
lavoro retribuito nei servizi della disabilità,
e sono stata assunta per lavorare
in quello che chiamavano un "cottage"
per 40 donne con disabilità
mentali,
e in questo "cottage" c'erano dei
bellissimi terreni,
ma le donne vivevano in una costruzione,
20 da un lato, 20 dall'altro,
e le mie responsabilità includevano
di assisterle per il bagno, vestirle e
farle mangiare.
Molte di loro erano incapaci
di nutrirsi da sé.
Perché a qualcuno di loro non è mai stata
l'opportunità,
e altri a causa della loro disabilità
fisica
e la mancanza di qualsiasi tipo di
utensili specifici o altri oggetti.
Stavo nutrendo le persone, una sorta di
routine che era la stessa ogni giorno.
Il piatto sarebbe uscito fuori e
ci sarebbero stati
3 mucchi di cibo nel piatto.
Un mucchio era sempre marrone,
un mucchio era sempre verde,
e un mucchio era sempre bianco.
Conosci la carne, la verdura,
e l'amido.
E sai anche che la gente ama
mangiare i propri pasti in modi diversi.
Ci sarebbe anche il dolce
ogni giorno,
gelatina, o gelato, o
qualcosa ancora sempre nel mucchio.
E avrei passato il tempo con ognuno di
loro che consumava
il proprio pasto
e avremmo lavorato insieme,
cercando di capire se
avessero preferito
mangiare prima il loro dolce?
Qualcuno amava fare questo.
Preferivano
un pò di marrone e un pò di
bianco tutto nella stessa forchetta?
Non volevano che il loro cibo fosse
toccato?
Sai e lavoravo
avanti e indietro
con loro per cercare di capire
le loro preferenze e
sono finita nei guai
perchè passavo troppo tempo
e alla fine, presi una posizione
diversa perchè prendevo troppo
tempo nel dare alle persone
un'opportunità per fare
qualche scelta ed esprimere
delle preferenze.
Questo era talmente fondamentale e
in molti modi, queste premature
esperienze mi hanno guidato
a chi sono e cosa credo
in tutti gli anni successivi.
Nei termini dell'ADA,
Ho avuto un'esperienza molto intima
con quella che al tempo era
chiamata
"legge pubblica 94142", la legge
sulla formazione dei portatori di
disabilità, dopo rinominata
Legge degli Individui con Disabilità,
IDEA
e ho avuto un'esperienza molto
famigliare
con l'IDEA e sono diventata
consapevole delle
iniziative legislative e di come
l'IDEA
fosse scomparsa. E allora
ho iniziato
a diventare più consapevole
del lavoro svolto.
Questo era negli anni 70,
il lavoro svolto su altre iniziative
legislative,
la 504,
il passaggio della legge
sulla Riabilitazione, seguita dalla
protesta sulla 504 a San Francisco
che ha messo
i regolamenti sul posto.
Ha catturato
fortemente la mia attenzione e
tra un pò
di informazioni mentre stavo andando a
lavoro
Stavo facendo e
diventando un avvocato a tempo pieno
che stava lavorando per una struttura
residenziale assistita
nel 1982, e allora sono rimasta
pienamente coinvolta
nel cambiamento del sistema e
come è cresciuta
la politica, come organizzare,
come supportare
i diritti e le preferenze delle
altre persone e perchè
ho vissuto nel
Connecticut e
l'autore originale
dell'ADA,
la prima volta che la legge era
stata introdotta era dal
senatore Weicker del Connecticut,
e
lui, padre di un grande
giovane uomo
che ebbe la Sindrome di Down.
Il senatore Weicker era molto
coinvolto con
la comunità per la difesa
della disabilità nel
Connecticut, e allora ho avuto
l'incredibile opportunità
di andare a Boston e
testimoniare
a una delle principali udienze
del Congresso
sulla questione dell'ADA.
Per certo, saprai
che al primo giro, la legge
non passò
ma eravamo su di giri
e nel passaggio dell'ADA,
nel periodo in cui
una volta la legge era stata
reintrodotta e i voti
erano organizzati, ricordo che
abbiamo avuto
pile e pile e pile di luminose
cartoline rosa e stavamo
organizzando
con le persone di tutto lo stato
la crescita,
la firma di queste cartoline per
supportare
il passaggio dell'ADA e
questo era
meraviglioso ma forse
un'esperienza un pò ingannevole,
in realtà avevamo avuto
successo. La legge era passata!
E io pensando
"Oh, bene questo non era
difficile
Dico, abbiamo dovuto farlo due volte
ma questo non era così difficile.
Facciamo qualche altra legge!"
Risultò che non era così semplice
come immaginavo. Non erano solo
cartoline rosa e incontri e
marce. Ha aiutato ma
qualche volta in quei giorni
non sembrava abbastanza
per cambiare la politica.
Così è iniziato il mio primo viaggio
nel 1990.

al presente adesso. Sai che

Così l'ADA ha avuto un impatto
enorme e radicale
ed è importante per me
iniziare a parlare
del tempo presente e di come
ci stiamo imbarcando
sull'ADA 30
è veramente importante iniziare
con quante cose assolutamente sono
cambiate, sai
gli sforzi
per la rimozione delle
barriere architettoniche,
alcuni significativi miglioramenti
in una comunicazione altrettanto
efficace
alcuni requisiti intorno ai programmi,
abbiamo la maggior parte di questi
significativi cambiamenti
che non possiamo dire
nel tempo, spesso
ci sono state delle grandi e buone
iniziative nel corso degli anni
ma abbiamo dovuto mantenere
un'incessante battaglia per
non lasciare sfuggire niente,
per non perdere
nessun momento verso
l'accessibilità.
Se guardiamo fuori per un minuto,
i nostri diritti saranno spazzati via.
E io posso certamente parlare
del momento presente,
e cosa ho da dire su dove
siamo oggi, e non è buono
e così voglio prendere un pò
di tempo in più
per gridare dei progressi significativi
in molti aspetti della vita quotidiana
nel quale possiamo
gridare dei fallimenti nell'osservanza
dell'ADA
del rinforzamento della legge,
ma spesse volte
nel comparare gli esempi di dove
stiamo lavorando, quando il trasporto
non è accessibile, stiamo gridando
perchè conosciamo le pratiche
buone e promesse che
sono state messe
per l'accessibilità del trasporto
rendono i fallimenti così ecclatanti
negli alloggi,nel lavoro, nei diversi tipi
di
attrezzature per l'assistenza che sono
accessibili,
il disegno universale dei posti
e delle cose
di tutti i punti che abbiamo spiegato
di dove stiamo
facendo la cosa giusta e
il netto contrasto
delle aree dove stiamo
facendo la cosa sbagliata.
Dico che molto recentemente,
Ho coinvolto la mia organizzazione
in una petizione al dipartimento
americano della Salute e delle Risorse umane
chiedendo che le persone con disabilità
siano immediatamente portate fuori
dalle case di riposo
e altri posti sono
dovute a orribili circostanze
causate
dal covid-19 e al fallimento
nel provvedere ad appropriate
protezioni
per le persone con disabilità
negli ambienti istituzionali.
L'ADA nel 1990
ha dato chiaramente alle persone
con disabilità
diritti significativi, e...
anche quando siamo stati sfidati
nel 1999, nel caso Olmstead,
era un caso della Georgia, e due donne
che erano Lois e Elaine,
Lois Curtis
una donna incredibile che ho
avuto il piace di conoscere in
un gran numero di occasioni,
due dei quali
era stato domandato se avessero
avuto il diritto di vivere
nell'ambiente più integrato e
appropriato per i loro bisogni
e le proprie decisioni, il caso è andato
dritto alla corte suprema
e io ero tra quelli che
hanno dormito fuori al
palazzo della corte suprema
la notte prima che il loro caso
fosse ascoltato
e io ero tra le persone
che hanno celebrato di fronte
la corte suprema nel giorno
che la decisione è venuta fuori
a favore dei diritti di Lois e Elaine,
e i diritti di duecento,
decine di migliaia,
millioni di persone con disabilità
per vivere in un ambiente più integrato
appropriato ai loro bisogni,
Sono 21 anni dopo quella decisione,
ieri l'Unione Americana Civile per
la libertà
ha sottoscritto una petizione.
e l'Istituto Mondiale
della Disabilità si è unita a
diverse organizzazioni per portare
quella petizione
domandando che le persone con
disabilità
siano immediatamente trasferite
fuori da quelli ambienti.
Decine di migliaia di persone sono
morte
negli ultimi cento giorni,
un genocidio
di persone con disabilità a
causa
dei fallimenti dell'attuazione della
decisione di Olmstead, e i fallimenti
del nostro governo a provvedere
diversi tipi di supporti
e servizi che consentono
le persone con disabilità
di vivere al sicuro e con il supporto
che hanno bisogno nella comunità
e, molto infuriati abbiamo continuato
con chiamate insistenti per
le persone con disabilità di
essere adeguatamente aiutate...
nei disastri sono stati ignorati,
e la linea di fondo è stata che
ancora oltre
gli ultimi cento giorni decine di
migliaia di persone con disabilità
sono morte. E quando ho gridato,
dicendo che quelle persone
con disabilità, hanno avuto con
un gran numero di governi superiori
delle conversazioni.
chi, come, perchè lo stanno dicendo
persone con disabilità?
e sai, ci sono gli anziani
che vivono sotto determinate condizioni
nelle case di riposo
e in strutture di cura a lungo termine.
Tu non vai in una casa di riposo
perchè sei vecchio, ci vai
perchè hai una disabilità e
dei supporti e servizi di cui hai
bisogno,
per restare nella comunità, che non
ti sono stati dati.
E la maggior parte, si potrebbe dire
che tutte le morti in queste strutture
sono
di persone con disabilità, la
maggior parte di loro
sono di colore e che vivono
in povertà. I fallimenti dell'ADA,
la decisione di Olmstead,
e il monitorare e rinforzare questa
legge
del nostro governo
e la legge sulla Riabilitazione ha
un impatto devastante su ciò che
siamo oggi.
E molte morti dei nostri fratelli.
Senza che si intraveda alcuna conclusione.

delle persone con disabilità
quale potrebbe essere?
Una cosa che deve accadere:
le persone con disabilità devono
avere la protezione sui diritti civili
dalla legge e un'altra cosa
che deve accadere
e che quei diritti devono essere
monitorati
e rinforzati senza eccezione.
Seguire la legge non basta,
abbiamo bisogno di un
disegno universale che sia
standard, abbiamo bisogno
di accessibilità e sistemazione
per essere facilmente disponibili,
ma dobbiamo avere
monitoraggio e rinforzo.
Ogni dollaro federale dovrebbe
essere speso
in osservanza della legge sulla
Riabilitazione.
E tra cosa è la RA e cosa l'ADA
richiede che
dovrebbe esserci, nessun dolore
per le persone alle quali i diritti
vengono protetti e per poi essere
ripetutamente negati
e incapaci di partecipare
pienamente
alla vita quotidiana e alla
comunità.
Monitoraggio e rinforzo
devono essere la base

proprio adesso?
Cosa possiamo fare di giusto dici,
sai,
uno dei miei motti preferiti
è "non arrenderti, non arrenderti".
Un altro è, "Niente di noi senza di noi."
Come capi della comunità dei disabili
abbiamo bisogno di essere uniti insieme
abbiamo bisogno di incentrare
il nostro lavoro intorno alle persone
che sono fortemente emarginate, escluse.
Abbiamo bisogno di essere sicuri che
non stiamo perdendo
tempo in lotte interne, e con
un tipo di comportamento infantile che
divide le persone che continuano
ancora ad attaccarsi,
dobbiamo assolutamente andare con una
mano avanti,
e con l'altra indietro, restare insieme
e continuare inesorabilmente
a lavorare verso la realizzazione
dell'obbiettivo
che è stato scritto nell'ADA e
per il quale molti nostri fratelli
hanno combattuto così duramente.
Abbiamo perso un mucchio di
quei leader visionari operosi;
molti di loro
si sono persi in questi anni,
alcuni di loro
si sono persi lungo la strada,
abbiamo un incredibile eredità
di cui prenderci cura, abbiamo
grandi opportunità per il lavoro,
la tecnologia ha il potenziale per
aumentare il livello
nel campo di gioco,
se le persone avessero vero
accesso e l'Istituto Mondiale
sulla Disabilità e il nostro
impegno per
lavorare in collaborazione con
altre
organizzazioni sulla disabilità e
i nostri alleati rendono le comunità
più forti, più resilienti per l'intera
comunità perchè possiamo farlo

안녕하세요, 저는 마시 로스입니다
저는 성인이 된 후로 지금까지
장애인 권리를 위해
일해왔습니다
세계장애인협회(WID)에서 일했고 현재는 그 조직의 CEO이자 상무이사입니다.
저는 여러 해 동안 이 단체에서 일했고 처음 이 단체에 들어와서는
지역 프로그램을 통해 지역 사람들과
함께 일했으며
그 이후에 학교에 다니는 어린이들과 일했고
직업 재활기관의 사람들,
그리고 지역사회 환경 프로그램과 관련하여 일했습니다.
그 과정에서 거는 장애인들의 권리에 대해 많은 것을 배웠고
ADA가 창설 되기 전에 이미 장애인들의
권리에 대해서 아주 잘 아는 사람이 되었습니다.
그 이후부터 지금까지 계속해서 장애인의 권리를 옹호하는 단체에서 일했습니다.
추가적으로 말하자면 저 자신도 장애를 잃고 있으며
제 두 자녀 역시 장애인입니다.
두 아이는 현재 성인이 되었습니다.
제 남편도 장애인이며
제 가중 중에 많은 수가 장애를 가졌기 때문에
장애인의 권리는 제 삶에서
너무나도 중요하다고 할 수 있습니다.
저는 2001년부터 계속해서 이 단체에서 일했고
장애인들이 어떤 일을 겪어서 장애를 가지게 되었는지
집중해 왔습니다.
그 이후로 저는 정말로 집중해서 제가 가진 장애에 대해서 생각해 볼 수 있었습니다.
실제로 저 8년 동안
오바마 행정부로부터 임명을 받아
FEMA의 장애통합조정 사무소라는 기관을
설립 및 운영하기도 했습니다.
그리고 같은 조직의 장애인 전문가로서
조직의 중역을 위임하고 기관을 유지하는 일을 했습니다. 그리고
조직 관리자들, 위급상황을 책임지는 중견 관리자들,
그리고 긴급 구호 조직에서 장애인을 위해 일하는 사람들을
지원하는 일도 맡았습니다.
그리고 재난이 발생했을 때 대응하고 문제를 완화시키고자 노력해 왔습니다.
지난 9월 이후 세계장애인협회와
계속 일해 오면서
전세계의 장애인들의 인권에 계속 집중해 왔으며
이 일이 장애인들의 국제적인 인권에 적극적으로 참여할 수 있는 기회로 이어졌고
저는 전략적 계획을 세우고
새로운 우선순위를 확보하여 기관을 돕기 위해
WID와 연합하여 일하는데 저의 시간을 보냈습니다.
그리고 기관의 사명을 이해하고
특히 최근에는 우리가 나아가야 할 바가 무엇인지 어떤 분야에 집중해야
하는지를 모색하느라 바빴습니다.

좋아요. 첫 번째 질문은 이전에 있었던 일에 대한 겁니다.
장애인들이 당면한 접근성 문제, 차별, 소외의 문제를
가장 먼저 깨달으신게 언제인지 말씀해 주세요.
직접 겪으신 일이나 지인으로부터 알게 된 이야기도 괜찮습니다.
미국 장애인법과 관련해서요.
장애인법이 설립될 당시에 관련해서 기억나는 일이 있으신가요?
그 일이 마르시와 주변 사람들에게 어떤 영향을 주었나요?

저는 아주 어린 나이에 장애인에 대해서 배웠습니다.
제가 초등학교 1학년일 때 가장 친한 친구였던 그레고리는
저랑 정말 친했는데요.
우리는 같이 시간을 많이 보냈어요.
그러던 어느 날 그레고리가 사라졌어요.
저는 그에게 무슨 일이 일어났는지 또는 그가 어디로 갔는지
알지 못했는데 몇 년 지나지 않아서
그레고리에게 다운 증후군이 있다는 사실을 알았습니다.
그레고리는 수업을 받을 수 없었고
그 해에 저는 장애인이라는 걸 처음 인식한 것 같습니다.
분명 그는 다른 학교로 보내진 것 같습니다.
친구를 잃었다는 기분이 저한테는 당혹스러운 거였고
그가 어디로 갔는지 왜 가야 했는지 이해할 수가 없었습니다.
되돌아 보면 우리가 계속해서 친구가 될 수 없다는 사실이 저한테는
유감이었습니다. 그가 이사를 간 것도 아니었고 잠시 제가 다니는 학교
다녔던 것 같아요.
저는 그 때 혼란스러웠고 그 후 몇 년 동안
세이브더칠드런이라는 단체가 처음 생겼던 마을에 살았습니다.
저는 세이브더칠드런이 하는 일에 언제나 아주 많은 관심을 가지고 있었습니다.
조금 인정하기 부끄럽기는 하지만 저는 자선기금을 모으는 활동을 하면서
어린 시절 봉사를 시작했고
저는 어린 시절 많은 시간을 세이브더칠드런을 위해 기금을 모으는 데 보냈습니다.
그리고 자선기금모음 이외의 활동에도 점차 발을 들여 놓았고
다른 장애인을 위한 행사에서 보조적인 일을 하거나
장애인을 돕는 일을 하게 되었습니다.
제 장애가 시작된 건 그 후 몇 년 정도가 지났을 때였고
고등학생 때 저는 지역사회 서비스를 하는데
요구되는 봉사를 하고, 그럴 기회를 가졌었고
그런 봉사를 해야 한다는 의무감도 이미 가지고 있었습니다.
제가 처음 장애를 가지게 되었을 때는
지구의 날(Earth Day)이 제정이 처음 된 해였고
지역 재활용 센터에 깨진 유리를 가져다 주는 봉사를 시작했던 때였습니다.
깨진 유리를 줍는 일은 정말 지루했지만 제 친구들 여러 명이
주가 설립한 기관에서 장애인을 위해
봉사를 하고 있었습니다 저는 1주에 1번씩
봉사를 했고 돌이켜보면
좀 놀라운 일이기도 한데 13살 때 저는 30명의 성인을 대상으로 한
강의의 선생님 일을 하고 있었습니다.
그들은 학교를 한 번도 다니지 않은 사람들이었고
13살에 선생님인 제가 그들을 1주에 한 번씩 가르쳤습니다.
분명한 사실은 제가
저라는 부족한 사람에게서 배운 것보다 훨씬 많은 것들을 그들에게서
배웠다는 점이었고, 우리는 즐겁게 지냈으며
아직도 그분들과 친하게 지나고 있습니다.
불운하게도 그들 중 일부는 이미 돌아가셨습니다.
그러나 그들은 정말 제 삶에서 아직도
중요한 사람들이고
그들은 주 기관에서 교육을 받아서
현재는 읽고 쓸 수 있게 되셨습니다.
그들과 다른 사람들로부터 저는 많은 것을 배웠고
삶의 가장 중요한 측면들을 경험할 수 있었던
것 같습니다. 이것이 제가 장애인을 위해
처음으로 돈을 받고 일을 했던 경험이었습니다.
그리고 지적장애를 가지지 않은 40명의 여성 장애인들을 위해서
작은 공간에서 유급으로 봉사를 하기도 하였습니다.
그 공간에 아름다운 정원이 있었고 건물 한 쪽에 20명의 여성이 살고 다른 한 쪽에 20명의 여성이 살았습니다.
저는 그들이 목욕을 하고 옷을 입고
식사를 하는 일을 도왔습니다.
다수가 스스로 먹을 수가 없었습니다.
그들 중 어떤 이들은 육체적인 일은 전혀 하지 못했고
도구를 사용하거나
식가를 하용할 수도 없었습니다.
저는 매일같이 그들이 식사하는 것을 도왔습니다.
식판이 나오고
식판에 음식을 세 번 담았습니다.
갈색, 녹색, 그리고 흰색
음식이 항상 나왔는데요
갈색은 고기고 녹색은 채소, 그리고 흰색은 죽이었습니다.
사람들은 각각 다른 방식으로 식사를 하는 걸 좋아했습니다.
매일 디저트가 나왔는데
프루트 젤리나 아이스크림이었습니다.
그렇게 매일 네 종류가 나왔습니다.
저는 식사를 하는 사람들과 시간을 보냈고
사람들이 디저트를 제일 먼저 먹는걸 좋아하는지
아닌지 알기 위해서 애썼습니다.
그들이
고기를 조금 먹고 그 뒤에 밥을
조금 먹는 걸 좋아하나? 아니면
음식에 내가 손을 대는 걸 좋아 하지 않나?
저는 그들 사이를 왔다 갔다 하면서
좋아하는게 뭔지 찾으려고 애썻고
그걸 알려고 너무 시간을 쓰다가
다른 일에 배정되고 말았습니다
문제가 있었던 거죠.
저는 사람들이 선택하는 걸
돕고 싶었고 어떤걸 좋아하는지도
알고 싶었던 거에요.
그런 일은 장애인을 돕는데 정말 중요합니다,
그런 어린 시절 경험이
지금의 제가 되었고
저의 믿음을 구성하였습니다.
미국 장애인법이 시행되고나서
저는 공법 제 94142조라고 부르는 법과
아주 밀접한 일을 하게 되었습니다.
모든 장애인의 교육을 위한 법이라고 알려진 법이며
개별 장애인의 교육을 위한 법(IDEA)라고
나중에 이름이 바뀐 법인데요, IDEA는 당시 저희 가족과도 관계가 있는 법이었습니다.
저는 입법이 처음 시작 될 때부터 그 법에 대해서 알았고
IDEA가 어떻게 의회에서 통과과 되었는지
그들이 한 일을 사람들이 어떻게
더 많이 알게 되었는지도 직접 목격하였습니다. 1970년대에
다른 입법안들이 발의 되었는데
재활법 제 504조가 발의될 당시에
504조가 샌프란시스코에서
발의되었는데
저는 그 과정을 모두 보았고
정말 흥미로운 일이었습니다.
그에 관한 정보도 이미 들었었고
샌프란시스코에 직접 가서
하루 종인 그 법의 옹호자로서
일도 했었습니다.
1982년 장애인자립 재활센터를 설립할 당시에도
그곳에 갔었고 시스템이 바뀌고
정책이 변화할 때 그 일에 깊이 가담했습니다.
어떻게 기관이 조직되고 권리를 옹호하게 되는지
다른 사람들이 무슨 의견을 가지고 있었는지를
계속 볼 수 있었습니다. 제가 당시 코네티컷에 살고 있었고
미국 장애인법이 맨처음 생겨난 곳이
바로 코네티컷이었기 때문입니다.
법을 처음 시작했던 사람이 코네티컷 주의 상원의원
윌 웨이커였는데, 그에게는 다운 증후군을 앓는
아들이 있었습니다.
웨이커 의원은 코네티컷에서
장애인을 옹호하는 지역사회에
깊은 관심을 가진 사람이었습니다
그 이후 저는 보스턴으로 갈 기회가
있었고 그곳에서 국회의원이자
시장인 오웬이 미국 장애인협회의
주장을 듣게 만들고 그에게 우리의 주장을
알릴 수 있는 놀라운 기회가 저에게 주어졌습니다.
몰른 처음에 법안은
통과되지 못했습니다.
그러나 이럴 수가, 우리는 계속
ADA를 입안하라고
그에게 관철하고자 했습니다.
시간이 지나자 그 법안이
정말로 다시 도입이 되었고 사람들이 모여들었습니다.
제가 기억하건데 우리는 밝은 분홍색 포스트 카드를
들고 거리로 나갔고
국가 전역에서 온 참여자들로 붐볐으며
ADA 입법을 통과시키라고
주장했습니다.
그 일은 정말 놀라웠지만
사람들이 이를 두고 조금 오해할 소지도 있었고
우리는 그래도 정말 성공했습니다!
법안이 통과된 것입니다! 저는 기억합니다.
일이 정말 어려웠던 것도 아니었고 시위에
두 번이나 참여했지만, 시위가 어려운 것은 아니었습니다.
통과된 법안에 대해서 이야기 하자면
일을 그렇게 만든건
분홍생 포스트 카드도 아니었고
회의와 사람들의 행렬도 아니었습니다.
그런 모든 일이 도움이 됐을 것입니다.
요즘에 들어서 이런 일은 정책을
변화시킬 만큼 충분하지는 않은 것 같습니다.
1990년대 제가 젊은 시절
겪었던 일입니다.

제가 2시에 다른 인터뷰가 있어서
세 가지 질문 정도가 남은 것 같아요.
현재, 미래
그리고 행동에 대한 소명에 대해 얘기해
보려고 합니다.
먼저 현재에 대해서 말해보죠. ADA는
정말 이전 법안들과는 달랐는데요.
ADA가 정말로 차이를 만들어 냈다거나,
차이를 만들어 내지 못했다고 느꼈던 그런 중대한 순간이 있었나요?
당신의 전문분야에 대한 열정과 전문성을
가지고 말씀해 주세요. 어느 지점에서 ADA의 영향력을 보셨나요?
마르시: ADA는 크고 광범위한
영향력을 만들어냈습니다. 이 법의 시작이 저한테는 중요합니다.
현재에 대해서 이야기 하자만, 우리는
ADA30에 대해 관여하고 있습니다.
어떻게 이런 변화들이 있었는지 이야기하는게 저한테는 정말 중요합니다.
틀럼없이 사회적이고 구조적인 문제점들을
해결해 나가고자 했던 노력이 필요했던게 분명합니다.
효과적인 의사소통이
필요했고 효과적인 개선도
똑같이 필요했습니다.
프로그램을 두고 요구사항이 있었습니다.
그러한 것들이 관철이
되었을 때 법안들이 조금씩 바뀌었습니다.
다수의 훌륭한
입법들이 존재했습니다.
여러 해가 지나고나서
우리는 장애인의 접근성에 대한 문제에서
중요한 지점을 놓치지 않기 위해서
끊임없이 노력을
해야 했습니다.
만약 우리가 잠시라도 한눈을 팔게 되면
우리가 주장하는 권리를 모두 관철시키지 못하게 될 수 있었고
바로 현재에 대해서 제가 조금 말하자면
그리고 오늘날 우리가 어디쯤에
와 있는지를 말하자면
아주 잘 되고 있지는 않은 것 같기도 합니다.
오늘 일상에서 벌어지는 아주 많은 관점에서
분명한 진보가 있다고 말할 수는
있겠습니다.
ADA 법안이 실제 이행된 것을
두고 실패라고 단정지을 수도 있겠으나
그건 관점과 비교의 문제이기도 합니다.
어디에서 그게 잘 작동되고 있는지의 문제이기도 합니다.
예를 들어 교통 수단에 장애인이 접근할 수 없다고 주장할 때
우리가 그렇게 이야기하는 이유는
장애인들이 교통수단에 잘 접근할 수 있게
하기 위해서 우리가
매우 훌륭한 정책들을 이미 주장을 한 바가 있었으나
말도 안되는 실패를 경험했기 때문입니다.
주거문제, 고용의 문제 등 이런 문제를 두고 우리는
적용 가능한 해결책을 제시했습니다.
장소와 수단에 대해서도 보편적인 접근법을 제시한 바 있습니다.
어느 지점이 잘 적용이 된 것이고
어느 지점에서 무언가가 잘못될 거라는 사실을
분명하게 제시했던 거죠.
그리고 이런 말도 덧붙여야 겠어요. 최근에 저희 기관이
미국 보건복지부에 청원을 냈습니다.
그리고 장애인들이 즉시 사설 병원에서
나와야 하고 의회가 그들이 머무를 수 있는 합법적
공간을 마련해야 한다고 주장했습니다.
이건 코로나 19 때문에 장애인들이 굉장히 혹독한
환경에 있었기 때문에 한 주장이었습니다.
그리고 장애인들에 대한 적절한 보호수단이
마련되지 않을 경우에
그들이 더 어려움을 겪을 수 있기 때문이기도 했습니다.
1990년대에 ADA는 장애인들에게
분명한 권한을 만들어 주었고
1999년 올름스테드 법안으로 인해서 장애인들이 어려움을 겪을 때도 그랬습니다.
올름스테드 법안은 조지아 법이라고도 하며,
루이스 커티스와 엘레인이라는 두 여성이
주장한 법이었습니다.
저는 이 두 여성과
몇 번에 걸쳐 만나볼 영광이 있었니다.
두 여성은 장애인들이
자신의 필요를 채우고 결정을 내릴 수 있는
적절한 환경이 미국에서 보편적으로 필요하다고 주장했습니다.
사건이 항소심으로 대법원 심판을 앞두고
있을 때 저는 대법원 계단 앞에서
잠을 자며 시위를
하던 무리 가운데 있었는데
마침내 판결이 났습니다.
우리는 루이스와 엘레인의 주장을
대법원에서 받아들였다는 사실을 알고
굉장히 기뻐했습니다.
그건 수천, 수만, 아니 수백만 명의 장애인들이
가장 안정적인 환경에서
그들의 필요를 채우며 삶을 영위할 수 있다는 권리가
받아 들여진 것이었기 때문입니다.
저 결정을 내린지 21년이 지났고
어제 미국시민자유연맹은
청원을 했습니다.
그리고 세계장애인협회가
다수의 다른 장애인 기관과 연합하여서
장애인들이 즉시
이러한 환경에서 벗어나야 한다는
정원을 제기했습니다.
수만 명의 사람들이 장애인에 대한 집단 학살때문에
지난 백여 일 동안 사망했습니다.
그 학살의 이유는
올름스테드 결정을 이행하는 과정에서
실패가 있었기 때문이며
정부가 장애인을 안전하게
보호할 수 있는 지원과 서비스를
제공하는데 실패했기 때문입니다.
그리고 지역사회에서
필요한 지원을 하지 못하고
우리가 계속해서
요구하는데도 장애인에 대해
적합한 지원하지 못한 데 대한
격양된 분노가 이 재앙을 낳았습니다.
정부는 우리의 요구를 무시하였고
정부의 정책은 탁상공론에만 머물렀습니다.
지난 수백 일 동안
수천 수만 명의 장애인들이 죽었습니다.
저는 그들에게 가서
장애인을 대표해서 와서 이야기하는 거라고 말해보기도 했습니다.
저는 다수의 정부 고위 관계자들과 대화를
해보았고 그들은 이렇게 말하곤 합니다.
"왜 장애인들에 대해서
말씀을 하시나요? 그들이 살 수 있는 공동시설이 있고
장기적으로 그들을 돌볼 수 있는 시설이
많이 있는데요?" 라고요.
장애인들은 늙었기 때문에 장애인 공동 시설에
입소하지 못하기도 합니다. 장애인들이 이따금
공동시설로 갈 수도 있겠지만
지역사회에서 장애인들이
필요로 하는 서비스와 지원은
장애인들에게 전달되지 않으며,
장애인들을 위한 공동 시설들은 이미 사망한 사람들을
위해서만 사용이 되고 있습니다. 장애인 가운데 대다수가 유색인종이고
가난으로 어려움을 겪으며
미국 장애인법과 올름스테드 법안이
실패한 것을 알고 있습니다. 정부는
이 법이 잘 지켜지는지 감시하고 실제로
준행해야 할 의무가 있습니다.
그리고 장애인재활법은 오늘날
우리가 하고 있는 일에 나쁜 영향을 주고 있으며
우리의 형제 자매들 다수를 죽음으로 몰아 넣었습니다.
지금으로서는 이 일이 끝날 기미가 보이지 않습니다.
마르시. 좋아요. 선생님께서 계속 해오신
일의 미래를 한 번 보도록 하겠습니다.
많은 일이 진행되었고 장애물도 굉장히 많이 보셨을 텐데요
만약 변화해야 할 한 가지를 고르실 수 있다면
혹은 장애인들의 평등과 접근권을 신장시키기 위해 발생해야 하는 한가지가 있다면,
그게 어렵다는 건 저도 알고 있습니다만, 장애를 가진
사람들의 삶에 평등과 접근권을 가져다 주기 위해서 지켜야
할 한 가지가 있다면 그건 뭘까요?
마르시 : 반드시 우리가 이루어내야 하는 한 가지가 있습니다.
장애를 가진 사람들은 보호를 받을 권리를 법적으로 가집니다.
반드시 이루어져야 하는 한 가지는
그들의 권리가 잘 지켜지고 있는지 감시하고
예외 없이 시행 되도록 해야한다는 것입니다.
법을 그저 따르기만 하는 것으로는 충분치 않습니다.
우리는 이 법이 여러 사람이 사용할 수 있는 보편적 기준이 되게 하기 위해서 노력해야 합니다.
우리는 이 법이 시행되어 장애인들이 유익을 입을 수 있도록
법을 잘 준행하도록 노력해야 합니다.
우리는 반드시 연방 정부가 사용하는 모든 돈이
재활 법과 관련해서 사용되고
있는게 맞는지 감시하고 법을 그대로 준행시켜야 합니다.
그리고 재활법과 ADA가 요구하는 대로 돈이 사용되는지 확인해야 합니다.
이러한 시민의 권리와 보호에 관한 법을
사람들은 도외시하며 계속해서
이 법들의 입안을 거절하고 지역사회와 가정에서
누구도 이 법을 위한 어떤 참여도 하지 않고 있습니다.
감시와 시행은 건물로 치면 기초와 지붕의 관계와 같습니다.
그러나 이러한 시민의 권리에 관한 법은
정말로 시작단계에서 발전하지 않고 있는게 사실입니다.
고맙습니다. 그러면 우리는 뭘 할 수 있는거죠? 어떤 단계를
지연사회 구성원인 우리가 밟을 수 있는 걸까요?
"절대 포기하지 말자. 절대 절대로"가 제가 좋아하는 경구입니다.
제가 좋아하는 다른 경구는
"우리가 없으면 사회에는 아무도 없다!"입니다.
장애인 지역사회의 지도자들인 우리는
함께 일해야 합니다.
우리는 소외된 사람들을 소외시키지 않기
위해서 매우 노력해야 합니다.
우리는 일부의 직원들이 하는
조직에서 불화를 일으키는 행위를
근절해야 하며 거기에 시간을 낭비해서는
안 됩니다. 우리는 반드시
앞으로 나아가야 하며 과거를 돌아보아야 하고
서로 더 협력해야 하며 지치지 말고
나아가서 ADA의 역사를 다시 써야 하며
우리와 함께 하는 형제 자매들이
이를 위해서 정말 열심히
일하고 있습니다.
우리는 다수의 비전을 가진 지도자를 잃었습니다.
그들 중 다수는 최근 몇 해 동안에 잃었습니다.

Olá! Me chamo Marcie Roth,
e venho trabalhando com

ao longo de toda minha vida,

na Universidade.
Atualmente, sou a diretora executiva e
CEO do Instituto Mundial de Deficiência, e
trabalhei, ao longo destes anos,

dos programas assistencialistas,

na época da advocacia.

E desde então trabalhei para organizações
de advocacia para deficientes até agora.
Além da minha deficiência,
sou mãe de dois adultos com deficiência.
Meu marido também tem uma deficiência,
e grande parte da minha família também.
Então, os direitos dos deficientes
acabam fazendo parte de tudo que sou
e de praticamente tudo que faço.
De 2001 em diante, eu passei
focando mais no que acontece
com pessoas que possuem deficiência
antes, durante e após os acidentes.
E este tem sido o meu
foco de trabalho exclusivo desde então.
Inclusive, tive a oportunidade de ser
indicada para Gestão Obama,
onde passei cerca de 8 anos no FEMA,
trabalhando na Coordenação
de Integração à Deficiência,
formando um quadro de profissionais
especializados,
auxiliando governantes e gestores
de emergências,
e mais particularmente,
engajando pessoas com deficiência
e organizações especializadas
na preparação para situações de
emergência,
evitando ao máximo acidentes
e reduzindo danos.
E então,
esta foi minha última contribuição
até o Instituto Mundial de Deficiência
desde o último Setembro.
Meu estudo, em andamento, sobre
os Direitos Globais da Deficiência
tem sido algo que eu pude participar,

Me tornei ciente do assunto "deficiência"
bem cedo.
Tive um melhor amigo na primeira série,
o nome dele era Gregory, e
ele e eu tínhamos uma amizade maravilhosa.
Passávamos muito tempo juntos.
Mas de repente, um dia,
Gregory sumiu
e eu não soube o que tinha acontecido
ou para onde ele tinha ido;
não até descobrir, muitos anos depois,
que ele tinha Síndrome de Down
e foi expulso da minha sala
do jardim de infância, e
acho que, naquele momento,
eu já estava no primeiro ano,
e, pelo visto, ele tinha sido transferido
para alguma outra escola, em algum lugar.
E a perda da nossa amizade
foi uma surpresa.
E eu não entendi, sabe?
Para onde ele tinha ido.
Olhando para trás, é estranho pensar
que não conseguimos manter a amizade,
já que ele não se mudou, só parou
de ir para minha escola.
Mas eu...
Lembro do quão confusa fiquei e,
ao longo dos próximos anos,
vivi numa cidade que
era o berço do Save the Children.
Sempre tive muito interesse no trabalho
que a organização fazia.
Tenho até vergonha de admitir
que minhas primeiras experiências
com trabalho voluntário foram assim, sabe?
Essa abordagem envolvendo caridade..
E assim passei parte da minha juventude,
juntando dinheiro para a organização.
Me envolvendo com outras atividades
com a mesma abordagem envolvendo caridade,
mas longe de ser um modelo de apoio para
ajudar aquelas pessoas com deficiência.
Minha experiência com a minha deficiência
só veio acontecer muitos anos depois,
mas quando estava no ensino médio
precisei fazer...
Não consigo me lembrar como se chama!
Trabalho voluntário! Perdão.
Tive a oportunidade de fazer,
na verdade, a obrigação de fazê-lo.
Comecei lá, naquele ano que comemoramos
o primeiro Dia da Terra,
e eu já comecei transformando vidro
no Centro de Reciclagem,
e acabou que não foi tão divertido assim,
na verdade bem chato.
Mas muitos dos meus colegas de classe
estavam fazendo trabalho voluntário
em uma instituição estatal para
pessoas com deficiência.
Participei com eles, uma vez por semana,
Olhando para trás, foi muito chocante que,
aos 13 anos de idade, eu fui designada
como professora
de uma sala com 30 adultos,
que nunca tiveram a oportunidade
de estudar,
e agora eles tinham uma
professora de 13 anos,
uma vez por semana.
Nem preciso dizer que aprendi
mais com eles do que eles com eu.
Foi uma experiência divertida, e
muitos viraram amigos
pelo resto da minha vida.
Infelizmente, alguns deles
já não estão mais vivos.
Mas ainda existem alguns
que fazem parte da minha vida,
e felizmente, tiveram êxito
em se libertarem daquela instituição.
Então, eles e muitos outros
me ensinaram muito.
Mas a experiência primordial para mim,
aconteceu enquanto trabalhava
nesta mesma instituição,
no meu primeiro trabalho remunerado na
na área dos serviços para deficientes.
Eu fui contratada para o que
chamaram de "Chalé"
para 40 mulheres com deficiências mentais.
Esse "chalé" tinha uma ótima localização,
mas elas moravam em partes do Chalé,
20 de um lado e 20 do outro, e
minhas responsabilidades incluíam
ajudá-las no banho, a se vestir e a comer.
A maioria delas não conseguia
se alimentar sozinhas.
Algumas por nunca terem tal oportunidade,
outras por alguma deficiência física,
e pela falta de equipamentos ou utensílios
apropriados para aquela situação.
Então, eu as alimentava e a rotina
acabava sendo a mesma, todos os dias.
O prato ficava pronto,
e teriam
3 porções de comida no prato.
Uma sempre marrom,
uma sempre verde,
e uma sempre branca.
A carne, os vegetais e as fibras.
Eu sei que as pessoas têm
as suas preferências na hora
de comer.
Também tinha uma sobremesa todos os dias.
Gelatina, sorvete
ou algo em porções, como sempre.
Assim, eu passava o tempo com cada uma
daquelas que estavam fazendo
suas refeições
e de certa forma trabalhando juntas
para tentando entender de
elas preferiram comer a
sobremesa primeiro ou não.
Algumas pessoas gostam de fazer isso.
Um pouco da porção de carne
com um pouco da porção de fibras
na mesma garfada?
Não querer ter suas comidas encostando?
Eu trabalhando com elas,
nesses processos,
para entender as preferências pessoais
de cada uma.
Inclusive, acabou sendo um problema,
pois eu gastava muito tempo nisso, e
no final das contas,
acabei mudando de função.
Eu gastava muito tempo dando a elas
a opção de escolha e de preferência.
Então aquilo acabou sendo fundamental,
de muitas maneiras.
E essas primeiras experiências realmente
moldaram quem eu sou e no que eu acredito.
Falando do
Decreto dos Americanos com Deficiência,
Tive uma experiência muito pessoal
com o que eles chamaram de
"Lei Pública 94142" o decreto
Educação para Crianças com Deficiência,
nomeado logo após como
Decreto para Indivíduos com Deficiência,
IDEA.
Tive uma experiência familiar
com o IDEA e conheci as iniciativas
legislativas as quais ele foi aprovado.
Desde então, tenho me informado
do trabalho feito por eles.
Isso aconteceu na década de 70,
junto de outras iniciativas do legislativo
Como a aprovação do
Decreto 504 de Reabilitação,
seguido do protesto 504 "Sit-in",
que aconteceu em São Francisco
para efetivar as leis.
Aquilo chamou minha atenção para
os detalhes das informações que recebia,
e para o trabalho que fazia.
Após isso, me efetivei enquanto Advogada,
trabalhando para um
reabilitação independente em 1982.
Logo, me envolvi com mudanças no sistema,
com o desenvolvimento de políticas,
em como organizar, em como ajudar
os direitos, vozes e preferências
das outras pessoas.
Já que morei em Connecticut, como o autor
do Decreto dos Americanos com Deficiência,
a primeira vez que
o projeto de lei foi pautado
foi pelo Senador Weicker, de Connecticut.
O Senador Weicker, era pai
de um jovem que tinha Síndrome de Down.
O senador Weicker se envolveu muito
com as questões de advocacia para
comunidade dos deficientes em Connecticut.
E então, tive a incrível oportunidade
de ir até Boston testemunhar
uma das oitivas no Congresso, na audiência
do Decreto para Americanos com Deficiência
Como já sabem,
o decreto não passou de primeira.
Mas estávamos tão entusiasmadas
e a aprovação do ADA,
no período em que o projeto tinha sido
votado novamente, com os votos recontados.
Lembro que tínhamos pilhas e pilhas de
abaixo-assinados rosas brilhantes,
e de organizarmos grupos pelo estado
para intensificar o apoio,
através de assinaturas,
ao Decreto ADA.
Você pode até pensar
que essa foi uma experiência maravilhosa
e um tanto desorganizada, mas conseguimos.
O projeto de lei foi aprovado!
Me lembro de ter pensado
"Até que isso não foi lá tão difícil.
Sabe? Tivemos que votar duas vezes,
mas não foi muito difícil.
Vamos aprovar mais leis!"
Acabei percebendo que não era tão fácil
quanto pensei.
Não eram só abaixo-assinados, reuniões
e atos.
Tudo isso ajudou, mas ultimamente não me
parece o suficiente para mudar a política.
E essa foi minha jornada até 1990.

para suas necessidades.
Considerando que estamos à 21 anos
depois desta decisão,
Ontem, a American Civil Liberties Union
Apresentou uma petição
E World Institute on Disability juntou-se
a várias outras organizações de pessoas
com deficiência
Em trazer essa petição
Solicitando que pessoas com deficiência
sejam imediatamente realocadas
Desses grupos de convivência.
Dezenas de milhares de pessoas morreram
nos últimos cem dias,
O genocídio de pessoas com deficiência
Pela ausência da implementação da
decisão de Olmstead
E da incapacidade do nosso governo de
fornecer assistência e serviços
Que permitam que pessoas com deficiência
de vivam em segurança
Com a assistência necessária dentro
da sociedade
E nossos muitos pedidos persistentes
e enfurecidos para
que pessoas com deficiência sejam
atendidas adequadamente
Nestes desastres foram ignorados,

E quando fui solicitada, dizendo que essas
eram pessoas com deficiência
Conversei com vários altos funcionários do
governo que,

'São pessoas idosas, com estado de saúde
agravados vivendo em casas de repouso
e unidades de cuidados a longo prazo'
Bem, você não vai para uma casa de repouso
porque está idoso

tem uma deficiência
E a assistência, os serviços que precisa
para participar da sociedade
não lhe foram dados.
A vasta maioria, alguns diriam,

padronizados

Tôi từng có 1 người bạn thân năm lớp 1,
tên cậu ấy là Gregory,

Cả 2 chúng tôi đều dành phần lớn thời gian cho nhau
và rồi một ngày, đột nhiên,
Gregory đã ra đi,
và tôi không biết điều gì đã xảy ra

tôi có một kinh nghiệm từ chính bản thân

"luật cộng đồng 94142" ban hành
đạo luật cho người khuyết tật
sau đổi tên là
Đạo luật về người khuyết tật, IDEA
và tôi đã có một kinh nghiệm cá nhân
với IDEA và nhận thức được rằng

我都已经不记得叫什么了!
做义工。不好意思。
我当时有机会,或者说我有义务做义工。
然后我就开始了,这一年有了第一个地球日。
我最开始在当地的回收厂搅碎玻璃。
但是这个我发现很没有意思。
但是我很多同学都在
为残疾人士建立的州立机构做义工。
我每周加入他们一次。现在回想,
作为一个十三岁的孩子被安排当
一个教室的三十个从来没有机会上学的大人的老师,
现在每个星期有一个十三岁的老师,挺令人震惊的。
不用多说,我从他们身上学到的比他们从我身上学到的多得多。
但是我们很开兴,他们很多人都成了朋友,
一直陪伴着我的道路。
很遗憾,他们有一些已经去世了。
但是还有一些人依然是我生活的一大部分。
幸运的是,他们成功的从那个
州立机构解放了他们自己。
所以,他们和很多其他人教了我很多。
但是,实际上对我最关键的一个经历是当年我在
那个州立机构工作的时候。
那是我第一个有薪水的为残疾人服务的工作。
并且我当时也在一个叫“别墅”的地方
为四十位有智力残疾的女士工作。
这个“别墅”在一个很美丽的地方,
但是那些女士住在一个建筑里,
二十位在一边,二十位在另一边。
我的责任包括
帮助他们洗澡和穿衣和吃饭。
她们很多人没有能力自己吃饭。
有一些人是应为她们从来没有过机会(自己吃),
其他人则是应为她们的身体残疾
和没有任何合适的用具或其他的设备。
所以我喂别人吃饭的时候,过程基本上每天都一样。
盘子会被端出来,然后回有
三堆食物在盘子上。
一堆从来都是咖啡色的,
一堆从来都是绿色的,
然后一堆从来都是白色的。
你知道的,肉类,蔬菜类,淀粉类。
然后,你知道的,我知道有人喜欢用不同的方法吃饭。
每天也会有不同的点心。
果冻,或者冰淇淋,或者什么其他的。
又一次,从来都是放成一堆的。
所以我就会花时间跟
每一个在吃饭的人
一起配合工作
想办法弄清楚她们是更喜欢
先吃甜点吗?
有些人喜欢那样的。
她们是更喜欢
一点咖啡色的然后一点
白色的,全在一个上字上吗?
她们是不想让她们的食物碰到一起吗?
我会这样子来回
跟她们交流,想办法弄清楚
她们的偏好。然后我应为
花太多时间惹上麻烦了。
最终,我被挪到了别的位置
应为我花太多时间在
给别人机会做自己的选择和
表达自己的喜好。
所以那是一个很关键的经历。
在很多方面。那些早期的
经历真的驱动着我
变成我现在的自己和我的信念这么多年以后。
关于美国残障人士法案,
我有一个非常密切的个人经历。
跟一个当时叫
“public law 94142" 残疾人教育法。
后来被重新命名为
身心障礙者教育法案,IDEA
我也有一个关于IDEA的
个人家庭经历。也意识到了
立法举措和IDEA是怎么
刚被通过的
然后,我开始发现有更多在进行的工作。
回到七十年代
其他立法倡议者正在进行的一些工作
例如504
例如康复法案的通过
它是随着504在旧金山被提出之后
得到立法通过并落实到位的
那确实引起了我的注意
结合我获得的这一小部分信息
和我正在做的工作
后来我成为了全职的倡导者
为独立生存中心工作
在1982年,我变得异常关注并投入到
系统改良,怎样制定政策?
怎样进行组织?怎样去支持他们?
帮助他们争取权利,发出自己的声音,取得利益
因为我住在康涅狄格州
美国残疾人法案的原作者,
第一次提出该法案
是康涅狄格州参议员威克
参议员韦克是一位患有唐氏综合症的伟大年轻人的父亲
参议员韦克在康涅狄格州非常积极地
参与残疾人倡导社区
然后我有难得的机会
去波士顿
并在国会的一次重大听证会上
即“关于美国残疾人法案”的现场听证会上作证
所以,你当然知道
法案在第一轮并没有被通过
但是天啊,天啊,我们是不是加速了
随着ADA法案的通过
一旦法案被重新提出
组织起投票的时间段里,我记得
一堆一堆亮粉色
的明信片,我们组织了
全国人民一起去行动起来
签署这些明信片,支持
通过ADA法案,之后,你也知道了
这是一种非常棒的可能
有一点点误导性的经历。实际上,
我们成功了!法案终于批准通过了!
我记得我当时想“噢,这也不是太难嘛”
我的意思是,你知道的,我们需要走两次
但是,这也不是太难
让我们采取更多的立法
因此,在我看来这并不容易
这不仅仅是
漂亮的粉红明信片,会议,游行示威的事情
这些虽然都有帮助,但是
有时候这些都不足够
去变更一个政策

我们的权利就会被剥夺

我们今天做得还不是太好
所以,我希望可以多用一点时间
去取得显著的进步
在生活中的很多方面

我一直从事残疾人权利方面的工作
在我整个成年生活
实际上从我高中时期开始
我目前是世界残疾人协会的执行董事兼首席执行官
这些年来我一直在服务领域工作
我一直在帮助人们解决住房问题(住宅项目)
和人在一起
还在上学的孩子
正在职业康复的人
还有社区生活环境中的人们
一路走来我开始非常积极的参与残疾权利
并且一直在倡导残疾人的权利
在引入ADA之前
从那时起,我几乎就在从事残障人士倡导组织工作
除了我自己的残疾
我也是两个孩子的父母
他们也是残疾人
我丈夫也有残疾
我家人几乎都是残疾人
残疾权利
成为了我生活的重心和我的意义
我从2001开始从事相关工作
我非常关注残疾人
灾难发生之前或者发生之后
