waiver is requested by Frank Levy who's
  • 7:31 - 7:37
the president of that organization and
  • 7:33 - 7:40
it will require six votes unless anybody

  • 7:40 - 7:46
    amended
  • 7:42 - 7:48

approving the consent agenda and tonight
  • 7:56 - 8:08
those are items 3 through 37 and item 5
  • 8:02 - 8:11
I vote no item 6c council members gray
  • 8:08 - 8:14
and Mandelbaum wish to speak item 20
  • 8:11 - 8:19
councilmember bo's'n is going to abstain
  • 8:14 - 8:19
as a conflict of interest in item 28
  • 8:19 - 8:26
councilmember boss also is going to
  • 8:22 - 8:26
abstain he has a conflict of interest
  • 8:27 - 8:34
and unless does anybody else have any
  • 8:31 - 8:36
other items you want to discuss or poll
  • 8:34 - 8:37
does anybody in the audience have
  • 8:36 - 8:43
anything you want to pull for additional
  • 8:37 - 8:45
love and again this is three through 37
  • 8:43 - 8:49
seeing none could we have a motion for
  • 8:45 - 8:55
the balance all right then move if
  • 8:49 - 8:56
everybody would vote Joe hello yes your
  • 8:55 - 9:03
    honor all right thank you
  • 8:56 - 9:10
seven yes motion carries all right let's
  • 9:03 - 9:12
go straight to item 6c item C is these
  • 9:10 - 9:14
    are public improvements or during
  • 9:12 - 9:17
construction the following see is the
  • 9:14 - 9:21
drake and bates park water playgrounds
  • 9:17 - 9:24
receiving bids 324 of 20 and setting the
  • 9:21 - 9:25
date of hearing for for six of 20 and
  • 9:24 - 9:31
    the engineer's estimate for this
  • 9:25 - 9:31
    improvement is 1234567
  • 10:26 - 10:34
more spray grounds in two of our parks
  • 10:29 - 10:38
one in Drake Park and the other baits
  • 10:34 - 10:39
which importantly it's also adding these
  • 10:38 - 10:41
    amenities so that they're more
  • 10:39 - 10:45
    accessible
  • 10:41 - 10:47
all over our community and again they're
  • 10:45 - 10:49
just fantastic amenities it would not be
  • 10:47 - 10:52
    possible given our budget constraints
  • 10:49 - 10:57
    without the participation and the
  • 10:52 - 10:58
generosity of of the Kelly family and I
  • 10:57 - 11:02
wanted to acknowledge that and I know
  • 10:58 - 11:04
it's going to make a huge difference for
  • 11:02 - 11:06
these neighborhood parks so wanted to
  • 11:04 - 11:09
just call that out and think that the
  • 11:06 - 11:12
Kelly's and encourage moving forward on
  • 11:09 - 11:13
this I fall along the same line Sara
  • 11:12 - 11:15
    Josh
  • 11:13 - 11:17
Kelly Foundation really has stepped up
  • 11:15 - 11:20
and started to get some things done in
  • 11:17 - 11:22
our parks as bed will probably tell you
  • 11:20 - 11:24
that we can probably do one splash pad a
  • 11:22 - 11:26
year and because of this generous
  • 11:24 - 11:28
donation we're going to be able to get
  • 11:26 - 11:30
two at the same time and that's pretty
  • 11:28 - 11:32
good because you know Bates Park I don't
  • 11:30 - 11:35
know if many people sitting in this
  • 11:32 - 11:37
audience know where it is is between 6th
  • 11:35 - 11:41
and 2nd Avenue on Clark and we have
  • 11:37 - 11:42
neglected it for far too long so it's
  • 11:41 - 11:46
it's with great pride to see that we're
  • 11:42 - 11:47
really getting this park spruced up make
  • 11:46 - 11:49
it a place in a neighborhood gathering
  • 11:47 - 11:52
place that it always should have been
  • 11:49 - 11:54
and keep that the amenities coming so
  • 11:52 - 11:56
that people I would like to hang with in
  • 11:54 - 11:59
your own neighborhood it's so important
  • 11:56 - 12:01
to see that happen in Ben hats off to
  • 11:59 - 12:04
    you for keeping these public-private
  • 12:01 - 12:07
partnerships going getting to on the
  • 12:04 - 12:11
same agenda this year is fantastic so
  • 12:07 - 12:11
    I'd like to move 6c
  • 12:17 - 12:24
Joe no yes your honor except these are
  • 12:21 - 12:25
points well made this is an important
  • 12:24 - 12:28
way we get things done the city and
  • 12:25 - 12:30
we've got a lot of families and in in
  • 12:28 - 12:31
    citizens and businesses that have
  • 12:30 - 12:35
stepped up to really make a lot of
  • 12:31 - 12:40
difference in this city Thank You mayor
  • 12:35 - 12:42
that was seven yes motion carries all
  • 12:40 - 12:46
right that completes the consent agenda
  • 12:42 - 12:50
that'll take us to ordinances our first
  • 12:46 - 12:55
consideration item 38 is amending by
  • 12:50 - 12:58
    repealing paragraph a of section 58 - 30
  • 12:55 - 13:03
they're up and enacting a new paragraph
  • 12:58 - 13:05
    a to section 58 30 regarding required
  • 13:03 - 13:07
    qualifications for appointment as an
  • 13:05 - 13:09
    at-large member of the Historic
  • 13:07 - 13:12
    Preservation Commission Council
  • 13:09 - 13:14
    communication number 20 - 120 - he has a
  • 13:12 - 13:16
    final consideration the ordinance above
  • 13:14 - 13:18
the waiver is requested by our own City
  • 13:16 - 13:20
Council member Linda Westergaard it will
  • 13:18 - 13:22
require six votes and be as a
  • 13:20 - 13:23
    recommendation from councilmember West
  • 13:22 - 13:26
    regard to a point
  • 13:23 - 13:27
    Tiffany Allison to the Historic
  • 13:26 - 13:34
Preservation Commission for a three year
  • 13:27 - 13:40
    term ending October 18th of 2022 I'll
  • 13:34 - 13:45
ask if any comments up here from Council
  • 13:40 - 13:47
I had some questions in terms of the
  • 13:45 - 13:53
language and the potential impact of
  • 13:47 - 13:53
    that so
  • 13:54 - 14:00
and and I think I had a conversation
  • 13:58 - 14:03
    with the city attorney beforehand
  • 14:00 - 14:05
answering some of where it came from
  • 14:03 - 14:08
but I actually think some of this
  • 14:05 - 14:15
actually makes some of this more
  • 14:08 - 14:18
restrictive I know my at-large appointee
  • 14:15 - 14:20
currently would not meet at least in my
  • 14:18 - 14:27
reading of the language would not meet
  • 14:20 - 14:32
the terms of this so I I just and I only
  • 14:27 - 14:34
saw it on Thursday but I got a little
  • 14:32 - 14:37
bit of concern I'm happy moving it
  • 14:34 - 14:39
forward but I am not comfortable moving
  • 14:37 - 14:42
this or waiving the second and third
  • 14:39 - 14:45
reading until we better understand the
  • 14:42 - 14:48
implication of this language and we
  • 14:45 - 14:51
understand if all of the current
  • 14:48 - 14:53
appointed at large members would meet
  • 14:51 - 14:58
the new requirements of the language
  • 14:53 - 15:01
because I'm confident that my at-large
  • 14:58 - 15:03
member would not and so I don't know if
  • 15:01 - 15:05
we would be in a position that this
  • 15:03 - 15:07
    would actually increase any flexibility
  • 15:05 - 15:07
    for us right now
  • 15:08 - 15:14
I'm I'm fine with not waving it but it
  • 15:11 - 15:17
goes back if it's okay for your pointy
  • 15:14 - 15:21
to not meet the meet the requirement why
  • 15:17 - 15:24
would it not be okay for my appointee to
  • 15:21 - 15:26
do it so you know you and I have had
  • 15:24 - 15:29
    discussions before about boards and
  • 15:26 - 15:32
commissions but I'm gonna put somebody
  • 15:29 - 15:34
who lives in my ward on the Commission
  • 15:32 - 15:37
but well and I'm happy to explain this
  • 15:34 - 15:40
because might explain why I think to me
  • 15:37 - 15:43
my appointee was not someone that I
  • 15:40 - 15:47
appointed that was a legacy appointment
  • 15:43 - 15:49
and the new the new language where you
  • 15:47 - 15:52
now have a requirement not just for
  • 15:49 - 15:55
    education but training and experience
  • 15:52 - 15:57
this appointee I think met the
  • 15:55 - 16:01
    qualification based on experience but
  • 15:57 - 16:03
not education and training and so what
  • 16:01 - 16:07
we are doing with this language change
  • 16:03 - 16:10
is now making them one of the non
  • 16:07 - 16:12
    qualified appointees but you understand
  • 16:10 - 16:16
    that language those qualifications are
  • 16:12 - 16:17
what kept me from being able to appoint
  • 16:16 - 16:20
    someone to it
  • 16:17 - 16:22
III understand that I'm just saying that
  • 16:20 - 16:25
    there are implications from this
  • 16:22 - 16:27
language change that I want to make sure
  • 16:25 - 16:29
that we understand and I would say I
  • 16:27 - 16:32
commend you for actually working to
  • 16:29 - 16:35
change this rather than I think at times
  • 16:32 - 16:37
in past practice council members have
  • 16:35 - 16:39
encouraged their applicants to be maybe
  • 16:37 - 16:43
less than truthful and whether or not
  • 16:39 - 16:46
they met qualification not an accusation
  • 16:43 - 16:49
    because I've never encouraged anybody
  • 16:46 - 16:52
that's it I do anything that is not
  • 16:49 - 16:54
above what I'm saying that that has been
  • 16:52 - 16:57
    a practice and it wasn't transparent I
  • 16:54 - 16:59
didn't say it was you i commended you
  • 16:57 - 17:02
for actually going through what I think
  • 16:59 - 17:04
is the proper process when we are not
  • 17:02 - 17:07
meeting the code if we don't think the
  • 17:04 - 17:10
code is appropriate we should change the
  • 17:07 - 17:12
    code rather than encourage people
  • 17:10 - 17:15
applying to our boards and commissions
  • 17:12 - 17:17
to be untruthful or to stretch the truth
  • 17:15 - 17:20
so that they are eligible for
  • 17:17 - 17:22
appointment and I think at least before
  • 17:20 - 17:24
    I was on the council
  • 17:22 - 17:26
I observe some instances where I think
  • 17:24 - 17:30
that happened and that's impacted our
  • 17:26 - 17:34
discussion here tonight I'm not aware of
  • 17:30 - 17:37
it ever happening but I don't follow
  • 17:34 - 17:39
what other council members who they're
  • 17:37 - 17:42
going to appoint to their boards I'm
  • 17:39 - 17:44
only concerned with my ward and the
  • 17:42 - 17:48
pointees that I put and I want to make
  • 17:44 - 17:51
sure that war two is well represented
  • 17:48 - 17:55
well let's see we've talked about
  • 17:51 - 17:59
perhaps on our council work session
  • 17:55 - 18:00
April 29th to discuss boards and
  • 17:59 - 18:04
    commissions
  • 18:00 - 18:09
could we forestall this conversation on
  • 18:04 - 18:13
this item until we have a chance to
  • 18:09 - 18:16
discuss April 29 so that's roughly six
  • 18:13 - 18:19
weeks away I'm not willing to make that
  • 18:16 - 18:21
okay that amendment to it because I
  • 18:19 - 18:23
think it's important that I have
  • 18:21 - 18:25
    representation on the Historic
  • 18:23 - 18:28
Preservation Commission and if we if we
  • 18:25 - 18:30
delay it until April 29th then I have to
  • 18:28 - 18:33
go through three more readings that's
  • 18:30 - 18:36
that much longer that that committee is
  • 18:33 - 18:41
without without a representative so I'm
  • 18:36 - 18:44
not willing to do that okay I would I
  • 18:41 - 18:47
think in this case if it has been I
  • 18:44 - 18:49
would suggest that we do that we are not
  • 18:47 - 18:51
waive it let's go through the hearing
  • 18:49 - 18:53
process so you can get your questions
  • 18:51 - 18:55
answered the person you're appointing is
  • 18:53 - 18:57
you know great person is not the person
  • 18:55 - 18:58
it's the product what how it's impacting
  • 18:57 - 19:01
all of it so we have a better
  • 18:58 - 19:02
understanding because again we thought I
  • 19:01 - 19:04
kind of thought we were going to wait
  • 19:02 - 19:05
and do boards and commissions on the
  • 19:04 - 19:07
29th that's when we would have more
  • 19:05 - 19:10
discussion and I saw this on the agenda
  • 19:07 - 19:11
so so I think that what I'm willing to
  • 19:10 - 19:14
say let's not waive it let's go through
  • 19:11 - 19:16
the process so we get some questions
  • 19:14 - 19:19
answered I don't see it waiting till
  • 19:16 - 19:22
apart the 29th and I guess my issue is
  • 19:19 - 19:24
is you know Josh during re-election you
  • 19:22 - 19:29
went out there and made a big deal
  • 19:24 - 19:31
because we had not had had board speed
  • 19:29 - 19:34
gender balance and I've never been
  • 19:31 - 19:35
against gender balance but for this
  • 19:34 - 19:39
    position
  • 19:35 - 19:41
require me to appoint a woman and she
  • 19:39 - 19:45
would have to be you know like a
  • 19:41 - 19:49
landscape architect and we just keep
  • 19:45 - 19:51
narrowing down those qualifications so I
  • 19:49 - 19:54
could appoint a man to that to that
  • 19:51 - 19:56
position today that would not be a
  • 19:54 - 19:59
problem but I know that you wouldn't
  • 19:56 - 20:01
    approve that either because because
  • 19:59 - 20:06
you're the one who's come after me for
  • 20:01 - 20:08
not being gender balance so I went to
  • 20:06 - 20:11
the city and said okay I want to appoint
  • 20:08 - 20:13
this woman I think she would be good and
  • 20:11 - 20:15
and I brought it up because I've looked
  • 20:13 - 20:17
at qualifications there are many boards
  • 20:15 - 20:21
    and commissions that have qualifications
  • 20:17 - 20:24
and a lot of you have people on there
  • 20:21 - 20:26
that don't meet the qualifications so I
  • 20:24 - 20:30
don't understand why it's okay for you
  • 20:26 - 20:31
but it's not okay for me that's my
  • 20:30 - 20:34
    question
  • 20:31 - 20:36
Linda I just want to follow the code and
  • 20:34 - 20:39
quite honestly I don't think you could
  • 20:36 - 20:41
make this appointment based on the
  • 20:39 - 20:43
changes to the code because of the other
  • 20:41 - 20:45
problems that it creates that's my
  • 20:43 - 20:48
reading of it and that's why I want to
  • 20:45 - 20:50
ask these questions now on the gender
  • 20:48 - 20:53
balance piece I've been trying to add a
  • 20:50 - 20:57
gender balance requirement to the Park
  • 20:53 - 21:00
and Recreation to the park board and to
  • 20:57 - 21:02
urban design and review that from a
  • 21:00 - 21:04
    process perspective we haven't managed
  • 21:02 - 21:09
to get a vote on this and then this this
  • 21:04 - 21:12
particular item somehow went around the
  • 21:09 - 21:14
process so I didn't go around the
  • 21:12 - 21:18
process at all Josh I followed the
  • 21:14 - 21:20
process completely and I made that
  • 21:18 - 21:23
appointment and Roger brown has a letter
  • 21:20 - 21:26
in here so I did follow the process I
  • 21:23 - 21:29
did exactly what was supposed to be done
  • 21:26 - 21:31
    we've been delaying these discussions
  • 21:29 - 21:33
which is why the gender balance
  • 21:31 - 21:36
requirement has not come up for a vote
  • 21:33 - 21:40
we've been delaying it till we do boards
  • 21:36 - 21:42
and commissions at a work session so it
  • 21:40 - 21:44
was a surprise to me and I don't think
  • 21:42 - 21:48
it was just me who was surprised to see
  • 21:44 - 21:53
this on the agenda that's fine
  • 21:48 - 22:02
I'm still going to move item 38 and a
  • 21:53 - 22:05
and B your honor please and I don't
  • 22:02 - 22:09
think you can move be given the comments
  • 22:05 - 22:14
here because you can't make the
  • 22:09 - 22:19
appointment under B if a doesn't so if
  • 22:14 - 22:21
you want to move 38:13 a and then you
  • 22:19 - 22:25
    can move thirty-eight be at 38 and 38 a
  • 22:21 - 22:28
pass but the the B appointment
  • 22:25 - 22:31
Rogers letter makes players can only
  • 22:28 - 22:34
happen if 38 and 38 a vote passed and I
  • 22:31 - 22:37
need six votes and I probably don't have
  • 22:34 - 22:42
    six votes I don't know
  • 22:37 - 22:47
well so mr. attorney can we pass 38 and
  • 22:42 - 22:50
    then have additional discussion to
  • 22:47 - 22:54
clarify some of these changes for this
  • 22:50 - 22:57
    particular appointment and continue to
  • 22:54 - 23:00
move this thing forward so that
  • 22:57 - 23:05
everybody gets I pull I would make a
  • 23:00 - 23:05
motion to pass the item 38
  • 23:06 - 23:13
and and that's to waive the second third
  • 23:11 - 23:15
no it's just just ask the ordinance and
  • 23:13 - 23:22
then have another hero's reading okay
  • 23:15 - 23:26
    got it Joe
  • 23:22 - 23:30
hello yes mr. mayor thank you
  • 23:26 - 23:34
six yes one no motion carries
  • 23:30 - 23:38
okay so we passed thirty-eight first
  • 23:34 - 23:42
reading and hopefully we'll get some of
  • 23:38 - 23:42
    the other questions clarified yep
  • 23:42 - 23:48
moved item 39 item 39 chapter 114 in the
  • 23:46 - 23:50
    misspell code regarding traffic
  • 23:48 - 23:53
    regulation changes as follows
  • 23:50 - 23:56
    council communication number 20 - 116
  • 23:53 - 23:58
hey it's a code correction to match
  • 23:56 - 24:01
    field conditions and Holcomb Avenue
  • 23:58 - 24:04
between sixth Avenue and the dead-end B
  • 24:01 - 24:09
is a code revision related to Hubbell
  • 24:04 - 24:12
    Avenue reconstruction projects East 38th
  • 24:09 - 24:15
Street East Douglas Avenue Kennedy Drive
  • 24:12 - 24:17
and Hubbell Avenue in see a code
  • 24:15 - 24:23
Corrections related to speed limit and
  • 24:17 - 24:25
parking changes on park roads council
  • 24:23 - 24:29
any comments here I just have one
  • 24:25 - 24:31
comment for the code change code
  • 24:29 - 24:34
    correction to match field conditions
  • 24:31 - 24:36
Holcomb Avenue between sixth Avenue and
  • 24:34 - 24:40
the dead-end are you talking about I
  • 24:36 - 24:42
think they're talking about West the
  • 24:40 - 24:45
dead-end to the west but there's also a
  • 24:42 - 24:45
    dead-end to the east
  • 24:46 - 24:52
there's two dead ends could we hit I
  • 24:50 - 24:55
think they're doing to the West but do
  • 24:52 - 24:58
we need to have that clarified I mean I
  • 24:55 - 25:05
did the man shows to the west yep
  • 24:58 - 25:08
but that's not what this says it looks
  • 25:05 - 25:12
like it's West yes it does
  • 25:08 - 25:14
on the map yes it does but I didn't know
  • 25:12 - 25:18
if it needed to be spelled out because
  • 25:14 - 25:19
there is a dead end to the east from 6th
  • 25:18 - 25:23
Avenue Holcomb there's a dead end on the
  • 25:19 - 25:23
east and there's a dead end on the West
  • 25:24 - 25:29
Honorable mayor members of City Council
  • 25:27 - 25:30
Steve neighbor city engineer thank you
  • 25:29 - 25:34
    for the question Council Northwest
  • 25:30 - 25:37
regard it you are correct it is to the
  • 25:34 - 25:41
west of sixth Avenue and so that would
  • 25:37 - 25:43
be covered in the ordinance there yeah
  • 25:41 - 25:46
yep all right should we correct that and
  • 25:43 - 25:51
say 6th Avenue in the dead end to the
  • 25:46 - 25:54
west just add to the west yeah you can
  • 25:51 - 25:56
this is part of the motion yep okay
  • 25:54 - 25:59
anybody in the audience want to make
  • 25:56 - 26:07
comment on this one come on most of you
  • 25:59 - 26:09
don't know that there's an East okay but
  • 26:07 - 26:11
it's not on the the item on the agenda
  • 26:09 - 26:19
so that's what we're asking to correct
  • 26:11 - 26:21
it thank you I know it is okay anybody
  • 26:19 - 26:24
in the audience nobody if we could have
  • 26:21 - 26:26
a motion on that I'll never for
  • 26:24 - 26:26
    all right
  • 26:30 - 26:42
Billy's no bushnell okay I hit the wrong
  • 26:35 - 26:48

  • 26:48 - 26:52

  • 26:53 - 27:02
all right moves that in 40 is emitting
  • 26:57 - 27:05
    section 62 point one in 62 - 166 related
  • 27:02 - 27:07
to prohibited municipal practices a is
  • 27:05 - 27:08
the final consideration in the Orden
  • 27:07 - 27:10
some of the waivers requested by the
  • 27:08 - 27:12
city manager requires six votes B is
  • 27:10 - 27:15
directing the city manager to develop
  • 27:12 - 27:17
your request for proposals to determine
  • 27:15 - 27:19
best practices for research and data
  • 27:17 - 27:22
    collection methods concerning law and
  • 27:19 - 27:25
    code enforcement and to authorize
  • 27:22 - 27:27
implementation of such research and data
  • 27:25 - 27:29
collection C is directing the city
  • 27:27 - 27:33
    manager to include implicit bias
  • 27:29 - 27:35
    training de-escalation training and
  • 27:33 - 27:40
    cultural competency training in the
  • 27:35 - 27:42
    employee training and education we're
  • 27:40 - 27:45
going to ask if there's anybody that
  • 27:42 - 27:47
would like to speak I would we have been
  • 27:45 - 27:50
working with our civil and human rights
  • 27:47 - 27:52
commission I want to thank them all for
  • 27:50 - 27:54
the work that they put forward over the
  • 27:52 - 27:58
last couple of years on this not only
  • 27:54 - 28:03
    moving discussion around this
  • 27:58 - 28:06
possibility on 40 relating to these
  • 28:03 - 28:09
    municipal practices but also working
  • 28:06 - 28:11
with the citizenry and having multiple
  • 28:09 - 28:14
meetings and I want to thank staff for
  • 28:11 - 28:19
doing the same thing and also working on
  • 28:14 - 28:22
the the bridging the gap work if is
  • 28:19 - 28:22
    Cameron here
  • 28:23 - 28:37
Cameron Middlebrooks all right we need
  • 28:27 - 28:38
to have Cameron come in Cameron if
  • 28:37 - 28:40
you're okay I'd like to have you kind of
  • 28:38 - 28:42
open and make a couple of statements and
  • 28:40 - 28:49
then I'd like manager to make couple and
  • 28:42 - 28:52
then we'll open it up for anybody else
  • 28:49 - 28:55
good evening everybody or good afternoon
  • 28:52 - 28:57
I just wanted to start by saying my
  • 28:55 - 28:58
grandmother used to tell me something
  • 28:57 - 29:01
all the time she used to tell me you
  • 28:58 - 29:03
don't judge man by where he is but you
  • 29:01 - 29:05
judge man by how far he's come it's my
  • 29:03 - 29:07
opinion that we have come light-years
  • 29:05 - 29:08
away from where we were when the first
  • 29:07 - 29:11
rendition of this ordinance came into
  • 29:08 - 29:12
play I want to send a special thank you
  • 29:11 - 29:14
to the organizations that were involved
  • 29:12 - 29:18
with bringing this to the forefront then
  • 29:14 - 29:19
double ACP they sell you in CCI and many
  • 29:18 - 29:20
    other individuals and community
  • 29:19 - 29:22
organizations for bringing this to the
  • 29:20 - 29:25
    forefront and remaining steadfast and
  • 29:22 - 29:27
seeing this through over four years ago
  • 29:25 - 29:28
    the n-double-a-cp state conference
  • 29:27 - 29:31
    boldly introduced an anti racial
  • 29:28 - 29:33
profiling bill to the state legislature
  • 29:31 - 29:34
and we find many of those components in
  • 29:33 - 29:36
    the city's ordinance and subsequent
  • 29:34 - 29:38
    resolutions including
  • 29:36 - 29:40
although not limited to the following
  • 29:38 - 29:43
the language the band's racial profiling
  • 29:40 - 29:45
a process to collect data of police
  • 29:43 - 29:47
interactions the creation of a body of
  • 29:45 - 29:49
the review set data and current policy
  • 29:47 - 29:51
to ensure that we continue to be an
  • 29:49 - 29:54
equitable City the simple human rights
  • 29:51 - 29:55
committee or Commission had was asked to
  • 29:54 - 29:57
    review several renditions of this
  • 29:55 - 29:59
ordinance over the course of the last
  • 29:57 - 30:01
nine months during our open meetings we
  • 29:59 - 30:02
    discussed with communities feedback and
  • 30:01 - 30:05
as well as relayed our discussions with
  • 30:02 - 30:07
city stats of the community to the best
  • 30:05 - 30:08
of our ability we negotiated what we
  • 30:07 - 30:10
thought were the key principle items
  • 30:08 - 30:13
    received from the community including
  • 30:10 - 30:14
those mentioned before the anti racial
  • 30:13 - 30:17
    profiling ordinance and the resolutions
  • 30:14 - 30:18
this sends a request for a proposal for
  • 30:17 - 30:20
an outside expert to review our current
  • 30:18 - 30:21
policies and procedures in regards to
  • 30:20 - 30:23
    data collection and offer
  • 30:21 - 30:26
    recommendations to ensure we collect
  • 30:23 - 30:28
data and the best way possible as well
  • 30:26 - 30:31
as the creation of the PPR C to review
  • 30:28 - 30:33
set data all in all as chair of the
  • 30:31 - 30:34
Civil Rights Commission I do feel we've
  • 30:33 - 30:35
made a significant progress from where
  • 30:34 - 30:36
    we started
  • 30:35 - 30:37
    however I do
  • 30:36 - 30:39
believe tonight we will hear from some
  • 30:37 - 30:42
organizations that would like to offer a
  • 30:39 - 30:43
few tweaks to the proposed package our
  • 30:42 - 30:45
    Commission is fully behind community
  • 30:43 - 30:47
    members and organizations advocating for
  • 30:45 - 30:50
themselves and not having to rely upon
  • 30:47 - 30:52
us with that being said after
  • 30:50 - 30:53
discussions with some of the groups I do
  • 30:52 - 30:55
believe that these tweets are worth
  • 30:53 - 30:57
taking a deeper look into and would
  • 30:55 - 30:59
encourage the council to not waive the
  • 30:57 - 31:01
three readings of this ordinance I ask
  • 30:59 - 31:03
that you take a thoughtful look at the
  • 31:01 - 31:04
suggested amendments and we continue to
  • 31:03 - 31:06
have further dialogue to make the
  • 31:04 - 31:09
    ordinance and the supporting resolutions
  • 31:06 - 31:10
the best that it can be for now again
  • 31:09 - 31:12
this is a positive step in the right
  • 31:10 - 31:14
    direction but the conversation from
  • 31:12 - 31:15
making Des Moines the equitable City
  • 31:14 - 31:18
that we all desired it to be does not
  • 31:15 - 31:20
end tonight and will not end after this
  • 31:18 - 31:21
package is eventually passed in order to
  • 31:20 - 31:23
make this city truly equitable the
  • 31:21 - 31:25
    conversation must persist when talking
  • 31:23 - 31:27
    about profiling housing education
  • 31:25 - 31:29
employment and a plethora of other
  • 31:27 - 31:32
issues that continue to exist I
  • 31:29 - 31:34
encourage everybody in this room to come
  • 31:32 - 31:36
join our City Council and the Des Moines
  • 31:34 - 31:38
Silver Human Rights Commission and our
  • 31:36 - 31:39
next joint meeting on Thursday when we
  • 31:38 - 31:42
talked about some of these added issues
  • 31:39 - 31:43
but it is our recommendation from the
  • 31:42 - 31:45
Commission that we do not waive the
  • 31:43 - 31:47
three readings that we continue to get
  • 31:45 - 31:49
dialog from the community members on
  • 31:47 - 31:51
some of these tweaks that I think you
  • 31:49 - 31:53
all find beneficial and then at the end
  • 31:51 - 31:54
of the day we can have consensus from
  • 31:53 - 31:57
the community and from the council on
  • 31:54 - 32:01
the best anti-retro profiling bill that
  • 31:57 - 32:05
we can have thank you Kevin thank you
  • 32:01 - 32:08
    [Applause]
  • 32:05 - 32:10
mr. manager Thank You mayor and Thank
  • 32:08 - 32:13
You Cameron I assumed that we'll
  • 32:10 - 32:16
actually see those amendments as the
  • 32:13 - 32:17
    conversations continue great mayor I
  • 32:16 - 32:19
also want to thank several people
  • 32:17 - 32:21
because we have spent an awful lot of
  • 32:19 - 32:24
time on us and made incredible progress
  • 32:21 - 32:26
and clearly a lot more conversation as
  • 32:24 - 32:28
needed so let me start by thanking the
  • 32:26 - 32:32
civil and human rights commission a
  • 32:28 - 32:34
    particular cameron Emily and Claudia
  • 32:32 - 32:35
because they helped us with the the
  • 32:34 - 32:38
actual drafting of some of the language
  • 32:35 - 32:41
and refining that and it clearly made
  • 32:38 - 32:43
that a better language as well had an
  • 32:41 - 32:46
opportunity to meet with several of the
  • 32:43 - 32:48
    advocacy groups throughout the community
  • 32:46 - 32:51
    and again through those conversations
  • 32:48 - 32:53
we're able to make improvements as well
  • 32:51 - 32:56
I hope to continue those conversations
  • 32:53 - 33:00
as long as we continue to make progress
  • 32:56 - 33:03
one of the concerns as I've expressed to
  • 33:00 - 33:06
the council is to not delay the areas
  • 33:03 - 33:09
that we know we need to get going on in
  • 33:06 - 33:11
particular data collection and so I'm
  • 33:09 - 33:13
hopeful that we can continue moving
  • 33:11 - 33:16
forward within the RFP portion of this
  • 33:13 - 33:18
immediately so that we can get that out
  • 33:16 - 33:22
on the street if you will and get
  • 33:18 - 33:24
vendors hired so that we can get the
  • 33:22 - 33:27
    data collection understood and moving
  • 33:24 - 33:30
forward quickly so I also want to thank
  • 33:27 - 33:33
the chief because I know he and I share
  • 33:30 - 33:36
    a commitment to continuous improvement
  • 33:33 - 33:38
and that's what this is continuing to
  • 33:36 - 33:40
improve our Police Department who have
  • 33:38 - 33:44
taken a leadership role in designing
  • 33:40 - 33:47
training for which other agencies now
  • 33:44 - 33:49
utilize and thank us for the work that
  • 33:47 - 33:51
our Police Department has done in
  • 33:49 - 33:54
    putting that train together with
  • 33:51 - 33:56
partners at Drake and other institutions
  • 33:54 - 34:00
so thank you chief for assisting on that
  • 33:56 - 34:04
as well we did have as mentioned I
  • 34:00 - 34:07
believe six areas of concern that the
  • 34:04 - 34:10
community brought to us and I'm glad to
  • 34:07 - 34:12
say tonight we have three of them being
  • 34:10 - 34:15
addressed in front of you for votes so
  • 34:12 - 34:18
thank you Mary all right well asset
  • 34:15 - 34:21
speakers to step up and we would ask
  • 34:18 - 34:24
all in LS the the council what do we
  • 34:21 - 34:28
think we'll go again with three minutes
  • 34:24 - 34:31
each if they want we would request that
  • 34:28 - 34:34
that we not be repetitive that we get
  • 34:31 - 34:37
new information we want to take a lot of
  • 34:34 - 34:41
notes and make sure we are but if
  • 34:37 - 34:43
somebody has a point and there's points
  • 34:41 - 34:46
of agreement and a lot of you feel that
  • 34:43 - 34:49
way why you know we could show hands
  • 34:46 - 34:52
that yeah hey we agree with this and do
  • 34:49 - 34:53
that as opposed to you know 20 people
  • 34:52 - 34:56
standing up and saying the same thing
  • 34:53 - 34:59
and I presume that's not going to be
  • 34:56 - 35:12
what happens but just with those
  • 34:59 - 35:19
directions let's get sorry mr. mayor
  • 35:12 - 35:22
city manager but I'm gonna read because
  • 35:19 - 35:29
again I ramble if everybody give their
  • 35:22 - 35:33
name and address okay mantheon little
  • 35:29 - 35:38
Smith 9 26 Oak Ridge Drive Des Moines
  • 35:33 - 35:42
503 one four and I'm a member of the CCI
  • 35:38 - 35:44
racial justice team and as I stand here
  • 35:42 - 35:48
today I'm feeling the weight of the work
  • 35:44 - 35:53
that we're doing it's the weight of a
  • 35:48 - 35:55
400 year old fight for the safety of
  • 35:53 - 35:59
black and brown bodies in this country
  • 35:55 - 36:01
and in this community we build every day
  • 35:59 - 36:04
on the work of those who come before us
  • 36:01 - 36:06
and whose work for equity and justice
  • 36:04 - 36:10
make our work today possible and
  • 36:06 - 36:13
necessary we still have work to do and
  • 36:10 - 36:15
we don't ant exaggerate when we say that
  • 36:13 - 36:19
people of color fear police and police
  • 36:15 - 36:22
stops in a state of Iowa but today I
  • 36:19 - 36:24
celebrate the hard work our community
  • 36:22 - 36:27
members over the past two years have
  • 36:24 - 36:30
done make no mistake we have reached a
  • 36:27 - 36:32
    historic victory
  • 36:30 - 36:34
the City of Des Moines is considering a
  • 36:32 - 36:39
racial profiling ordinance for the first
  • 36:34 - 36:44
time this is a win and I feel encouraged
  • 36:39 - 36:48
by our first steps for meaningful change
  • 36:44 - 36:52
but I'd like to refer to the city
  • 36:48 - 36:56
manager Scott Sanders in city legal
  • 36:52 - 36:59
Jeffery Lester's letter on March 3rd
  • 36:56 - 37:03
despite the fact that the community
  • 36:59 - 37:05
CCI ACLU and n-double a-c-p have been
  • 37:03 - 37:09
working together with the city on
  • 37:05 - 37:11
ordinance language Mr Sanders chose to
  • 37:09 - 37:14
send a letter just to one member of our
  • 37:11 - 37:17
community cutting the rest of us out of
  • 37:14 - 37:21
the communication about his plans to put
  • 37:17 - 37:24
the resolutions on the agenda today we
  • 37:21 - 37:28
only found out about this move on Friday
  • 37:24 - 37:30
we were in the middle of dialogue with
  • 37:28 - 37:32
Mr Sanders when he wrote this letter
  • 37:30 - 37:36
sending this letter was a divisive and
  • 37:32 - 37:37
strategic move to limit our access to
  • 37:36 - 37:41
the information and to divide the
  • 37:37 - 37:44
community we need to trust that the City
  • 37:41 - 37:48
Council will continue working with us
  • 37:44 - 37:51
the decision to send this letter out to
  • 37:48 - 37:54
the community members is damaging of
  • 37:51 - 37:57
that trust in addition this letter
  • 37:54 - 38:00
minimizes the experience of black and
  • 37:57 - 38:03
brown community members in his letter Mr
  • 38:00 - 38:07
Sanders says that City Council positions
  • 38:03 - 38:11
have not changed and that the city will
  • 38:07 - 38:15
not and I put in quotes randomly
  • 38:11 - 38:19
    foreclose this valuable and legitimate
  • 38:15 - 38:23
as my time up I got a few more I got a
  • 38:19 - 38:25
few more meaningful protection stops for
  • 38:23 - 38:27
two years we have met with the city
  • 38:25 - 38:30
staff and I'm gonna talk fast okay and
  • 38:27 - 38:33
the City Council to share stories our
  • 38:30 - 38:35
data in our experiences we have
  • 38:33 - 38:39
presented anecdotal it's only a few more
  • 38:35 - 38:41
    statistical evidence our experiences
  • 38:39 - 38:43
matter black lives matter and this
  • 38:41 - 38:46
    policy affects the
  • 38:43 - 38:50
Tyrael circumstances of our lives we are
  • 38:46 - 38:52
not asking for a random change and we
  • 38:50 - 38:55
are telling you there is a poop on our
  • 38:52 - 38:59
bat and we're asking you to remove it
  • 38:55 - 39:03
still Mr Sanders cautions us on the tone
  • 38:59 - 39:05
we use in our work for an ordinance with
  • 39:03 - 39:08
teeth threatening that we are hurting
  • 39:05 - 39:11
our cause by pushing for solutions we
  • 39:08 - 39:14
need we are looking for a meaning
  • 39:11 - 39:18
    meaningful two-way conversation that
  • 39:14 - 39:22
uses the tools of compromise for a
  • 39:18 - 39:25
meaningful and equitable outcome we know
  • 39:22 - 39:29
that no work can be done on matters that
  • 39:25 - 39:33
are about us without us at the table Mr
  • 39:29 - 39:35
    Sanders letter repeatedly discounts the
  • 39:33 - 39:39
    experiences and recommendations of
  • 39:35 - 39:42
people most affected by the racially
  • 39:39 - 39:46
biased policing and threatens that we
  • 39:42 - 39:49
are asking for too much this is a huge
  • 39:46 - 39:52
impediment to the trust of the community
  • 39:49 - 39:55
and no meaningful solutions will be
  • 39:52 - 39:57
crafted without the leadership of those
  • 39:55 - 40:01
people of color affected by the racial
  • 39:57 - 40:04
profiling I look forward to continuing
  • 40:01 - 40:08
we can move with this historic work
  • 40:04 - 40:14
    forward with the community
  • 40:08 - 40:17
CCI ACLU and double ACP Mr Sanders and
  • 40:14 - 40:17
    the City Council thank you
  • 40:26 - 40:33
good evening my name is Laurie young I
  • 40:29 - 40:36
live at 2707 High Street des Moines Iowa
  • 40:33 - 40:39
5:03 one two and I am a proud member of
  • 40:36 - 40:42
the racial justice team of Iowa CCI
  • 40:39 - 40:46
let me say this is my fifth appearance
  • 40:42 - 40:50
before the City Council since March 2018
  • 40:46 - 40:52
Iowa CCI has worked tirelessly to gather
  • 40:50 - 40:54
the stories and listen to the voices of
  • 40:52 - 40:56
our citizens who have been racially
  • 40:54 - 40:59
profiled we've been on this journey for
  • 40:56 - 41:00
five years but we believe like Martin
  • 40:59 - 41:03
Luther King jr. that a threat to justice
  • 41:00 - 41:05
anywhere is a threat to justice
  • 41:03 - 41:08
everywhere and here in Des Moines the
  • 41:05 - 41:11
city I was born in raised in raised my
  • 41:08 - 41:15
family in debated and defended critics
  • 41:11 - 41:17
over volunteered and served in hasn't
  • 41:15 - 41:20
showed justice all the time to people
  • 41:17 - 41:23
who look like me but tonight we move
  • 41:20 - 41:26
forward we are encouraged by the motion
  • 41:23 - 41:29
to pass an ordinance a law that
  • 41:26 - 41:31
explicitly bans racial profiling by the
  • 41:29 - 41:33
Des Moines police department and all
  • 41:31 - 41:36
city employees we are hopeful that
  • 41:33 - 41:39
progress continues to be made to make
  • 41:36 - 41:42
the ordinance strong and effective at
  • 41:39 - 41:44
    reducing if not eliminating racially
  • 41:42 - 41:47
biased policing but while we are
  • 41:44 - 41:50
encouraged and hopeful we are cautiously
  • 41:47 - 41:53
optimistic as city manager Scott Sanders
  • 41:50 - 41:55
said in his March 3rd letter we are
  • 41:53 - 41:58
willing to move forward in good faith
  • 41:55 - 42:01
the Bible defines faith as the substance
  • 41:58 - 42:05
of things hoped for the evidence of
  • 42:01 - 42:07
things not seen so we go from here
  • 42:05 - 42:09
having faith that the council and city
  • 42:07 - 42:12
leadership and the Des Moines police
  • 42:09 - 42:15
department will move this forward with
  • 42:12 - 42:17
expediency it's taken two years to get
  • 42:15 - 42:20
to this point five years of my life
  • 42:17 - 42:24
    specifically this is what President
  • 42:20 - 42:27
Obama called the fierce urgency of now
  • 42:24 - 42:31
let's move forward in good faith with
  • 42:27 - 42:33
    intentionality priority and expediency
  • 42:31 - 42:35
in good faith the community will also
  • 42:33 - 42:37
    need to see
  • 42:35 - 42:41
Transparency as we work to strengthen
  • 42:37 - 42:44
    this ordinance information data and
  • 42:41 - 42:47
reporting should be shared so the trust
  • 42:44 - 42:49
and confidence can be restored where
  • 42:47 - 42:54
    it's currently on life support
  • 42:49 - 42:57
Iowa CCI n-double-a-cp ACLU in working
  • 42:54 - 43:01
with the city in 2020 must see progress
  • 42:57 - 43:03
    expediency and transparency where groups
  • 43:01 - 43:06
are treated as equal partners in the
  • 43:03 - 43:09
    discussion and communication is shared
  • 43:06 - 43:12
equally the community expects it demands
  • 43:09 - 43:15
it and deserves it all in with this
  • 43:12 - 43:18
James Baldwin said not everything that
  • 43:15 - 43:21
his face can be changed but nothing can
  • 43:18 - 43:24
be changed until it is faced Des Moines
  • 43:21 - 43:27
City Council city officials you are
  • 43:24 - 43:29
finally facing the reality my people
  • 43:27 - 43:31
have been living with for decades here
  • 43:29 - 43:34
in Des Moines you've seen the data
  • 43:31 - 43:37
you've heard the stories and you've
  • 43:34 - 43:39
settled way too many lawsuits let's move
  • 43:37 - 43:41
forward together in good faith and
  • 43:39 - 43:44
create the Des Moines where all citizens
  • 43:41 - 43:47
are treated justly and fairly a city
  • 43:44 - 43:50
where we all can share a high quality of
  • 43:47 - 43:54
life and feel safe let's strengthen the
  • 43:50 - 43:56
ordinance in good faith that you say you
  • 43:54 - 44:01
are committed to tonight and let's do it
  • 43:56 - 44:09
    expeditiously and with transparency
  • 44:01 - 44:16
    [Applause]
  • 44:09 - 44:20
    hello mayor councilmembers city manager
  • 44:16 - 44:24
I'm the old appearing Des Moines Iowa I
  • 44:20 - 44:28
am a member of the CC I racial justice
  • 44:24 - 44:32
team do not be fooled by this I'm gonna
  • 44:28 - 44:36
make it short and sweet all right I did
  • 44:32 - 44:38
Oh what my past are racial justice team
  • 44:36 - 44:40
members just said so I'm not just gonna
  • 44:38 - 44:43
go out all that you already heard it you
  • 44:40 - 44:47
got it let it saturate deep in your
  • 44:43 - 44:50
pores what I wanted to say before I
  • 44:47 - 44:55
depart from here I want to make an
  • 44:50 - 45:00
    observation observational item number 38
  • 44:55 - 45:06
where I saw a lively discussion between
  • 45:00 - 45:08
a council member with 42 and conviction
  • 45:06 - 45:12
    that's what I'm talking about
  • 45:08 - 45:17
I like that so with that same kind of
  • 45:12 - 45:21
    fortitude and attitude and conviction
  • 45:17 - 45:33
let's apply that to this racial
  • 45:21 - 45:36
profiling ban look at this energize I
  • 45:33 - 45:40
want to see that same kind of energy
  • 45:36 - 45:44
with this racial profiling ordinance and
  • 45:40 - 45:50
also ditto to the fact of including us
  • 45:44 - 45:54
all the community ICC I n-double-a-cp
  • 45:50 - 45:56
ACLU we are in this together and let us
  • 45:54 - 46:01
continue to have a lively conversation
  • 45:56 - 46:01
    with conviction and
  • 46:09 - 46:14
good evening I'm Daniel Z no policy and
  • 46:11 - 46:17
advocacy director at the ACLU of I were
  • 46:14 - 46:20
located at 505 5th Avenue Suite 8:08 in
  • 46:17 - 46:23
Des Moines ACLU of Iowa once again joins
  • 46:20 - 46:25
the call from community members and our
  • 46:23 - 46:27
    organizational partners for the City
  • 46:25 - 46:29
Council to pass a meaningful ordinance
  • 46:27 - 46:31
to address the critical and specific
  • 46:29 - 46:34
issue of racial profiling and other
  • 46:31 - 46:37
    important issues racial profiling and
  • 46:34 - 46:39
    pretextual stops alienate the very
  • 46:37 - 46:42
communities the police are supposed to
  • 46:39 - 46:43
be protecting and serving they violate
  • 46:42 - 46:45
the rights and freedoms of Des Moines
  • 46:43 - 46:46
residents and do not make our community
  • 46:45 - 46:48
    safer
  • 46:46 - 46:50
you councilmembers can change that and
  • 46:48 - 46:53
we are calling on you to do that
  • 46:50 - 46:55
we know that racial profiling does it
  • 46:53 - 46:57
only refer to intentional and deliberate
  • 46:55 - 47:00
racial profiling but more often than not
  • 46:57 - 47:02
is about implicit racial bias devised
  • 47:00 - 47:04
that leads officers to be more likely to
  • 47:02 - 47:07
perceive a black driver as involved in
  • 47:04 - 47:09
drug or gang activity than a white
  • 47:07 - 47:11
driver that's one of the issues the
  • 47:09 - 47:13
community is asking the council to
  • 47:11 - 47:16
    address specifically about the the
  • 47:13 - 47:19
ordinance and the two resolutions the
  • 47:16 - 47:20
ordinance on racial profiling of the six
  • 47:19 - 47:22
issues that the community asks the
  • 47:20 - 47:24
council to address this has seen the
  • 47:22 - 47:27
most progress we are happy to see this
  • 47:24 - 47:29
we do believe there can be some some
  • 47:27 - 47:32
strengthening of the definition it is
  • 47:29 - 47:36
    not clear what appreciably motivating
  • 47:32 - 47:41
means it ought we would also suggest
  • 47:36 - 47:43
adding actual and perceived race so that
  • 47:41 - 47:44
it is more than just the actual race of
  • 47:43 - 47:47
the person but the perception of their
  • 47:44 - 47:50
race in terms of the data collection
  • 47:47 - 47:52
resolution we agree Mr Sanders that we
  • 47:50 - 47:54
shouldn't delay in fact we think the
  • 47:52 - 47:57
city police could start collecting data
  • 47:54 - 48:00
tomorrow on stops that do not result in
  • 47:57 - 48:02
an arrest or a citation what they don't
  • 48:00 - 48:04
they don't collect data right now and so
  • 48:02 - 48:06
we would urge that there be quicker
  • 48:04 - 48:09
action on that and then on the training
  • 48:06 - 48:12
again good steps forward we would
  • 48:09 - 48:14
    suggest strengthening the language to
  • 48:12 - 48:16
require city employees to take the
  • 48:14 - 48:19
    training the reson
  • 48:16 - 48:20
and says the city manager shall make
  • 48:19 - 48:21
sure the training is available but
  • 48:20 - 48:24
    there's no requirement that employees
  • 48:21 - 48:27
actually take the training so we would
  • 48:24 - 48:29
suggest you you strengthen that we all
  • 48:27 - 48:31
want to be safe in our communities we
  • 48:29 - 48:32
want to be safe in Des Moines the
  • 48:31 - 48:35
ordinance in the resolution today before
  • 48:32 - 48:37
you are steps in the right direction we
  • 48:35 - 48:39
look forward to continuing to work to
  • 48:37 - 48:42
make these ordinances the ordinance and
  • 48:39 - 48:43
the resolutions meaningful and real so
  • 48:42 - 48:45
that at the end of the day
  • 48:43 - 48:55
    constitutional rights are indeed for
  • 48:45 - 48:56
every single one of us thank you good
  • 48:55 - 48:58
    afternoon
  • 48:56 - 49:00
we're in cohort what they seal you and
  • 48:58 - 49:01
that statement he just made it carries a
  • 49:00 - 49:03
    lot of weight
  • 49:01 - 49:05
my name is ona woods currently serve as
  • 49:03 - 49:07
first vice president for Des Moines
  • 49:05 - 49:11
grant gen double ACP and I will briefly
  • 49:07 - 49:13
read my comments about data collection
  • 49:11 - 49:16
and first community we do support the
  • 49:13 - 49:18
proposed RFP to solicit proposals from
  • 49:16 - 49:21
vendors to determine the best practices
  • 49:18 - 49:23
    nationwide for collecting data and
  • 49:21 - 49:26
creating metrics that that have a valid
  • 49:23 - 49:28
review to study the internal trends of
  • 49:26 - 49:31
our city staff to make sure that they
  • 49:28 - 49:34
    are appropriately delivering services to
  • 49:31 - 49:37
for our our cohorts we also support the
  • 49:34 - 49:39
RFC's authorization for the city manager
  • 49:37 - 49:44
    to employ a successor successful
  • 49:39 - 49:45
    proposal to implement identify best
  • 49:44 - 49:48
    practices research and data collection
  • 49:45 - 49:51
as far as the racial profiling
  • 49:48 - 49:54
prohibition we do find it there there is
  • 49:51 - 49:58
some flaws in it the ordinances proposal
  • 49:54 - 49:59
does not bar all racial profiling only
  • 49:58 - 50:01
    when racial profiling is appreciably
  • 49:59 - 50:04
    motivated as previously mentioned
  • 50:01 - 50:06
simply put race should play no part of
  • 50:04 - 50:09
an officer's decisions during age in an
  • 50:06 - 50:11
    enforcement action this language
  • 50:09 - 50:13
    essentially enables any officer even
  • 50:11 - 50:15
when there isn't strong evidence that
  • 50:13 - 50:17
race or ethnicity motivated to stop to
  • 50:15 - 50:20
avoid finding liability by claiming to
  • 50:17 - 50:22
stop was based on alleged traffic code
  • 50:20 - 50:24
violation no matter how minor or
  • 50:22 - 50:26
superficial regardless of the fact that
  • 50:24 - 50:29
the data collection shows the officer
  • 50:26 - 50:34
had a record of excessive stops to
  • 50:29 - 50:36
    persons of color consultants will
  • 50:34 - 50:38
    research other states prohibition for
  • 50:36 - 50:40
protection stops we'd agree that the
  • 50:38 - 50:42
amendment to the resolution 40 B ensures
  • 50:40 - 50:44
that the consultant will research and
  • 50:42 - 50:47
    make records eight recommendations as
  • 50:44 - 50:49
that those like states of Washington New
  • 50:47 - 50:51
    Mexico in Massachusetts and communities
  • 50:49 - 50:54
such as Iowa City and University Heights
  • 50:51 - 50:56
that have made protection stops unlawful
  • 50:54 - 50:58
and there is a critical need for the
  • 50:56 - 51:00
    community group representation for
  • 50:58 - 51:02
policy and practices for the review
  • 51:00 - 51:04
committee now we believe the resolution
  • 51:02 - 51:06
for the data collection refers to a
  • 51:04 - 51:08
    policy and practice review committee
  • 51:06 - 51:10
that will review data and metrics by
  • 51:08 - 51:12
    providing meaningful analysis and policy
  • 51:10 - 51:15
    recommendations the city manager's
  • 51:12 - 51:16
proposed that the committee be comprised
  • 51:15 - 51:18
of three members from the Human Rights
  • 51:16 - 51:20
Commission one member from the housing
  • 51:18 - 51:22
Appeals Board and one staff member from
  • 51:20 - 51:25
    the Community Development Department and
  • 51:22 - 51:26
additionally one police officer but we
  • 51:25 - 51:28
propose that the composition of the
  • 51:26 - 51:30
committee be increased by at least three
  • 51:28 - 51:32
    community member groups that have
  • 51:30 - 51:35
    historically been associated with
  • 51:32 - 51:37
efforts to rid or eliminate racial
  • 51:35 - 51:39
discrimination or work with or either
  • 51:37 - 51:42
people who work with victims of racial
  • 51:39 - 51:45
    profiling or ethnic profiling our
  • 51:42 - 51:47
proposal was rejected the need for
  • 51:45 - 51:50
community groups to be truly represented
  • 51:47 - 51:52
    represented on this Advisory Committee
  • 51:50 - 51:55
is crucial to the credibility of the
  • 51:52 - 51:57
community so with this we thank you for
  • 51:55 - 51:59
an opportunity to to come before you
  • 51:57 - 52:02
this evening and we ask that you would
  • 51:59 - 52:06
consider our proposed changes Arnold did
  • 52:02 - 52:09
you say Arnold you said by 2/3 you said
  • 52:06 - 52:11
three increased by 3k if that's not
  • 52:09 - 52:11
    enough about six
  • 52:12 - 52:18
    [Applause]
  • 52:15 - 52:18
    yeah
  • 52:18 - 52:24
    good afternoon mr. mayor City
  • 52:21 - 52:25
Councilmembers and and city manager and
  • 52:24 - 52:27
    attorney thank you so much
  • 52:25 - 52:30
Arnold had our formal remarks so I just
  • 52:27 - 52:34
wanted to provide just a little bit of
  • 52:30 - 52:37
    support acknowledging that the
  • 52:34 - 52:40
n-double-a-cp CCI ACLU have been on a
  • 52:37 - 52:42
long journey we started working on
  • 52:40 - 52:44
legislation at the state level and now
  • 52:42 - 52:47
    have been working together on
  • 52:44 - 52:49
legislation for the City of Des Moines
  • 52:47 - 52:52
and I know that we have provided as said
  • 52:49 - 52:57
been said before stories stacks of
  • 52:52 - 53:00
information memos video and all kinds of
  • 52:57 - 53:02
information and so with that being said
  • 53:00 - 53:06
we know that there were two proposals
  • 53:02 - 53:08
that that didn't come anywhere close to
  • 53:06 - 53:13
being up to snuff for the community so
  • 53:08 - 53:16
we are grateful for the opportunity to
  • 53:13 - 53:19
weigh in on this third proposal with
  • 53:16 - 53:22
that being said our bottom line today
  • 53:19 - 53:25
for you is that we would like to see
  • 53:22 - 53:28
waivers I mean we would not like to see
  • 53:25 - 53:30
the waiver in terms of the three
  • 53:28 - 53:33
readings so we would like to make sure
  • 53:30 - 53:36
that we do have the three readings and
  • 53:33 - 53:41
the n-double-a-cp in your email box we
  • 53:36 - 53:45
    have submitted amendments to the
  • 53:41 - 53:47
resolutions both for T B and for T C the
  • 53:45 - 53:49
    resolutions are very similar these
  • 53:47 - 53:53
resolutions are pretty much what Daniel
  • 53:49 - 53:55
from the ACLU mentioned earlier in terms
  • 53:53 - 54:00
of making sure that employees are
  • 53:55 - 54:02
required to undergo the implicit bias
  • 54:00 - 54:05
training and the escalation training as
  • 54:02 - 54:08
well as making sure that when the
  • 54:05 - 54:10
consultant for the RFP looks at that
  • 54:08 - 54:14
that he also looks into best practices
  • 54:10 - 54:16
around pretextual stops so that's hugely
  • 54:14 - 54:17
important the other just a couple of
  • 54:16 - 54:21
other things that we want to point out
  • 54:17 - 54:23
that the three readings that would help
  • 54:21 - 54:25
us at least bring to your attention I
  • 54:23 - 54:25
    know
  • 54:26 - 54:30
city manager or Sanders we have met and
  • 54:28 - 54:32
talked a little bit about that we did
  • 54:30 - 54:37
expect another meeting so that's also
  • 54:32 - 54:41
why we're here saying let's not move so
  • 54:37 - 54:43
hastily but but the ordinance at this
  • 54:41 - 54:47
point does not speak to data collection
  • 54:43 - 54:50
it doesn't bring over the language of
  • 54:47 - 54:55
training them in and I know of training
  • 54:50 - 54:57
and I know that we are with the hiring
  • 54:55 - 54:59
or the RFP and bringing that data
  • 54:57 - 55:02
    collection conversation that that
  • 54:59 - 55:05
conversation is supposed to be ongoing
  • 55:02 - 55:08
and it must be ongoing and that it and
  • 55:05 - 55:11
again it should be a conversation we
  • 55:08 - 55:14
should be and I say we you are the city
  • 55:11 - 55:16
should be listening to the community and
  • 55:14 - 55:20
then the other concern that I'd like to
  • 55:16 - 55:23
raise is that in the even though this is
  • 55:20 - 55:26
under the Civil Rights Code there are
  • 55:23 - 55:30
    several provisions in this ordinance
  • 55:26 - 55:33
that that exempt it from actually being
  • 55:30 - 55:35
having the benefits of being of the
  • 55:33 - 55:40
Civil Rights Code so one is that
  • 55:35 - 55:44
complaint process and that's vital and
  • 55:40 - 55:46
again we support the definition having a
  • 55:44 - 55:49
change in the definition as well of the
  • 55:46 - 55:50
    appreciably motivating factor is a
  • 55:49 - 55:53
problem to me it should just be a
  • 55:50 - 55:57
motivating factor because any any kind
  • 55:53 - 55:58
of kind of racial profiling profiling is
  • 55:57 - 56:02
    it should be prohibited
  • 55:58 - 56:05
so as we stand as another speaker said
  • 56:02 - 56:08
here on the cusp of making history I
  • 56:05 - 56:12
    think there's an opportunity we've
  • 56:08 - 56:14
talked about this being a step and for
  • 56:12 - 56:18
many in the community it may not be
  • 56:14 - 56:21
quite a step it is a start but we think
  • 56:18 - 56:23
with the waiver and if we have ongoing
  • 56:21 - 56:25
conversations and I do want to thank the
  • 56:23 - 56:27
City Council members several of them
  • 56:25 - 56:30
have met with us and our colleagues and
  • 56:27 - 56:31
so I know in that vein we're moving for
  • 56:30 - 56:34
them but we want to make sure that it's
  • 56:31 - 56:35
not just a start but it's a step and we
  • 56:34 - 56:38
want to make sure it's a good step that
  • 56:35 - 56:40
we all can be proud of and that we all
  • 56:38 - 56:41
    can call a win
  • 56:40 - 56:44
so that's what we're looking for so
  • 56:41 - 56:51
let's make a good strong step together
  • 56:44 - 56:53
Thank You America mayor before for the
  • 56:51 - 56:57
next speaker is very very convincing on
  • 56:53 - 57:00
the need to hold off on the second third
  • 56:57 - 57:03
waving so mayor if you would I'm gonna
  • 57:00 - 57:11
withdraw the consideration of the second
  • 57:03 - 57:12
and third reading I didn't get the name
  • 57:11 - 57:21
    of the last speaker
  • 57:12 - 57:30
Betty Ann Andrews my name is Chris
  • 57:21 - 57:32
Robinson live at 12:59 Stewart I guess
  • 57:30 - 57:36
I'm kind of coming at you from a
  • 57:32 - 57:39
perspective as black male black man what
  • 57:36 - 57:45
everyone called me because we have
  • 57:39 - 57:49
several names were called and as long as
  • 57:45 - 57:51
you guys keep dragging your feet there
  • 57:49 - 57:55
are still folks out there being stopped
  • 57:51 - 57:57
and it's not being recorded or and if
  • 57:55 - 58:01
nothing is found or anything and it's
  • 57:57 - 58:05
just let go and on their way and so that
  • 58:01 - 58:08
    that's not recorded it's it's not even
  • 58:05 - 58:11
you don't even know unless somebody
  • 58:08 - 58:13
doesn't feel they were treated right and
  • 58:11 - 58:16
they decide they want to make a
  • 58:13 - 58:20
complaint then you might find out about
  • 58:16 - 58:23
it and that's it still the the
  • 58:20 - 58:29
community's word against the police word
  • 58:23 - 58:32
and so who's gonna be believe I've been
  • 58:29 - 58:34
stopped several times so I know what it
  • 58:32 - 58:38
    feels like yeah
  • 58:34 - 58:41
any of y'all being stopped any time do
  • 58:38 - 58:43
you know what it feels like I don't
  • 58:41 - 58:46
think you do if you haven't been stopped
  • 58:43 - 58:48
because the skin you're in that's
  • 58:46 - 58:52
different than the skin I mean
  • 58:48 - 58:55
and so I get treated differently just
  • 58:52 - 59:00
because the skin I'm in which isn't fair
  • 58:55 - 59:04
but I guess according to some folks it's
  • 59:00 - 59:08
okay but I thought the City Council is
  • 59:04 - 59:12
    supposed to protect everybody regardless
  • 59:08 - 59:15
of my skin color Who I am
  • 59:12 - 59:18
we are all supposed to be protected and
  • 59:15 - 59:24
    I guess it's hard they're trying to
  • 59:18 - 59:30
figure out why council is fighting so
  • 59:24 - 59:32
hard against us just to help protect us
  • 59:30 - 59:40
    that's all we're asking
  • 59:32 - 59:43
it's just to be protected and we
  • 59:40 - 59:48
shouldn't have to we we shouldn't have
  • 59:43 - 59:53
to beg for this and that's what it feels
  • 59:48 - 59:56
like feels like we're begging to just to
  • 59:53 - 59:59
be protected and it should we should be
  • 59:56 - 60:02
protected anyway but it just feels like
  • 59:59 - 60:06
we're just big is no different than back
  • 60:02 - 60:09
in the day when we were slaves and has
  • 60:06 - 60:11
to beg Massa for some scrap just eat
  • 60:09 - 60:13
it's the same thing there's no
  • 60:11 - 60:18
    difference it's the same thing
  • 60:13 - 60:21
and until you flip the script where if
  • 60:18 - 60:26
you have to come to the black community
  • 60:21 - 60:27
even when you could running when you run
  • 60:26 - 60:30
    for office
  • 60:27 - 60:33
now you did come to the black community
  • 60:30 - 60:37
needed our boat and it for some ungodly
  • 60:33 - 60:41
reason all of a sudden all you guys were
  • 60:37 - 60:46
poor racial profiling you was against it
  • 60:41 - 60:48
now it's done changed because all of you
  • 60:46 - 60:53
said that you was going to fight against
  • 60:48 - 60:56
this racial profiling to stop it but now
  • 60:53 - 61:00
that you got your seats back you know
  • 60:56 - 61:01
fell to the wayside with uh you know
  • 61:00 - 61:02
used to say we used to be on the back
  • 61:01 - 61:04
    burner
  • 61:02 - 61:10
we don't roll it off the stove and
  • 61:04 - 61:15
underneath the stove and so it's it's
  • 61:10 - 61:18
it's and then when you pick the groups
  • 61:15 - 61:21
and everything that that you're gonna go
  • 61:18 - 61:25
with please pick some folks that you're
  • 61:21 - 61:27
not comfortable with because right now
  • 61:25 - 61:29
you keep going with folks that you're
  • 61:27 - 61:31
    comfortable with because they're not
  • 61:29 - 61:34
going to go against you they're going to
  • 61:31 - 61:37
they'll go with you there's nothing
  • 61:34 - 61:40
wrong with those of us we're not against
  • 61:37 - 61:42
you we're against bad police officers
  • 61:40 - 61:44
    yeah it
  • 61:42 - 61:47
you should be against bad police
  • 61:44 - 61:49
officers just like we're against bad
  • 61:47 - 61:53
police officers no problem with a good
  • 61:49 - 61:56
police officer no problem but with a bad
  • 61:53 - 62:00
one yet because they're out there to
  • 61:56 - 62:02
continue that madness out there and they
  • 62:00 - 62:06
continue getting away with it because
  • 62:02 - 62:09
they can and it's it it's not fair to us
  • 62:06 - 62:09
    as the people appellant
  • 62:19 - 62:25
are you doing my name is will Johnson
  • 62:21 - 62:27
281 East walnut' in Des Moines the guy
  • 62:25 - 62:29
that just spoke motivated me to speak I
  • 62:27 - 62:31
might be a little younger than him I'll
  • 62:29 - 62:33
be 40 here in August I didn't plan on
  • 62:31 - 62:35
saying anything but hearing him speak
  • 62:33 - 62:39
make me wanted to come and say something
  • 62:35 - 62:41
I've been a victim of racial profiling I
  • 62:39 - 62:44
spent half my life living in Chicago
  • 62:41 - 62:46
South Side of Chicago 21st 25 years of
  • 62:44 - 62:48
my life so I know what that's like moved
  • 62:46 - 62:50
out here with my family went through
  • 62:48 - 62:53
that out here for the last maybe 10
  • 62:50 - 62:55
years I have two teenage kids here in
  • 62:53 - 62:56
the audience now I look around I see
  • 62:55 - 62:59
that I'm probably the only one that
  • 62:56 - 63:01
brought my teenage kids to this event
  • 62:59 - 63:03
just to let them know what happens what
  • 63:01 - 63:06
goes on and if we're not here to speak
  • 63:03 - 63:08
up for ourselves no one would so I'm
  • 63:06 - 63:10
here to let them know the the children
  • 63:08 - 63:12
this is the process and if we're not
  • 63:10 - 63:14
here to speak up things are going to go
  • 63:12 - 63:19
even slower than what they are going and
  • 63:14 - 63:23
I lead the council to to to to to be
  • 63:19 - 63:24
aware of the situation that everyone has
  • 63:23 - 63:26
to deal with it even though we are in
  • 63:24 - 63:28
our black skin we have to deal with a
  • 63:26 - 63:30
little bit more and like I said I have
  • 63:28 - 63:31
teenage kids and they're about to be
  • 63:30 - 63:34
driving and I don't want them to have to
  • 63:31 - 63:36
deal with what I've went through most of
  • 63:34 - 63:38
my life living in this country not just
  • 63:36 - 63:41
this state or city it's the whole
  • 63:38 - 63:43
country and it has to start in the
  • 63:41 - 63:45
cities before it can branch out to the
  • 63:43 - 63:47
state before it can branch out across
  • 63:45 - 63:57
    the country that's it
  • 63:47 - 64:00
    [Applause]
  • 63:57 - 64:04
this children's Arnett expector how many
  • 64:00 - 64:07
more people are planning on speaking so
  • 64:04 - 64:09
we get one two three we need to kind of
  • 64:07 - 64:12
get an idea here so we can get kind of
  • 64:09 - 64:15
an idea of time we were you know we're
  • 64:12 - 64:20
over a half hour now you know so there's
  • 64:15 - 64:20
one two three how many we got I
  • 64:22 - 64:35
understand what what are we getting
  • 64:28 - 64:39
broke down here for okay go ahead sir
  • 64:35 - 64:40
good afternoon your honor mayor City
  • 64:39 - 64:43
    Council
  • 64:40 - 64:48
Rory Freeman for o33 Plainview drive a
  • 64:43 - 64:51
Des Moines Iowa it was not my intention
  • 64:48 - 64:53
to speak and I don't typically want to
  • 64:51 - 64:56
speak but there comes a point when all
  • 64:53 - 64:59
of us have to speak up
  • 64:56 - 65:02
I'm a very very proud resident Des
  • 64:59 - 65:05
Moines I'm an 18 year old 18 year
  • 65:02 - 65:09
employee of the city of the morning I've
  • 65:05 - 65:13
had fights arguments I've stood strong
  • 65:09 - 65:16
in campaigns I thank you for your help
  • 65:13 - 65:19
as a as a City of Des Moines employee
  • 65:16 - 65:20
and I'm not representing the place as
  • 65:19 - 65:22
the City of Des Moines employee I've
  • 65:20 - 65:25
    done mandatory training mandatory
  • 65:22 - 65:31
    training mandatory training down the
  • 65:25 - 65:35
line I fail to understand why such an
  • 65:31 - 65:37
important factor as racial profiling is
  • 65:35 - 65:38
a question for the city des moines
  • 65:37 - 65:42
    council
  • 65:38 - 65:45
I know that you all support all of your
  • 65:42 - 65:46
citizens I know that you support me
  • 65:45 - 65:49
individually because I've spoken to most
  • 65:46 - 65:52
of you and yet when we come to this very
  • 65:49 - 65:56
important point all of a sudden we seem
  • 65:52 - 65:58
to be hedging our bets I support my
  • 65:56 - 66:00
brothers and sisters in blue absolutely
  • 65:58 - 66:03
I understand their safety and security
  • 66:00 - 66:07
and the importance of that but I don't
  • 66:03 - 66:11
think that we should allow an insidious
  • 66:07 - 66:15
act of racial profiling to go
  • 66:11 - 66:18
    continuously unrecorded unreported swept
  • 66:15 - 66:24
under the table when it has such a huge
  • 66:18 - 66:25
effect upon our population there's no
  • 66:24 - 66:28
need for me to go into my own personal
  • 66:25 - 66:30
stories I can I can raise hands there 15
  • 66:28 - 66:33
20 people here who all have personal
  • 66:30 - 66:37
stories as a City of Des Moines employee
  • 66:33 - 66:40
I can tell you my personal humiliation a
  • 66:37 - 66:46
big roast racially profiled by police
  • 66:40 - 66:50
officers what is my recourse my recourse
  • 66:46 - 66:55
is to file a complaint I know how that
  • 66:50 - 66:57
goes I've listened to complaints and I
  • 66:55 - 67:00
    know that sometimes those complaints
  • 66:57 - 67:02
fall on deaf ears and it falls on the
  • 67:00 - 67:04
ears of those that are pro-police
  • 67:02 - 67:07
I love my brothers and sisters and blue
  • 67:04 - 67:12
that's all great but the fact of the
  • 67:07 - 67:15
matter is we need specific evidence of
  • 67:12 - 67:19
racial profiling so that we can
  • 67:15 - 67:22
eliminate this continued act and I don't
  • 67:19 - 67:24
    understand for instance no offence
  • 67:22 - 67:26
estándares when we talk about by it I
  • 67:24 - 67:27
know that you've dropped that when we
  • 67:26 - 67:30
talk about waiving the second and third
  • 67:27 - 67:34
reading that is an indication to me that
  • 67:30 - 67:37
we don't want to listen to everyone and
  • 67:34 - 67:40
    I think that's not appropriate for a
  • 67:37 - 67:43
city that touts itself mayor that's one
  • 67:40 - 67:43
of the greatest in the United States
  • 67:44 - 67:50
let's establish the same priorities for
  • 67:47 - 67:54
racial profiling that we have for LGBTQ
  • 67:50 - 67:59
rights that we have for housing rights
  • 67:54 - 68:03
and let's make that a foundation of what
  • 67:59 - 68:05
the City of Des Moines stands for that's
  • 68:03 - 68:07
all that I'm asking for individually
  • 68:05 - 68:09
it's what I'm asking for from our
  • 68:07 - 68:09
children and I know that we have the
  • 68:09 - 68:11
    ability
  • 68:09 - 68:13
I personally believe the moor is one of
  • 68:11 - 68:15
the greatest cities in the in the United
  • 68:13 - 68:18
States and anybody that knows me knows
  • 68:15 - 68:20
that I'm very very proud to be here but
  • 68:18 - 68:22
the fact of the matter is I think it's
  • 68:20 - 68:24
about time for the City Council to stand
  • 68:22 - 68:26
up and represent the entire population
  • 68:24 - 68:29
of Des Moines and if a portraitist
  • 68:26 - 68:32
population is saying that this is the
  • 68:29 - 68:35
problem then mr. mayor with all due
  • 68:32 - 68:38
respect I would expect you to take the
  • 68:35 - 68:43
lead in addressing all of these issues
  • 68:38 - 68:43
for all of us thank you very very much
  • 68:52 - 68:59
    Charice Williams
  • 68:55 - 69:03
14:34 East 18th Street Des Moines five
  • 68:59 - 69:06
zero three one six hello Oh
  • 69:03 - 69:10
most of you have talked to me on
  • 69:06 - 69:13
multiple occasions as the chair for M
  • 69:10 - 69:17
okay but I've also had other
  • 69:13 - 69:23
conversations with you about the City of
  • 69:17 - 69:28
Des Moines and the lack of equity in
  • 69:23 - 69:32
some areas and we all know it's real so
  • 69:28 - 69:38
I just wanted to stand up here and look
  • 69:32 - 69:39
each of you in the face because you're
  • 69:38 - 69:42
    stoned
  • 69:39 - 69:46
I know yet I've been smoking nothing
  • 69:42 - 69:49
like that's not what I'm saying but I
  • 69:46 - 69:53
need you all to really really try to put
  • 69:49 - 69:56
yourself in the position that so many of
  • 69:53 - 69:59
    these families including myself have
  • 69:56 - 70:03
been in I've watched profiling happen
  • 69:59 - 70:06
for three generations in my family
  • 70:03 - 70:09
starting with my daddy being stopped
  • 70:06 - 70:14
because at the time we didn't have a car
  • 70:09 - 70:17
walking home from work for my brother
  • 70:14 - 70:21
driving with my baby brother in the car
  • 70:17 - 70:26
who was five at the time being rolled up
  • 70:21 - 70:32
on from SWAT because he happened to be a
  • 70:26 - 70:34
black male between the ages of 16 and 25
  • 70:32 - 70:37
riding in a very nice car because at
  • 70:34 - 70:43
    that time we had Cadillacs
  • 70:37 - 70:49
to my son not even wanting to come home
  • 70:43 - 70:53
from college because of the treatment
  • 70:49 - 70:57
that he's received from our brothers and
  • 70:53 - 71:00
sisters in blue and mind you a lot of
  • 70:57 - 71:05
    these instances were never recorded
  • 71:00 - 71:12
there's no documentation but to hear my
  • 71:05 - 71:18
son cry screaming for his uncle dad who
  • 71:12 - 71:21
helped me because officers have done a
  • 71:18 - 71:23
    u-turn and actually a three-point turn
  • 71:21 - 71:29
in the middle of a residential street
  • 71:23 - 71:33
and terrorized it way back when people
  • 71:29 - 71:37
migrated from the south not necessarily
  • 71:33 - 71:42
    seeking better employment but running
  • 71:37 - 71:44
from the Terrorism of racism I don't
  • 71:42 - 71:47
expect any of you to quite fully
  • 71:44 - 71:51
understand I don't because you will
  • 71:47 - 71:54
never be able to be in my shoes as men
  • 71:51 - 71:59
you will never be able to be in these
  • 71:54 - 72:03
men shoes ever I don't expect you to
  • 71:59 - 72:09
understand that way but what I do expect
  • 72:03 - 72:13
is for you to use your privilege because
  • 72:09 - 72:15
of the color of your skin because of the
  • 72:13 - 72:19
authority that we the people have
  • 72:15 - 72:24
invested in you right to do something
  • 72:19 - 72:29
real and not lip service because
  • 72:24 - 72:31
honestly I'm tired of lip service when
  • 72:29 - 72:34
it comes to my neighborhood and trying
  • 72:31 - 72:37
to get things done when it comes to
  • 72:34 - 72:39
something like this that affects so many
  • 72:37 - 72:39
    people
  • 72:41 - 72:50
I just need you to look me in my eyes
  • 72:45 - 72:55
and I want you to think about if it's
  • 72:50 - 73:01
your baby if it's your grandchild
  • 72:55 - 73:06
it fits short daddy if it's your mom if
  • 73:01 - 73:23
it's someone you loved that is afraid to
  • 73:06 - 73:26
be in the place that they call home I am
  • 73:23 - 73:28
sharing och their 401 Northeast crest
  • 73:26 - 73:31
    mark place in Ankeny and
  • 73:28 - 73:35
just wanted to say we have heard story
  • 73:31 - 73:40
after story from people living with
  • 73:35 - 73:46
racial profiling they are experiencing a
  • 73:40 - 73:48
lot of indignities fears day to day that
  • 73:46 - 73:51
no one in this country should have to
  • 73:48 - 73:55
    experience and yet they're experiencing
  • 73:51 - 73:58
it in Des Moines Iowa and they've spent
  • 73:55 - 74:01
hours and hours and hours of their lives
  • 73:58 - 74:06
    coming up with suggestions
  • 74:01 - 74:09
    recommendations and actual possible
  • 74:06 - 74:13
ordinance that included seven or six
  • 74:09 - 74:17
options of things that really need it to
  • 74:13 - 74:20
not have been ignored needed to have
  • 74:17 - 74:21
    been very seriously considered because
  • 74:20 - 74:24
    they all made sense
  • 74:21 - 74:27
    they were comprehensive they addressed
  • 74:24 - 74:30
every issue that has been brought
  • 74:27 - 74:33
forward by people who are experiencing
  • 74:30 - 74:36
this in their daily lives and so
  • 74:33 - 74:39
anything that has come back that hasn't
  • 74:36 - 74:44
    seriously considered every aspect and
  • 74:39 - 74:48
actually is acting on all six areas of
  • 74:44 - 74:52
    concern is watered down
  • 74:48 - 74:55
it's watered down and it diminishes the
  • 74:52 - 74:58
stories that we've heard it diminishes
  • 74:55 - 75:01

  • 75:17 - 75:25
privilege echoes across this land all
  • 75:21 - 75:27
the time is indicative of this council I

  • 75:31 - 75:39
don't see American is up here I was a
  • 75:36 - 75:42
victim of white privilege I was told the
  • 75:39 - 75:44
lives of the conquer for the last 30 or
  • 75:42 - 75:49
40 years I've been listening to the
  • 75:44 - 75:52
conquered those victims of white slavery
  • 75:49 - 75:52
    and Jim Crow ISM
  • 75:54 - 76:02
slavery fascism that's what it was
  • 75:59 - 76:09
genocide American Indian was slate it
  • 76:02 - 76:11
was fascism why don't I see the words
  • 76:09 - 76:20
racial profiling up there instead of
  • 76:11 - 76:24
prohibit municipal practices why don't I
  • 76:20 - 76:28
see city cop citizen review board up
  • 76:24 - 76:30
there when are those three organizations
  • 76:28 - 76:33
gonna have a seat at the table up here
  • 76:30 - 76:41
on this floor up this up behind it see
  • 76:33 - 76:44
those names up there you know I've had
  • 76:41 - 76:49
the privilege and the honor of listening
  • 76:44 - 76:54
the people of the black community I've
  • 76:49 - 76:54
    heard their stories dammit
  • 76:55 - 77:12
sorry folks it helped it justice is what
  • 77:02 - 77:18
they want these people have stood by me
  • 77:12 - 77:19
for years fighting for family farms some
  • 77:18 - 77:21
of them people are two or three
  • 77:19 - 77:23
generations for family farm but they
  • 77:21 - 77:27
know what the hell I'm talking about
  • 77:23 - 77:27
    justice on the land
  • 77:32 - 77:40
so you people better wake up because
  • 77:36 - 77:42
justice is rolling and they're not gonna
  • 77:40 - 77:42
    take it anymore
  • 77:43 - 77:48
we got things happening on this into
  • 77:45 - 77:50
this climate we got to me there's three
  • 77:48 - 77:51
great evils and I'm not afraid to say it
  • 77:50 - 77:54
    say it
  • 77:51 - 77:58
    capitalism racism and religious
  • 77:54 - 78:03
dogmatism and they're alive and kicking
  • 77:58 - 78:05
in this on this planet terribly well
  • 78:03 - 78:28
anyway I'm proud to stand with these
  • 78:05 - 78:34
folks my name is Carla Dawson I live at
  • 78:28 - 78:38
    2,900 Cottage Grove Avenue I wasn't
  • 78:34 - 78:41
going to speak but then I said I work
  • 78:38 - 78:46
with young people and I tell them the
  • 78:41 - 78:46
weapon that you have is your voice I
  • 78:47 - 78:55
have been privileged to be chosen the
  • 78:52 - 79:05
25th recipient of the Bishop Maurice
  • 78:55 - 79:09
Dingman award I am very proud I am very
  • 79:05 - 79:12
proud because Bishop Dingman spoke truth
  • 79:09 - 79:12
    to power
  • 79:13 - 79:23
as serese would say none of you will
  • 79:17 - 79:27
walk in my shoes as the mother of three
  • 79:23 - 79:31
african-american young men none of you
  • 79:27 - 79:33
know what it's like to stay awake at
  • 79:31 - 79:37
night wondering if you're gonna get that
  • 79:33 - 79:37
phone call or that knock on the door
  • 79:39 - 79:46
like so many people have said if you
  • 79:43 - 79:49
have privilege and you don't use it to
  • 79:46 - 79:57
help someone what good is your privilege
  • 79:49 - 79:59
I saw Connie I saw Joshua I saw Linda at
  • 79:57 - 80:06
the racial profiling meetings we had at
  • 79:59 - 80:09
CCI and I was very happy about that but
  • 80:06 - 80:11
as they've said time and time again and
  • 80:09 - 80:15
just in case you're wondering I'm bored
  • 80:11 - 80:19
and / had Des Moines I came here when I
  • 80:15 - 80:22
was seven years old I will be 55 in May
  • 80:19 - 80:24
so that's pretty much all my life that
  • 80:22 - 80:24
    I've been in Des Moines
  • 80:25 - 80:36
I would like young people of color to be
  • 80:31 - 80:39
able to live in Des Moines safely how
  • 80:36 - 80:42
can we tell them to come back to Des
  • 80:39 - 80:48
Moines when we know that it's not safe
  • 80:42 - 80:55
for them Des Moines is a lovely place to
  • 80:48 - 81:02
live if you look like any of you that
  • 80:55 - 81:08
hurts me to my soul everything that I
  • 81:02 - 81:14
was raised to believe everything I don't
  • 81:08 - 81:16
feel it in Des Moines I don't feel it
  • 81:14 - 81:21
when young men and young women of color
  • 81:16 - 81:25
are stopped and harassed and terrorized
  • 81:21 - 81:28
how would I be able to honestly tell my
  • 81:25 - 81:28
    boys to come home
  • 81:31 - 81:37
and I'm gonna tell you the words of
  • 81:33 - 81:42
Archbishop Romero you have the power to
  • 81:37 - 81:46
stop the repression you have the power
  • 81:42 - 81:49
to stand up for what is right because
  • 81:46 - 81:50
everything is good everything is really
  • 81:49 - 81:53
    good
  • 81:50 - 81:55
when you need us when people who look
  • 81:53 - 81:57
like me and people who look like you
  • 81:55 - 82:01
miss miss miss Lancia when you need us
  • 81:57 - 82:05
we're good when you don't need us the
  • 82:01 - 82:08
hell with us I didn't come to ask the
  • 82:05 - 82:11
vote for you mayor you Connie you came
  • 82:08 - 82:14
to us asking us to vote for you so we're
  • 82:11 - 82:18
coming to you asking to put out the
  • 82:14 - 82:21
olive branch do what is right in 2020
  • 82:18 - 82:24
    really it's 2020 we don't have a racial
  • 82:21 - 82:25
profiling bill in Des Moines shame on
  • 82:24 - 82:30
    you
  • 82:25 - 82:30
I'm gonna put it on you shame on you if
  • 82:30 - 82:36
you want to represent somebody then
  • 82:33 - 82:43
represent them if you don't get up and
  • 82:36 - 82:45
leave it's as simple as that cuz you
  • 82:43 - 82:48
know what you're gonna need us again
  • 82:45 - 82:51
each one are you gonna need us again and
  • 82:48 - 82:54
when you need us and we don't come don't
  • 82:51 - 83:05
    wonder why thank you
  • 82:54 - 83:08
    [Applause]
  • 83:05 - 83:11
    my name is Wallace Jackson
  • 83:08 - 83:14
I've lived in the morning all my life
  • 83:11 - 83:17
with the exception of the time by served
  • 83:14 - 83:21
in the military for the adjutant general
  • 83:17 - 83:24
as a legal clerk or courier of secret
  • 83:21 - 83:27
documents and a little bit more if I
  • 83:24 - 83:36
told you more I'd have to you know the
  • 83:27 - 83:41
rest I represented this nation from the
  • 83:36 - 83:43
time I was a little boy and I'm bit of
  • 83:41 - 83:47
cups got boy scout a good floor of a
  • 83:43 - 83:49
tick with dancer and maybe a little more
  • 83:47 - 83:55
    a loving person
  • 83:49 - 83:59
I had background with your blood my
  • 83:55 - 84:04
    blood Native American blood tallying
  • 83:59 - 84:08
blood what can I tell you blacks you're
  • 84:04 - 84:11
my you're my family when my family
  • 84:08 - 84:16
mystery set misrepresents me I'm hurt
  • 84:11 - 84:21
past my heart I've served this community
  • 84:16 - 84:26
like many of these other people here all
  • 84:21 - 84:26
    generations all walks of life
  • 84:28 - 84:37
this is one this is my premiere I'm
  • 84:33 - 84:42
giving a turn 71 years young and it's
  • 84:37 - 84:46
still going on y'all and I love you I've
  • 84:42 - 84:52
been a man in blue so what's up
  • 84:46 - 84:58
I've been profiled I've got friends
  • 84:52 - 85:04
they've been profiled my grandpa look
  • 84:58 - 85:12
like y'all but he was considered black
  • 85:04 - 85:14
statistics from medical to all different
  • 85:12 - 85:20
types of things animals whatever it's
  • 85:14 - 85:25
it's moving to me how judgment can be
  • 85:20 - 85:29
placed on one because of a statistic
  • 85:25 - 85:29
    let's get real
  • 85:30 - 85:39
the cover is off I love this town but
  • 85:36 - 85:47
there's some things about this town I do
  • 85:39 - 85:51
not love and it's showing and I'm not
  • 85:47 - 85:55
    blaming anybody particularly but the
  • 85:51 - 85:59
finger pointers are there so you have to
  • 85:55 - 86:03
be real in your own hearts and represent
  • 85:59 - 86:10
I don't know what else I can tell you
  • 86:03 - 86:14
God's watching that's my master and God
  • 86:10 - 86:27
bless y'all and God have mercy upon you
  • 86:14 - 86:31
thank you hello my name is Buffy Jameson
  • 86:27 - 86:33
I am a co-chair and founder of the Iowa
  • 86:31 - 86:36
    queer communities of color coalition
  • 86:33 - 86:38
about a couple of weeks ago us the Iowa
  • 86:36 - 86:40
    queer communities of color coalition
  • 86:38 - 86:40
along with the Des Moines branch of the
  • 86:40 - 86:43
    n-double a-c-p
  • 86:40 - 86:45
and one Iowa got together to have a
  • 86:43 - 86:47
    community discussion about profiling
  • 86:45 - 86:53
    here is what we learned
  • 86:47 - 86:58
it's rampid it's happening to many of us
  • 86:53 - 87:01
it's happening to people because of a
  • 86:58 - 87:03
variety of different identities not even
  • 87:01 - 87:05
just racial we heard from a lot of trans
  • 87:03 - 87:09
    individuals who talked about being
  • 87:05 - 87:14
profiled and what that means for them I
  • 87:09 - 87:16
have sat and listened to my friends and
  • 87:14 - 87:21
my family talk about their experiences
  • 87:16 - 87:26
    with profiling and especially especially
  • 87:21 - 87:29
when it's coming from my mama or my
  • 87:26 - 87:32
little brother like that's my baby bro
  • 87:29 - 87:35
when he told me that he was stopped and
  • 87:32 - 87:38
that he you know it just scared the hell
  • 87:35 - 87:40
out of me it really did that's my heart
  • 87:38 - 87:43
right there that's my baby bro
  • 87:40 - 87:44
this is something that is extremely
  • 87:43 - 87:48
    personal to
  • 87:44 - 87:50
many of us many of us not just the black
  • 87:48 - 87:52
community not just a lot the next
  • 87:50 - 87:59
community or Asian Americans or Native
  • 87:52 - 88:00
Americans but all of us if they come for
  • 87:59 - 88:03
all for one of us eventually they're
  • 88:00 - 88:06
gonna come for all of you and I know
  • 88:03 - 88:08
that that's something that's been said
  • 88:06 - 88:10
over and over again for a variety of
  • 88:08 - 88:13
reasons and people don't tend to believe
  • 88:10 - 88:13
    it but it's true
  • 88:13 - 88:18
something that I heard over and over
  • 88:17 - 88:22
again and I was born and raised here by
  • 88:18 - 88:25
the way as I was growing up is oh no oh
  • 88:22 - 88:28
why are our young people leaving why
  • 88:25 - 88:30
    aren't they staying why
  • 88:28 - 88:32
you know Iowa's getting older and older
  • 88:30 - 88:33
and all of our children they're just
  • 88:32 - 88:39
leaving as soon as they get the chance
  • 88:33 - 88:42
they just take off why I have seen about
  • 88:39 - 88:45
five of my friends take off from here
  • 88:42 - 88:47
queer people of color because they just
  • 88:45 - 88:50
couldn't take it anymore if you want
  • 88:47 - 88:52
your young people to stay you need to
  • 88:50 - 88:57
start listening to us if you want people
  • 88:52 - 89:01
    to take responsibility for their
  • 88:57 - 89:03
community then you have to listen if you
  • 89:01 - 89:06
don't listen to what we are saying to
  • 89:03 - 89:08
you then why should we say do you have
  • 89:06 - 89:11
any idea how many times I thought about
  • 89:08 - 89:15
leaving my own home my whole half of my
  • 89:11 - 89:18
mom's side of the family is here but I
  • 89:15 - 89:21
thought over and over again about how
  • 89:18 - 89:23
much better my life might be if I didn't
  • 89:21 - 89:25
live here and that makes me sad and I
  • 89:23 - 89:28
know I'm not the only one who has had
  • 89:25 - 89:28
    these thoughts
  • 89:29 - 89:35
what keeps getting regurgitated at us
  • 89:32 - 89:36
over and over again if there isn't a
  • 89:35 - 89:38
    problem
  • 89:36 - 89:39
    this isn't that's right spread if you're
  • 89:38 - 89:41
thinking of this this is all in your
  • 89:39 - 89:48
head this is better than that all right
  • 89:41 - 89:50
cool prove it pass this ordinance prove
  • 89:48 - 89:53
it if there really isn't a problem then
  • 89:50 - 89:59
this would Ellis trait it for all of us
  • 89:53 - 90:07
prove it that's all I have to say thank
  • 89:59 - 90:09
you for your time good evening Council
  • 90:07 - 90:11
my name is Laurel Clinton I live at
  • 90:09 - 90:14
    eleven ninety tenth Street
  • 90:11 - 90:17
des Moines Iowa I wasn't gonna speak
  • 90:14 - 90:19
tonight I was not asked to speak but
  • 90:17 - 90:22
this came across my facebook feet today
  • 90:19 - 90:25
and it was important to me to say this
  • 90:22 - 90:29
to you this is a quote from Albert
  • 90:25 - 90:31
Einstein it says the world is not
  • 90:29 - 90:34
dangerous because of those who do harm
  • 90:31 - 90:38
but because of those who look at it
  • 90:34 - 90:40
without doing anything so that's why
  • 90:38 - 90:45
we're here tonight because I can speak
  • 90:40 - 90:48
directly about the harm that my son felt
  • 90:45 - 90:50
from his racial profiling how I've been
  • 90:48 - 90:52
the one a couple of the council members
  • 90:50 - 90:54
and I thank you for asking how he's
  • 90:52 - 90:58
doing how he's progressing since that
  • 90:54 - 91:01
but he took what I say was monumental
  • 90:58 - 91:05
courage to fight for his constitutional
  • 91:01 - 91:07
rights after that stop he's a young man
  • 91:05 - 91:10
and I know grown men who are afraid who
  • 91:07 - 91:14
have lost their voice because of these
  • 91:10 - 91:15
incidents and it hurts me as a woman
  • 91:14 - 91:18
that I have to come up here and fight
  • 91:15 - 91:23
for my men in my community but I'll do
  • 91:18 - 91:26
it because they're important to us so as
  • 91:23 - 91:28
you take the time counsel because I
  • 91:26 - 91:31
thank you for what you've done to move
  • 91:28 - 91:33
it this far and we I think you Scott
  • 91:31 - 91:36
    tonight especially for saying you'd
  • 91:33 - 91:38
waive that opportunity to to rush it
  • 91:36 - 91:40
through that we get the right wording in
  • 91:38 - 91:42
that we're all comfortable in this
  • 91:40 - 91:44
    community I
  • 91:42 - 91:49
do not want any person no matter their
  • 91:44 - 91:53
rates to be sacrificed for a statistic
  • 91:49 - 91:55
we have to be more than a statistic we
  • 91:53 - 92:00
have to be part of the community and in
  • 91:55 - 92:01
order to over our to move forward we
  • 92:00 - 92:04
have to come together and that's what
  • 92:01 - 92:07
we're doing we have a whole chamber of
  • 92:04 - 92:10
people who just want to be respected
  • 92:07 - 92:12
when they walk out of their homes who
  • 92:10 - 92:15
are doing the normal things that any
  • 92:12 - 92:18
people should be able to do without
  • 92:15 - 92:20
    consequences the Surgeon General has
  • 92:18 - 92:25
almost said that being black in America
  • 92:20 - 92:28
is detrimental to your health so it's
  • 92:25 - 92:30
because of that that your citizens in
  • 92:28 - 92:33
the city of Des Moines Iowa are asking
  • 92:30 - 92:36
    you to please please
  • 92:33 - 92:36
pace yourself do a good job make us all
  • 92:36 - 92:49
    proud
  • 92:36 - 92:50
thank you I want to thank you all for
  • 92:49 - 92:53
coming down this evening I think that
  • 92:50 - 92:58
you've given us some more valuable input
  • 92:53 - 93:03
is Mr Sanders said and has asked that we
  • 92:58 - 93:05
not proceed with 40 a which is the final
  • 93:03 - 93:09
    consideration which he had originally
  • 93:05 - 93:11
requested I think he has felt that
  • 93:09 - 93:13
there's been some valuable input here
  • 93:11 - 93:16
this evening but I do feel that we have
  • 93:13 - 93:17
to to move a lot of this stuff forward
  • 93:16 - 93:20
and know that this is a dynamic process
  • 93:17 - 93:22
we've been working on it for years I
  • 93:20 - 93:23
look at Cameron and he knows how hard
  • 93:22 - 93:27
we've been working on not only this but
  • 93:23 - 93:29
bridging the gap and all the other we
  • 93:27 - 93:31
think effective steps that we're taking
  • 93:29 - 93:33
for all members of our community and I
  • 93:31 - 93:41
want to urge you all to continue that
  • 93:33 - 93:44
work and I mr. manager I want to ask you
  • 93:41 - 93:45
to take into consideration I said you've
  • 93:44 - 93:50
been taking a lot of notes here this
  • 93:45 - 93:53
evening and let's incorporate as much as
  • 93:50 - 93:56
we can into our moving forward but I
  • 93:53 - 93:58
    would like to see these
  • 93:56 - 94:00
ordinances which I believe we have
  • 93:58 - 94:03
supported to put the racial profiling
  • 94:00 - 94:05
ordinance in place I'd like to move
  • 94:03 - 94:09
these forward as quickly as possible and
  • 94:05 - 94:13
I'd also like to move it forward to make
  • 94:09 - 94:15
sure we get that RFP out and so what
  • 94:13 - 94:19
whatever process that we can have to
  • 94:15 - 94:22
move all these initiatives that you have
  • 94:19 - 94:25
worked on with staff and with our
  • 94:22 - 94:27
members of human and civil rights and
  • 94:25 - 94:29
quite frankly also I want to thank our
  • 94:27 - 94:35
members of the Civil Service Commission
  • 94:29 - 94:37
who have reviewed an awful lot of folks
  • 94:35 - 94:38
that are applying for jobs at the City
  • 94:37 - 94:41
of Des Moines and especially in in
  • 94:38 - 94:44
public safety and urge them we've got a
  • 94:41 - 94:48
great balance on on that particular
  • 94:44 - 94:51
Commission as well I mean we've got good
  • 94:48 - 94:53
gender balance we've got good racial
  • 94:51 - 94:56
balance we've got a couple of brown
  • 94:53 - 95:01
individuals into blacks and three whites
  • 94:56 - 95:04
and we urge them to keep their eyes wide
  • 95:01 - 95:06
open as well and let's continue all
  • 95:04 - 95:08
working together to make progress but I
  • 95:06 - 95:11
want to see it move together rather than
  • 95:08 - 95:13
I knowing that the process over time is
  • 95:11 - 95:15
going to be dynamic and we're going to
  • 95:13 - 95:18
get more good ideas but let's get some
  • 95:15 - 95:20
of this moving forward and so if
  • 95:18 - 95:22
somebody will give us a motion I think
  • 95:20 - 95:24
that we ought to at least take the first
  • 95:22 - 95:31
reading of this and move this process
  • 95:24 - 95:34
forward so just for clarity B and C all
  • 95:31 - 95:36
right it's been moved penny a point yeah
  • 95:34 - 95:41
I just wanted to check which to go ahead
  • 95:36 - 95:43
with the proposals for the RFP at the
  • 95:41 - 95:45
same time or okay yep that's part of my
  • 95:43 - 95:45
    motion
  • 95:47 - 95:58
soaking videos gosh I'd like to to make
  • 95:54 - 95:59
some comments first off I want to thank
  • 95:58 - 96:00
everyone that's been a part of this
  • 95:59 - 96:05
    process
  • 96:00 - 96:08
the folks at CCI and double-a-c-p ACLU I
  • 96:05 - 96:11
want to thank the civil and human rights
  • 96:08 - 96:14
commission for their work I also want to
  • 96:11 - 96:20
thank the city manager the city attorney
  • 96:14 - 96:25
and the police chief for their work -
  • 96:20 - 96:29
this has been a valuable process I know
  • 96:25 - 96:32
it's been a long process I know for for
  • 96:29 - 96:36
folks who have a different lived
  • 96:32 - 96:41
experience in this community than me the
  • 96:36 - 96:43
process is too long and that is actually
  • 96:41 - 96:47
one of the things that this process
  • 96:43 - 96:51
helps me understand you know it started
  • 96:47 - 96:55
when at a meeting much like this when a
  • 96:51 - 96:57
bunch of folks at least for me I know it
  • 96:55 - 97:01
started way before that but for me two
  • 96:57 - 97:04
years ago when when folks came to one of
  • 97:01 - 97:09
our meetings and asked me to participate
  • 97:04 - 97:14
in a series of community meetings and I
  • 97:09 - 97:17
spent time at community meetings at
  • 97:14 - 97:19
several small group meetings before and
  • 97:17 - 97:23
after the community meetings and I've
  • 97:19 - 97:28
met with constituents outside of that as
  • 97:23 - 97:33
well and I continue to learn from that
  • 97:28 - 97:37
process one of the things that that is
  • 97:33 - 97:42
hard it folks have pointed it out I mean
  • 97:37 - 97:46
I I sit here in a position of privilege
  • 97:42 - 97:50
I get to make decisions and I've lived a
  • 97:46 - 97:51
life of privilege I don't have the same
  • 97:50 - 97:55
    experience that everyone in our
  • 97:51 - 98:00
community has but it's my responsibility
  • 97:55 - 98:08
to help make sure that our community
  • 98:00 - 98:12
works for everyone and we have folks in
  • 98:08 - 98:16
our community who know that it is not
  • 98:12 - 98:18
working for them in the same way that it
  • 98:16 - 98:23
is working for others and we have a
  • 98:18 - 98:28
responsibility to listen to learn and to
  • 98:23 - 98:32
work to fix it I and this process has
  • 98:28 - 98:38
been a part of that I and I I've seen
  • 98:32 - 98:43
I've seen steps in in progress that
  • 98:38 - 98:44
maybe not everyone gets to see but just
  • 98:43 - 98:46
in the way that the discussion has
  • 98:44 - 98:49
evolved over the course of the two years
  • 98:46 - 98:51
now this isn't the first time that
  • 98:49 - 98:56
something has been back in front of us
  • 98:51 - 99:00
and we've improved over time what is
  • 98:56 - 99:02
back in front of us we've had a serious
  • 99:00 - 99:05
conversation and one of the things that
  • 99:02 - 99:08
I am appreciative of has been the
  • 99:05 - 99:12
willingness of the city manager and the
  • 99:08 - 99:16
chief to continue engaging and continue
  • 99:12 - 99:22
thinking through these issues there is
  • 99:16 - 99:25
not consensus on our end on how to solve
  • 99:22 - 99:28
this and how to go forward but we are
  • 99:25 - 99:33
continuing to work through that process
  • 99:28 - 99:37
and that is important that willingness
  • 99:33 - 99:39
and openness to talk to continue
  • 99:37 - 99:42
learning and to continue looking for
  • 99:39 - 99:49
solutions is an important part of this
  • 99:42 - 99:53
process what we have in front of us
  • 99:49 - 99:56
there are three pieces of the six there
  • 99:53 - 99:58
were six different different pieces that
  • 99:56 - 100:02
    the community elevated and brought
  • 99:58 - 100:08
brought to us and we've got three pieces
  • 100:02 - 100:08
of that and that is a step forward
  • 100:08 - 100:14
    it's an important step forward it's a
  • 100:11 - 100:16
first step forward and there are there
  • 100:14 - 100:19
is more to do even within the
  • 100:16 - 100:20
constraints of these three items and
  • 100:19 - 100:23
we're going to keep having that
  • 100:20 - 100:26
conversation but this is an important
  • 100:23 - 100:29
step forward we are putting in our
  • 100:26 - 100:38
    ordinance a prohibition on racial
  • 100:29 - 100:45
profiling yes we are taking steps on
  • 100:38 - 100:48
data collection because we need to do
  • 100:45 - 100:51
better on that front if we we frequently
  • 100:48 - 100:56
say up here you can't manage what you
  • 100:51 - 100:58
don't measure and and this is a part of
  • 100:56 - 101:01
that and going forward and identifying
  • 100:58 - 101:04
best practices on data collection and
  • 101:01 - 101:07
taking concrete steps to implement those
  • 101:04 - 101:11
practices will help make this a better
  • 101:07 - 101:14
discussion going forward and it's a part
  • 101:11 - 101:17
of it's a part of solving this problem
  • 101:14 - 101:20
and that's a concrete and important step
  • 101:17 - 101:21
and we're taking step on the training
  • 101:20 - 101:23
steps on the training side the
  • 101:21 - 101:26
    de-escalation training and the implicit
  • 101:23 - 101:29
bias training and that's already having
  • 101:26 - 101:32
an impact and I don't know how many but
  • 101:29 - 101:35
I know there has been online training
  • 101:32 - 101:38
pushed out to I think the entire city on
  • 101:35 - 101:41
implicit bias training I spent some time
  • 101:38 - 101:41
    doing that myself
  • 101:43 - 101:52
    I recognize it's not the same but it's a
  • 101:45 - 101:54
piece all of this is a piece and we are
  • 101:52 - 102:00
moving these things forward and that's
  • 101:54 - 102:02
making a difference I'm committed above
  • 102:00 - 102:04
and beyond what we do here and what we
  • 102:02 - 102:09
do over the next two readings I
  • 102:04 - 102:11
recognize that there is more to do and
  • 102:09 - 102:17
I've talked about a number of those
  • 102:11 - 102:22
issues I'm particularly interested in in
  • 102:17 - 102:26
addressing how we deal with marijuana
  • 102:22 - 102:28
and I've talked about that for some time
  • 102:26 - 102:31
    making that the lowest enforcement
  • 102:28 - 102:33
    priority I'm gonna continue talking
  • 102:31 - 102:36
about that and working to build
  • 102:33 - 102:39
consensus I know there's not consensus
  • 102:36 - 102:42
there today but that is an issue that I
  • 102:39 - 102:45
am committed to continuing to work on
  • 102:42 - 102:47
    and committed to continuing the
  • 102:45 - 102:52
conversation to meeting with anyone who
  • 102:47 - 102:54
wants to to moving this forward above
  • 102:52 - 102:57
and beyond just the actions that we take
  • 102:54 - 103:00
here today because there's more work to
  • 102:57 - 103:04
be done there are more stories to be
  • 103:00 - 103:06
heard and it's our responsibility to
  • 103:04 - 103:09
make our community work for everyone
  • 103:06 - 103:13
and I appreciate everything that has
  • 103:09 - 103:17
gotten us to this point but it's only a
  • 103:13 - 103:17
    starting point matter
  • 103:20 - 103:27
okay any other comments I we have a
  • 103:25 - 103:29
motion on the on the board we're just
  • 103:27 - 103:30
gonna echo what josh has said having
  • 103:29 - 103:33
been involved from the plane so
  • 103:30 - 103:35
appreciate that we know that there's
  • 103:33 - 103:36
more to do but I just want everybody you
  • 103:35 - 103:38
know we have from what the first
  • 103:36 - 103:40
proposal was to now we have made some
  • 103:38 - 103:44
giant steps and we're going to continue
  • 103:40 - 103:46
the dialogue and the different issues
  • 103:44 - 103:49
that have come up and listen to the new
  • 103:46 - 103:50
proposals and to try to make this the
  • 103:49 - 103:55
best for everybody to make everybody
  • 103:50 - 103:55
feel comfortable and safe in the city
  • 103:57 - 104:03
yes we're the only ones haven't and Jo
  • 104:01 - 104:10
moved it so I'm assuming he's voting for
  • 104:03 - 104:12
it yep seven yes again thank you all for
  • 104:10 - 104:15
being here and let's all stay engaged
  • 104:12 - 104:18
and keep working and I appreciate
  • 104:15 - 104:20
Cameron you and the human civil rights
  • 104:18 - 104:25
we'll have a good meeting this week
  • 104:20 - 104:28
we've got more work to do and with that
  • 104:25 - 104:29
we will I think we have to move to
  • 104:28 - 104:31
    hearings right yes all right
  • 104:29 - 104:40
we'll get ready a chance if anybody
  • 104:31 - 104:40
    wants to be okay
  • 104:48 - 104:52
I'm sorry the motion was for beans
  • 104:58 - 105:01

from the city to purchase my sound
  • 125:52 - 125:57
permits for Amy's I meet with them in
  • 125:55 - 125:59
February and then I get all my sound
  • 125:57 - 126:01
permits for March all the way through
  • 125:59 - 126:04
Halloween and then I write them a check
  • 126:01 - 126:06
and I'm good for the season the sound
  • 126:04 - 126:10
parent rules have changed and they only
  • 126:06 - 126:12
changed two years ago the new rule is I
  • 126:10 - 126:13
pay the city $200 and I get eight days
  • 126:12 - 126:16
    that's it
  • 126:13 - 126:18
per month these eight days are
  • 126:16 - 126:20
    non-refundable are transferable so in
  • 126:18 - 126:24
the month of May this year there are 10
  • 126:20 - 126:25
total Fridays and Saturdays I have to
  • 126:24 - 126:28
    randomly guess which Fridays and
  • 126:25 - 126:32
Saturdays I want to have amplified sound
  • 126:28 - 126:34
outside on my patio every month one or
  • 126:32 - 126:36
more weekend days are ruined due to rain
  • 126:34 - 126:39
or severe weather this 8 day rule does
  • 126:36 - 126:41
not work for many reasons first of all I
  • 126:39 - 126:42
guarantee you a majority of the
  • 126:41 - 126:45
businesses around Des Moines do not
  • 126:42 - 126:48
follow this rule or even pay attention
  • 126:45 - 126:51
or know about it the old room that we
  • 126:48 - 126:54
had two years ago I could purchase more
  • 126:51 - 126:56
days for an extra hundred dollars I did
  • 126:54 - 126:58
this for years and the city made a lot
  • 126:56 - 127:01
of money because this is how it worked
  • 126:58 - 127:03
I believe they changed the rule because
  • 127:01 - 127:05
they were bombarded by sound permits on
  • 127:03 - 127:07
very short notice for every night of the
  • 127:05 - 127:10
week our people just didn't follow the
  • 127:07 - 127:13
rules at Inez I'd like to play music on
  • 127:10 - 127:15
my patio every Sunday afternoon but
  • 127:13 - 127:19
according to the these new rules I can't
  • 127:15 - 127:21
I'd like to have karaoke or bingo or a
  • 127:19 - 127:25
DJ on Wednesday nights but according to
  • 127:21 - 127:27
these rules I can't my suggestion to the
  • 127:25 - 127:30
city is to let establishments by more
  • 127:27 - 127:32
than eight days first of all I would
  • 127:30 - 127:34
like the two hundred dollars per month
  • 127:32 - 127:36
to get you a total of ten days per month
  • 127:34 - 127:39
to cover your extra weekends or there's
  • 127:36 - 127:42
a Friday or Saturday then you can buy
  • 127:39 - 127:45
    Sunday's afternoons or Thursdays or
  • 127:42 - 127:48
Wednesdays to a certain time and respect
  • 127:45 - 127:50
the noise levels each day after the
  • 127:48 - 127:51
first ten days could cost a business
  • 127:50 - 127:54
owner somewhere between fifteen and a
  • 127:51 - 127:56
hundred dollars then the city is making
  • 127:54 - 127:59
extra money sound permits should be a
  • 127:56 - 128:00
privilege and if you don't follow the
  • 127:59 - 128:03
rules and you aren't respectful to your
  • 128:00 - 128:05
neighbors you should not be able to get
  • 128:03 - 128:07
these sound permits but it's unfair to
  • 128:05 - 128:09
punish the good business owners because
  • 128:07 - 128:11
a few bad actors in recent years have
  • 128:09 - 128:14
abused the rules and didn't have respect
  • 128:11 - 128:15
for the city those people should be
  • 128:14 - 128:18
punished and not allowed to have more
  • 128:15 - 128:20
than a certain amount however the good
  • 128:18 - 128:22
business owners and the ones that you
  • 128:20 - 128:24
know contribute to the community should
  • 128:22 - 128:25
have an opportunity to succeed and make
  • 128:24 - 128:28
Court Avenue a great environment for
  • 128:25 - 128:31
people to enjoy I'm coming to you now in
  • 128:28 - 128:34
March to solve this issue before we get
  • 128:31 - 128:36
into May and into the summer months so
  • 128:34 - 128:38
I'm hoping that the city I mean you
  • 128:36 - 128:39
might not even be aware that this is a
  • 128:38 - 128:43
rule and they have changed it a couple
  • 128:39 - 128:46
of years ago yeah so I'll move to
  • 128:43 - 128:49
receive and file this this is new
  • 128:46 - 128:53
information to me I would also like to
  • 128:49 - 128:56
as part of the motion ask for a
  • 128:53 - 129:00
background memo on the changes that are
  • 128:56 - 129:03
    referenced as well as
  • 129:00 - 129:07
    Community development's recommendation
  • 129:03 - 129:10
with regard to the suggestions that that
  • 129:07 - 129:12
miss Baldwin has made so that that comes
  • 129:10 - 129:14
back to us so that we can take a look at
  • 129:12 - 129:16
    those recommendations and consider how
  • 129:14 - 129:19
    to move forward
  • 129:16 - 129:32
    mr. mayor I see sue Ann's here - I'd
  • 129:19 - 129:35
like to ask her a very council swin
  • 129:32 - 129:38
    Donovan neighborhood inspections on how
  • 129:35 - 129:40
did we get to this eight-month manner
  • 129:38 - 129:43
just seems a little fine to me because I
  • 129:40 - 129:46
think that this year we have two months
  • 129:43 - 129:49
that have five weekends in them how did
  • 129:46 - 129:51
we end up deciding on eight eight was
  • 129:49 - 129:54
established years and years ago as a
  • 129:51 - 129:57
compromise on having too much sound in
  • 129:54 - 129:59
especially court Avenue trying to limit
  • 129:57 - 130:03
it so the neighbors in the area weren't
  • 129:59 - 130:04
bothered every single weekend or every
  • 130:03 - 130:07
single night of the week for a whole
  • 130:04 - 130:10
summer we don't have a limit on a time
  • 130:07 - 130:13
frame like shut down by seven they have
  • 130:10 - 130:16
to shut down by 10:30 or 11 depending on
  • 130:13 - 130:19
if it's a weekday or weekend I believe
  • 130:16 - 130:20
    might be 12:30 I can't remember good
  • 130:19 - 130:23
    right before before the ordinance
  • 130:20 - 130:25
changed two years ago and I'll give a
  • 130:23 - 130:27
background memo it's sort of setting out
  • 130:25 - 130:31
    how we got here
  • 130:27 - 130:34
they could pay for a variance to get
  • 130:31 - 130:38
more than the eighth mm-hmm and we had
  • 130:34 - 130:42
to mail cards to everybody within 250
  • 130:38 - 130:44
feet of like Inez and so you'd mail out
  • 130:42 - 130:46
hundreds and hundreds of cards to like
  • 130:44 - 130:49
the plaza cuz that's individually owned
  • 130:46 - 130:52
and 20% of the people could respond
  • 130:49 - 130:54
saying they didn't want the variance to
  • 130:52 - 130:56
add more dates but you could hardly ever
  • 130:54 - 130:57
meet that threshold and so we would hear
  • 130:56 - 130:59
from people that live down there
  • 130:57 - 131:01
especially in the plaza that we
  • 130:59 - 131:04
shouldn't be handing out variances that
  • 131:01 - 131:06
that allowed more sound so we brought it
  • 131:04 - 131:08
to council a couple years ago saying
  • 131:06 - 131:10
they shouldn't be able to get a variance
  • 131:08 - 131:12
unless it was due to a hardship that was
  • 131:10 - 131:15
    not necessarily economic and
  • 131:12 - 131:18
and counsel at that time approved that
  • 131:15 - 131:20
amendment but you know what you
  • 131:18 - 131:22
mentioned you get to get eight per month
  • 131:20 - 131:25
and you have a weekend it's a rained out
  • 131:22 - 131:30
you can't recover can't pay you cannot
  • 131:25 - 131:32
reuse that that's the reason we did that
  • 131:30 - 131:33
years ago when we came up with the
  • 131:32 - 131:36
limits is it would be impossible for
  • 131:33 - 131:38
    staff to manage transferring permits
  • 131:36 - 131:41
from one day to the other and be able to
  • 131:38 - 131:43
tell police and other people when there
  • 131:41 - 131:45
should be appropriate tab music and when
  • 131:43 - 131:48
they weren't supposed to have music for
  • 131:45 - 131:50
enforcement purposes it has to be that
  • 131:48 - 131:52
we know whether that band is supposed to
  • 131:50 - 131:58
be out there or not for enforcement
  • 131:52 - 132:03
purposes and Sue Ann or or Annie how
  • 131:58 - 132:05
many Court Avenue establishments have an
  • 132:03 - 132:11
outdoor patio would you guess best guest
  • 132:05 - 132:13
Oh probably five or six some of them
  • 132:11 - 132:15
have noise on the patio and some don't
  • 132:13 - 132:20
some just use the background some have
  • 132:15 - 132:21
actual DJs and music on the patios Annie
  • 132:20 - 132:25
    does that sound about right
  • 132:21 - 132:27
well I'm thinking if we talk about court
  • 132:25 - 132:29
Avenue then you talk about ingersoll
  • 132:27 - 132:31
then you talk about all the different
  • 132:29 - 132:33
areas in Des Moines - so you have the
  • 132:31 - 132:36
300 group you know down the street by
  • 132:33 - 132:38
Principal Park there's plenty of patios
  • 132:36 - 132:41
the rooftop and that sort of thing and
  • 132:38 - 132:43
then you have a few on court Avenue and
  • 132:41 - 132:46
then you have three or four between
  • 132:43 - 132:48
Larry Smithson's places and then my
  • 132:46 - 132:51
    place and that's what I think I don't
  • 132:48 - 132:52
think people know the actual I'm sure
  • 132:51 - 132:55
like a lot of business owners don't even
  • 132:52 - 132:57
know these rules and going back to the
  • 132:55 - 133:00
neighbors if I want to have an acoustic
  • 132:57 - 133:03
I out there playing guitar on Sunday
  • 133:00 - 133:06
afternoon from 1:00 to 5:00 that I have
  • 133:03 - 133:08
to get a noise permit and with the
  • 133:06 - 133:10
eighth rule now I can't do that which
  • 133:08 - 133:11
makes it a little bit difficult to do
  • 133:10 - 133:13
you know if I want to do bingo on
  • 133:11 - 133:14
Wednesday nights and say okay we're
  • 133:13 - 133:17
gonna have a guy walking around
  • 133:14 - 133:20
announcing numbers outside I have to
  • 133:17 - 133:22
have a noise permit so it stifles my
  • 133:20 - 133:25
business I mean and like she said you
  • 133:22 - 133:27
know if it rains one weekend I'm in
  • 133:25 - 133:30
don't know if you've been down a third
  • 133:27 - 133:32
and Court I am majority patio and it is
  • 133:30 - 133:34
    not covered and it's it's a great
  • 133:32 - 133:37
farmers market place we always have
  • 133:34 - 133:39
someone out there playing guitar on
  • 133:37 - 133:41
farmers market then we have a DJ after
  • 133:39 - 133:44
farmers market then we have a DJ that
  • 133:41 - 133:45
night and then Sunday afternoons we need
  • 133:44 - 133:47
to have a key to be out there someone
  • 133:45 - 133:51
clean you know the instrument or
  • 133:47 - 133:53
something that's amplified sound I mean
  • 133:51 - 133:55
you'd be surprised with like little
  • 133:53 - 133:59
speakers even if I had them inside it
  • 133:55 - 134:02
doesn't give you the same feel as having
  • 133:59 - 134:04
someone out there playing so I'm just
  • 134:02 - 134:05
asking the city to reconsider and I'm
  • 134:04 - 134:07
not saying that there aren't people that
  • 134:05 - 134:09
probably don't break the rules or play
  • 134:07 - 134:11
the music too loud or accidentally go
  • 134:09 - 134:13
over a half an hour when they should not
  • 134:11 - 134:15
do that but then they need to be
  • 134:13 - 134:17
    punished individually because this is
  • 134:15 - 134:21
kind of just a big blanket rule for
  • 134:17 - 134:23
everybody down there mr. mayor can I
  • 134:21 - 134:27
just jump in real quick I'm not sure if
  • 134:23 - 134:31
you can hear me but you know mrs.
  • 134:27 - 134:33
Baldwin has always been a leader down in
  • 134:31 - 134:35
the court Avenue area and anytime we've
  • 134:33 - 134:37
had problems heard her establishment has
  • 134:35 - 134:39
stepped up and she is not the bad actor
  • 134:37 - 134:42
that we have down there whether it be
  • 134:39 - 134:45
noise whether it be any other problems I
  • 134:42 - 134:46
mean she's engaged and I think that we
  • 134:45 - 134:50
need to figure out a way with Josh
  • 134:46 - 134:53
bullshit return it back to help her not
  • 134:50 - 134:56
cyfle her business but help it grow so I
  • 134:53 - 134:58
hope that with Josh's motion that we can
  • 134:56 - 135:03
figure something like that out it was to
  • 134:58 - 135:06
Antel yeah I mean I think that fits
  • 135:03 - 135:09
within the emotion that I made and to
  • 135:06 - 135:11
get a record from Sue and to figure out
  • 135:09 - 135:15
perfect how to approach this and what
  • 135:11 - 135:18
what should recommend so yeah I mean I
  • 135:15 - 135:21
think we want we want to make sure that
  • 135:18 - 135:23
we get this like many other things we're
  • 135:21 - 135:27
trying to get the balance right it's
  • 135:23 - 135:29
    between providing a regulatory framework
  • 135:27 - 135:32
that allows the businesses that are
  • 135:29 - 135:35
doing the right thing to continue
  • 135:32 - 135:36
operating and then I certainly know that
  • 135:35 - 135:41
    I hear from neighbors
  • 135:36 - 135:45
they're from businesses that maybe are
  • 135:41 - 135:48
not as conscientious about following the
  • 135:45 - 135:50
rules because I know Sue Ann you and I
  • 135:48 - 135:52
have worked on several of those just in
  • 135:50 - 135:53
my short time on the council so it's
  • 135:52 - 135:56
about getting that balance right and
  • 135:53 - 135:59
what the recommendation is to get that
  • 135:56 - 136:09
balance right going forward perfect I
  • 135:59 - 136:09
don't yet thank you receive a file yeah
  • 136:14 - 136:17
    [Applause]
  • 136:31 - 136:41
I'm Q Kane at 2700 Grand Avenue des
  • 136:36 - 136:45
Moines Iowa I am the attorney for for
  • 136:41 - 136:47
mr. mr. Carlson mr. Carlson last week
  • 136:45 - 136:50
was injured and was in the hospital and
  • 136:47 - 136:52
he is here tonight but taking medication
  • 136:50 - 136:53
and he asked me to to speak on his
  • 136:52 - 136:57
    behalf
  • 136:53 - 137:01
mr. Carlson was removed as a trustee by
  • 136:57 - 137:06
the mayor on a January 6th of this year
  • 137:01 - 137:09
and pursuant to municipal code law mr.
  • 137:06 - 137:11
Carlson is entitled to a hearing in
  • 137:09 - 137:13
front of this board as to a
  • 137:11 - 137:17
    name-clearing hearing or you process
  • 137:13 - 137:20
your so based on that I would have the
  • 137:17 - 137:22
following statement from mr. Carlson I
  • 137:20 - 137:25
want to thank the mayor and the council
  • 137:22 - 137:27
for this opportunity to address the
  • 137:25 - 137:30
miscarriage of justice in mayor counties
  • 137:27 - 137:34
    surprising and politically motivated
  • 137:30 - 137:36
dismissal of me On January 6 2020 from
  • 137:34 - 137:38
the Des Moines waterworks board of
  • 137:36 - 137:40
trustees in the middle of my term I
  • 137:38 - 137:43
stand before you as a whistleblower
  • 137:40 - 137:46
because no one else was listening the
  • 137:43 - 137:49
mayor used a district court ruling in
  • 137:46 - 137:50
Kelter versus Oskaloosa which allows a
  • 137:49 - 137:54
    mayor to
  • 137:50 - 137:56
move a trustee for any reason trying to
  • 137:54 - 138:01
justify my removal his letter to me On
  • 137:56 - 138:03
January 6 stated I shared with you that
  • 138:01 - 138:06
discussions with your colleagues left me
  • 138:03 - 138:09
convinced that the board as presently
  • 138:06 - 138:11
    constituted is dysfunctional and your
  • 138:09 - 138:14
    colleagues unanimously have indicated to
  • 138:11 - 138:18
me that trust and confidence in you has
  • 138:14 - 138:20
been lost I know in fact that there is
  • 138:18 - 138:23
not a unanimous dissatisfaction with my
  • 138:20 - 138:26
membership how interesting it is to
  • 138:23 - 138:28
blame me for the mayor's lack of
  • 138:26 - 138:31
attention and to use me as a foil to
  • 138:28 - 138:34
justify his great displeasure with the
  • 138:31 - 138:37
waterworks I see it quite differently
  • 138:34 - 138:40
after the loss of Bill stove our new
  • 138:37 - 138:43
chair and vice chair began having closed
  • 138:40 - 138:46
meetings about eight in a few months the
  • 138:43 - 138:48
chair and the vice chair then presented
  • 138:46 - 138:51
the board with a contract in June of
  • 138:48 - 138:55
2019 and discussed how the deal could be
  • 138:51 - 138:59
closed the new waterworks was to be up
  • 138:55 - 139:01
and running in January 2020 a draft
  • 138:59 - 139:04
contract has been circulating in the
  • 139:01 - 139:07
suburbs for several months after I made
  • 139:04 - 139:09
several requests to the waterworks for a
  • 139:07 - 139:14
copy a person from one of the suburbs
  • 139:09 - 139:17
provided me one the contract stated the
  • 139:14 - 139:19
following only two members of the
  • 139:17 - 139:22
    seven-member board would represent the
  • 139:19 - 139:24
City of Des Moines complete control of
  • 139:22 - 139:27
the water work plants budget and
  • 139:24 - 139:29
wholesale water rates were to be
  • 139:27 - 139:32
    immediately controlled by the suburbs
  • 139:29 - 139:35
Water Works asset values had been
  • 139:32 - 139:38
adjusted so that almost no money would
  • 139:35 - 139:40
be contributed upfront a future by out
  • 139:38 - 139:42
of all the Des Moines assets were
  • 139:40 - 139:46
included with the amount to be
  • 139:42 - 139:49
negotiated in 10 or 20 years I asked
  • 139:46 - 139:52
mayor Cownie on several occasions to
  • 139:49 - 139:54
look into what was going on since no one
  • 139:52 - 139:56
    was listening I approached then
  • 139:54 - 139:59
councilman Chris Coleman for help and
  • 139:56 - 140:02
getting the mayor and the council more
  • 139:59 - 140:04
involved as a result of my meeting with
  • 140:02 - 140:06
    Mayor our with Councilman
  • 140:04 - 140:11
then he sent me the following text on
  • 140:06 - 140:14
    August 22nd 2019 hi Gabe
  • 140:11 - 140:16
thanks for visiting yesterday I never
  • 140:14 - 140:18
used your name but did get 60 minutes
  • 140:16 - 140:21
with Frank and Scott Sanders yesterday
  • 140:18 - 140:23
you appropriately lit a fire under us
  • 140:21 - 140:27
we're going to more aggressively engage
  • 140:23 - 140:29
the chair and Sue should have already
  • 140:27 - 140:32
had a convo with the mayor please keep
  • 140:29 - 140:35
me in the loop I need to respect the
  • 140:32 - 140:38
mayor's position in the process and I
  • 140:35 - 140:41
won't overstep but I know how to keep
  • 140:38 - 140:43
things moving and influence him and if
  • 140:41 - 140:46
the ball gets dropped that will be my
  • 140:43 - 140:49
license to get more aggressive myself
  • 140:46 - 140:52
    unfortunately nothing happened
  • 140:49 - 140:54
as a result I became a whistleblower and
  • 140:52 - 140:56
mayor mayor County was embarrassed by
  • 140:54 - 140:58
what I reveal I've done nothing wrong
  • 140:56 - 141:01
and letting the City Council and
  • 140:58 - 141:02
citizens know what was going on mayor
  • 141:01 - 141:04
    Cownie
  • 141:02 - 141:07
can now remove a board trustee for no
  • 141:04 - 141:08
reason and as appointed as campaign
  • 141:07 - 141:11
    manager as my replacement
  • 141:08 - 141:14
the mayor is now in total control and
  • 141:11 - 141:17
responsible for the waterworks and all
  • 141:14 - 141:19
    regionalization action Water Works
  • 141:17 - 141:22
    customer relations committee the one
  • 141:19 - 141:24
    responsible for regionalization has
  • 141:22 - 141:27
owned has only had closed meetings since
  • 141:24 - 141:29
    approximately March of 2019 the
  • 141:27 - 141:33
leadership has stated that it did not
  • 141:29 - 141:36
want to quote discuss marketing and
  • 141:33 - 141:38
    pricing strategies and proprietary
  • 141:36 - 141:40
    information that may impact its
  • 141:38 - 141:43
    competitive position by public
  • 141:40 - 141:46
disclosure not required of potential or
  • 141:43 - 141:49
    actual competitors related to ongoing
  • 141:46 - 141:53
    negotiations over creating an integrated
  • 141:49 - 141:56
Regional Water Authority I worked hard
  • 141:53 - 141:59
for the citizens of Des Moines during my
  • 141:56 - 142:01
chairmanship from 2012 to 2013 we began
  • 141:59 - 142:03
the greater Des Moines Botanical Garden
  • 142:01 - 142:06
    Foundation the Des Moines waterworks
  • 142:03 - 142:10
Park Foundation and we hired bill Stowe
  • 142:06 - 142:12
I've worked for 16 years volunteering my
  • 142:10 - 142:14
time as a trustee and I do not deserve
  • 142:12 - 142:17
to be traded treated with such
  • 142:14 - 142:20
disrespect so what do I want
  • 142:17 - 142:22
with unlimited removal power and his
  • 142:20 - 142:24
campaign manager on the board mayor
  • 142:22 - 142:26
Cownie now has complete control of the
  • 142:24 - 142:29
    waterworks don't give away the
  • 142:26 - 142:32
waterworks to the suburbs one you should
  • 142:29 - 142:35
    immediately stop all secret negotiations
  • 142:32 - 142:39
on regionalization and assemble a task
  • 142:35 - 142:39
force to review everything that water
  • 142:45 - 142:51
    - you should hold public hearings on
  • 142:49 - 143:00
what the present owners the ratepayers
  • 142:51 - 143:03
of Des Moines want to do 3 you should
  • 143:00 - 143:05
hire an outside financial analyst to
  • 143:03 - 143:07
make a realistic assessment of the
  • 143:05 - 143:10
    numerous studies Water Works has
  • 143:07 - 143:12
initiated and determined the real value
  • 143:10 - 143:16
of the Water Works plants and other
  • 143:12 - 143:18
physical resources please don't give the
  • 143:16 - 143:21
waterworks away to the suburbs thank you
  • 143:18 - 143:21
    so much
  • 143:28 - 143:35
and we would add one more put day back
  • 143:31 - 143:39
on the Des Moines Water Works board
  • 143:35 - 143:43
my name is qsv I'm a member of CCI I
  • 143:39 - 143:46
live at the 1005 63rd Street I'm here
  • 143:43 - 143:47
we're here to stand up for Dave it's
  • 143:46 - 143:49
been a champion of clean water a
  • 143:47 - 143:51
champion for 16 years other folks that
  • 143:49 - 144:02
are here to stand up and support Dave
  • 143:51 - 144:04
please stand up so thank you just wanted
  • 144:02 - 144:06
you to know that even though not every
  • 144:04 - 144:07
and everybody is welcome to talk to you
  • 144:06 - 144:10
even though everybody might not talk
  • 144:07 - 144:12
they've got a lot of support so we're
  • 144:10 - 144:14
here to stand up for Dave we're here to
  • 144:12 - 144:16
stand up for clean water because he was
  • 144:14 - 144:19
recently kicked off the Des Moines Water
  • 144:16 - 144:23
Works board by mayor County because Dave
  • 144:19 - 144:25
was being open and honest mayor Cownie
  • 144:23 - 144:29
boo today because Dave stood up for
  • 144:25 - 144:32
people and clean water he challenged how
  • 144:29 - 144:35
    decisions about water regionalization in
  • 144:32 - 144:39
the metro area were being made behind
  • 144:35 - 144:43
closed doors and behind our backs what
  • 144:39 - 144:45
the mayor did is wrong don't be smart
  • 144:43 - 144:48
    smirking at me
  • 144:45 - 144:50
we need the City Council to stand up for
  • 144:48 - 144:51
clean water we need the cut city council
  • 144:50 - 144:55
    the stand of her people
  • 144:51 - 144:55
    [Applause]
  • 144:56 - 145:04
we don't need behind closed doors behind
  • 145:00 - 145:08
our backs deals we need Dave back on the
  • 145:04 - 145:12
board I'm gonna ask a rhetorical
  • 145:08 - 145:13
question as I leave Frank if Dave had
  • 145:12 - 145:15
supported you in the election rather
  • 145:13 - 145:19
than your opponent Jack hat would he
  • 145:15 - 145:19
have been booted off the board
  • 145:19 - 145:32
    [Applause]
  • 145:28 - 145:39
my name is good I appreciate in your hue
  • 145:32 - 145:41
right yeah this was an opportunity for
  • 145:39 - 145:43
Dave to make a statement which he gave
  • 145:41 - 145:46
over to his attorney and I appreciate
  • 145:43 - 145:49
that and and I understand that and so
  • 145:46 - 145:51
this isn't sort of an open hearing to
  • 145:49 - 145:53
whatever but can I make a statement
  • 145:51 - 145:54
let's we got two people to make
  • 145:53 - 145:56
statements and then you're going to
  • 145:54 - 145:59
receive and file and appreciate your
  • 145:56 - 146:02
comments go ahead so my name is ava I
  • 145:59 - 146:04
live at 6:56 to 16th Street in Des
  • 146:02 - 146:06
    Moines over in Sherman Hill
  • 146:04 - 146:07
unfortunately because we live in Iowa
  • 146:06 - 146:09
and our state has been overrun by the
  • 146:07 - 146:12
factory from industry our right to clean
  • 146:09 - 146:14
    water is constantly under threat
  • 146:12 - 146:16
fortunately because we live in Des
  • 146:14 - 146:18
Moines and the Water Works has a nitrate
  • 146:16 - 146:20
removal system we can have safe clean
  • 146:18 - 146:22
drinking water so but any discussions
  • 146:20 - 146:24
    about regionalization or what impacts
  • 146:22 - 146:27
our right to clean water should not be
  • 146:24 - 146:30
discussed behind closed doors we're not
  • 146:27 - 146:31
a deal that you can make without us and
  • 146:30 - 146:33
that's why we need people like Dave more
  • 146:31 - 146:35
than ever who will stand up to our right
  • 146:33 - 146:36
to clean water and so Dave should be
  • 146:35 - 146:38
back on the board and we need more
  • 146:36 - 146:41
people like him not people who won't
  • 146:38 - 146:41
    make deals without us
  • 146:48 - 146:55
at a Mason 1434 44th Street I am also an
  • 146:52 - 146:58
Iowa CCI member I am also here to
  • 146:55 - 147:01
support Dave Carlson dave was a champion
  • 146:58 - 147:03
for clean water you know during his time
  • 147:01 - 147:05
on the board numerous things that he did
  • 147:03 - 147:06
to support Des Moines Water Works to
  • 147:05 - 147:08
support the City of Des Moines but most
  • 147:06 - 147:11
importantly to protect the ratepayers of
  • 147:08 - 147:14
Des Moines Dave voted for the Des Moines
  • 147:11 - 147:16
waterworks lawsuit as a board member and
  • 147:14 - 147:18
    he fought legislative attempts to
  • 147:16 - 147:19
    dismantle Des Moines waterworks which
  • 147:18 - 147:24
was more than discounted and at that
  • 147:19 - 147:26
time currently he was one of the the Des
  • 147:24 - 147:28
    Moines waterworks board members who
  • 147:26 - 147:30
voted to support CC eyes lawsuit against
  • 147:28 - 147:36
the state of Iowa protecting clean water
  • 147:30 - 147:37
for this city in this state and that's
  • 147:36 - 147:39
what our vision for for what this
  • 147:37 - 147:41
council should be doing is working in
  • 147:39 - 147:42
partnership with the community to make
  • 147:41 - 147:43
life better for more people it's plain
  • 147:42 - 147:45
    and simple
  • 147:43 - 147:47
shouldn't be that hard to figure out
  • 147:45 - 147:49
Dave sounded the alarm for just how far
  • 147:47 - 147:51
    these regionalization talks had happened
  • 147:49 - 147:54
behind closed doors and for that he was
  • 147:51 - 147:57
punished he was fired earlier tonight
  • 147:54 - 147:59
this chamber was packed talking with you
  • 147:57 - 148:00
about discussions that you've had with
  • 147:59 - 148:02
community members over the last two
  • 148:00 - 148:04
years to move forward a racial profiling
  • 148:02 - 148:06
    ordinance now admittedly that that
  • 148:04 - 148:08
ordinance is not where we like it but
  • 148:06 - 148:11
you agreed to keep the conversation
  • 148:08 - 148:13
going so why you would move forward with
  • 148:11 - 148:15
a double standard to allow those
  • 148:13 - 148:18
    regionalization talks to continue to
  • 148:15 - 148:21
exclude the public boggles my mind that
  • 148:18 - 148:23
cannot continue that's why we need
  • 148:21 - 148:25
people like Dave back on the board board
  • 148:23 - 148:26
members and counselors like yourself who
  • 148:25 - 148:31
are going to partner with the community
  • 148:26 - 148:31
and put people first that's it
  • 148:34 - 148:38
I'd like to speak as well and I think
  • 148:36 - 148:40
there's more folks who want their voices
  • 148:38 - 148:42
heard so I'd like to make a statement as
  • 148:40 - 148:44
well um my name is Ross I'm a resident
  • 148:42 - 148:47
of Des Moines and I'm a proud member of
  • 148:44 - 148:49
Iowa's CCI and to me these are different
  • 148:47 - 148:52
    issues that have striking resemblances
  • 148:49 - 148:54
to each other this City Council's
  • 148:52 - 148:58
orientation to a ban on racial profiling
  • 148:54 - 149:01
and your decision mayor County to kick
  • 148:58 - 149:02
Dave off the board so raise your hand if
  • 149:01 - 149:04
you were here to support a ban on racial
  • 149:02 - 149:06
    profiling today a real bad
  • 149:04 - 149:08
ya know keep your hand up if you're here
  • 149:06 - 149:10
to demand that Dave gets put back on the
  • 149:08 - 149:10
    board
  • 149:10 - 149:14
neither of these issues should be
  • 149:12 - 149:16
political making sure everyone in our
  • 149:14 - 149:18
city is safe and making sure we can
  • 149:16 - 149:21
drink clean water should it be political
  • 149:18 - 149:24
but it seems for y'all everything is
  • 149:21 - 149:26
political when power is involved you'd
  • 149:24 - 149:28
