the subject property is owned by central
  • 3:11 - 3:17
    Iowa shelter and services determination
  • 3:15 - 3:19
as to whether the requested rezoning is
  • 3:17 - 3:22
in conformance with the plan dsm
  • 3:19 - 3:26
    creating our tomorrow comprehensive plan
  • 3:22 - 3:29
rezone properties from p2 public Civic
  • 3:26 - 3:31
and institutional district to DX to
  • 3:29 - 3:34
downtown district to allow for expansion
  • 3:31 - 3:36
of the existing temporary shelter for
  • 3:34 - 3:41
    additional multiple household living
  • 3:36 - 3:41
units an area for service provision
  • 3:42 - 3:49
there anyone on the in the audience who
  • 3:45 - 3:56
wants to hear this item anyone on the
  • 3:49 - 3:58
Commission okay number two requests from
  • 3:56 - 4:01
    Des Moines cold-storage represented by
  • 3:58 - 4:04
CJ Morton for review and approval of a
  • 4:01 - 4:09
PU deep final development plan for a
  • 4:04 - 4:12
phase one hey of Des Moines cold storage
  • 4:09 - 4:15
located at 3805 Vandalia Road to allow
  • 4:12 - 4:16
the sixty two thousand six hundred and
  • 4:15 - 4:20
eighty square foot addition to the
  • 4:16 - 4:22
    existing refrigerated warehouse building
  • 4:20 - 4:26
there anyone in the audience who wants
  • 4:22 - 4:34
to hear this item anyone on the
  • 4:26 - 4:38
commission as much as I can okay number
  • 4:34 - 4:42
three do you want to say something here
  • 4:38 - 4:44
Erica item three we're recommending it
  • 4:42 - 4:47
was on the consent but we're
  • 4:44 - 4:49
    recommending continuance based on the
  • 4:47 - 4:52
applicant contacted us and was not able
  • 4:49 - 4:54
to set up their neighborhood meeting and
  • 4:52 - 4:59
so under the code they really can't
  • 4:54 - 5:02
proceed with an action on it so the you
  • 4:59 - 5:04
it could be tabled to for two weeks it
  • 5:02 - 5:08
could be tabled for a month depending on
  • 5:04 - 5:09
the Commission's will I guess I have the
  • 5:08 - 5:12
sense they're ready to set that up and
  • 5:09 - 5:12
    have that meeting
  • 5:14 - 5:24
if you really wanted to get them
  • 5:15 - 5:28
adequate time to do that so move okay so
  • 5:24 - 5:30
it's been recommended that its continued
  • 5:28 - 5:32
because we can't take action because
  • 5:30 - 5:35
there hasn't been a neighborhood meeting
  • 5:32 - 5:37
so yeah so if you voted on the consent
  • 5:35 - 5:42
you would be voting to continue yes
  • 5:37 - 5:46
you'll be voting to continue okay number
  • 5:42 - 5:48
four wait I said you might find it
  • 5:46 - 5:51
there's anybody in the odd is anyone
  • 5:48 - 5:56
want to hear what is anyone here -
  • 5:51 - 6:01
you're here for number three banker
  • 5:56 - 6:03
investment okay number four request from
  • 6:01 - 6:06
    living waters fellowship represented by
  • 6:03 - 6:09
Joshua Daggett for the following or the
  • 6:06 - 6:13
following for property located at thirty
  • 6:09 - 6:15
    161 southeast 22nd Street determination
  • 6:13 - 6:17
as to whether the requested rezoning is
  • 6:15 - 6:18
in conformance with the plan dsm
  • 6:17 - 6:23
    creating our tomorrow Comprehensive Plan
  • 6:18 - 6:25
and B rezone property from P to public
  • 6:23 - 6:27
civic institutional district to our x1
  • 6:25 - 6:30
mixed use district to allow for
  • 6:27 - 6:34
conversion of the premise to a daycares
  • 6:30 - 6:36
roots is there anyone here who wants to
  • 6:34 - 6:40
    hear this item
  • 6:36 - 6:44
anyone on the Commission I think did you
  • 6:40 - 6:44
    did you raise your hand
  • 6:46 - 6:54
    [Music]
  • 6:50 - 6:54
    as absolute arrogance
  • 6:54 - 7:00
that that would be a detail of their
  • 6:57 - 7:03
operation under our code it's defined as
  • 7:00 - 7:06
day care yeah okay thanks for that
  • 7:03 - 7:12
    clarification anyone on the Commission
  • 7:06 - 7:19
who wants to hear this okay do I have a
  • 7:12 - 7:22
motion I'll move and we have March 19th
  • 7:19 - 7:24
for the continuance date for item three
  • 7:22 - 7:26
on the staff recommendation but I
  • 7:24 - 7:28
thought I heard he wanted to move it to
  • 7:26 - 7:31
April 30 days to allow things to happen
  • 7:28 - 7:34
as you say that's up to the Commission I
  • 7:31 - 7:38
didn't get a specific request on the
  • 7:34 - 7:41
from the applicant so leave it as it is
  • 7:38 - 7:45
    move consent okay okay
  • 7:41 - 7:48
consents been moved all in favor raise
  • 7:45 - 7:48
    your right hand
  • 7:51 - 7:57
look skinny I missed me right all right
  • 7:58 - 8:02
time for the public hearings so if you
  • 8:01 - 8:04
were here for one through four you don't
  • 8:02 - 8:07
have to stay unless you want to see your
  • 8:04 - 8:07
    government at work
  • 8:13 - 8:18
    okay item number five
  • 8:24 - 8:30
Eric do you want to move it up or yeah
  • 8:27 - 8:33
I'll you want read better okay I'll read
  • 8:30 - 8:36
    request from qfl development represented
  • 8:33 - 8:39
by john larson for review and approval
  • 8:36 - 8:41
of a preliminary plat Woodberry on
  • 8:39 - 8:45
property located in the vicinity of the
  • 8:41 - 8:48
3401 block of East 56th Street to allow
  • 8:45 - 8:53
the property to be divided into 84 Lots
  • 8:48 - 8:57
for one household development to that to
  • 8:53 - 9:01
do two lots for multiple multi household
  • 8:57 - 9:03
development and out lot for stormwater
  • 9:01 - 9:05
    management and/or open space additional
  • 9:03 - 9:08
subject property is owned by jail arts
  • 9:05 - 9:10
and homes yeah and I want to correct
  • 9:08 - 9:13
that that that was corrected to say
  • 9:10 - 9:16
three Lots for you okay there's one
  • 9:13 - 9:19
small lot and that was corrected on what
  • 9:16 - 9:22
got posted online since the time is a
  • 9:19 - 9:22
    packet
  • 9:25 - 9:30
so the property property in question the
  • 9:29 - 9:32
    Commission's familiar they went through
  • 9:30 - 9:35
a rezoning in the fall and then the new
  • 9:32 - 9:38
    zoning ordinance superseded but the
  • 9:35 - 9:43
zoning is reflective generally of what
  • 9:38 - 9:46
was approved in in the previous code you
  • 9:43 - 9:51
have an area two sub areas that are
  • 9:46 - 9:55
    zoned n 2 B and n 2 a each of them allow
  • 9:51 - 9:58
different standards for the house type D
  • 9:55 - 10:00
that would be constructed and that's
  • 9:58 - 10:04
generally the house type that would be
  • 10:00 - 10:07
built in new development throughout the
  • 10:04 - 10:12
perimeter of the city for the most part
  • 10:07 - 10:16
the 2a would require a lot of wider lot
  • 10:12 - 10:19
configuration and area for us the
  • 10:16 - 10:24
    single-family dwelling or one household
  • 10:19 - 10:26
dwelling the it was continued a couple
  • 10:24 - 10:30
times to get that straightened out with
  • 10:26 - 10:33
the design that was being submitted to
  • 10:30 - 10:35
ensure that those Lots would comply with
  • 10:33 - 10:38
standards of the new code for that house
  • 10:35 - 10:42
type and they they've done that and
  • 10:38 - 10:47
resubmitted the other Lots to the east
  • 10:42 - 10:51
are accessed by a drive that is going to
  • 10:47 - 10:53
allow for separate development plans for
  • 10:51 - 10:58
those foresight plans for those areas
  • 10:53 - 11:00
it's conceivable that those may come
  • 10:58 - 11:02
back with design exceptions depending on
  • 11:00 - 11:05
the specific building type design that
  • 11:02 - 11:09
gets built there but that is zoned annex
  • 11:05 - 11:13
to and allows for multi household
  • 11:09 - 11:14
development so that would be anticipated
  • 11:13 - 11:17
there I think they're still planning to
  • 11:14 - 11:19
follow through with the same program
  • 11:17 - 11:21
they had back when they initially tried
  • 11:19 - 11:25
to rezone this in the fall so or last
  • 11:21 - 11:27
    last year so I don't think they've
  • 11:25 - 11:30
changed our intentions I do want to
  • 11:27 - 11:35
point out there's some floodway in this
  • 11:30 - 11:36
area and floodplain and that's all zoned
  • 11:35 - 11:38
    with the flood designation they're
  • 11:36 - 11:41
essentially staying away from that with
  • 11:38 - 11:43
development that's going to serve as
  • 11:41 - 11:47
    open space for their site
  • 11:43 - 11:48
they're gonna I'll let the designer get
  • 11:47 - 11:52
up here and go over it but they're gonna
  • 11:48 - 11:55
reef reconfigure this to serve the
  • 11:52 - 11:59
    stormwater needs and they've they've
  • 11:55 - 12:03
done design work they're reshaping of
  • 11:59 - 12:06
the property to ensure that water that
  • 12:03 - 12:08
comes in that's coming on the west
  • 12:06 - 12:12
through the property to the west is
  • 12:08 - 12:14
managed properly and get taken to where
  • 12:12 - 12:18
it needs to go for any detention
  • 12:14 - 12:21
required and that that shouldn't be an
  • 12:18 - 12:26
impact in a hundred year or less
  • 12:21 - 12:28
frequent storms so right now our
  • 12:26 - 12:32
requirements and reviews are based on
  • 12:28 - 12:32
    100-year event so
  • 12:32 - 12:37
the and I'll let the designer again kind
  • 12:35 - 12:40
of explain any nuances if you're curious
  • 12:37 - 12:42
about how that works for that situation
  • 12:40 - 12:45
but I think that was kind of the big
  • 12:42 - 12:47
issue the other thing that was concerned
  • 12:45 - 12:52
kind of initially was the fire access
  • 12:47 - 12:53
and that's been addressed for the areas
  • 12:52 - 12:56
to the east the challenge to the east of
  • 12:53 - 12:58
course is getting access to it because
  • 12:56 - 13:01
you're not coming through the flood area
  • 12:58 - 13:05
and if the church is preventing access
  • 13:01 - 13:08
from the north directly so that was the
  • 13:05 - 13:10
fire marshal's office or fire prevention
  • 13:08 - 13:12
looked at that and they're they're
  • 13:10 - 13:15
    satisfied with what what's being
  • 13:12 - 13:19
proposed now with all the radius is on
  • 13:15 - 13:23
the streets and everything and then the
  • 13:19 - 13:28
trail the parks staff has worked with
  • 13:23 - 13:29
them to provide the trail alignment
  • 13:28 - 13:31
that's shown in the preliminary plot I
  • 13:29 - 13:34
think they will continue to work with
  • 13:31 - 13:36
parks to when that Parks is ready to
  • 13:34 - 13:38
move on that project because they're
  • 13:36 - 13:42
gonna have to also coordinate with other
  • 13:38 - 13:45
properties to the south and north to get
  • 13:42 - 13:48
that realignment to occur in fact you
  • 13:45 - 13:48
may see in the future a
  • 13:49 - 13:55
amendment to plan TSM and move DSM to
  • 13:52 - 13:58
add that into the system of the trail
  • 13:55 - 14:03
    system but staff is recommending
  • 13:58 - 14:08
approval of this subject to compliance
  • 14:03 - 14:10
    with all administrative review comments
  • 14:08 - 14:13
    [Music]
  • 14:10 - 14:13
    and then
  • 14:15 - 14:23
I'll make sure and then we want to make
  • 14:37 - 14:42
we want to make sure that there's an
  • 14:39 - 14:47
easement provided for the trail that
  • 14:42 - 14:48
parks and recreation is shown they may
  • 14:47 - 14:50
not show exactly as it is on the
  • 14:48 - 14:53
preliminary plat but once there's a
  • 14:50 - 14:57
final plat we will want that defined so
  • 14:53 - 14:59
that that gets dedicated with the final
  • 14:57 - 15:04
plan but there so there show it's shown
  • 14:59 - 15:06
generally in the preliminary plat final
  • 15:04 - 15:08
plat will have to be consistent with
  • 15:06 - 15:10
    that
  • 15:08 - 15:11
    any questions
  • 15:10 - 15:15
    [Music]
  • 15:11 - 15:17
no I'll let the Alette Brent from
  • 15:15 - 15:20
Schneider kind of give you more detail
  • 15:17 - 15:22
on that or if you have any questions
  • 15:20 - 15:25
about some of the concerns I think that
  • 15:22 - 15:25
    about
  • 15:31 - 15:37
okay please state your name and address
  • 15:33 - 15:37
and then sign the sheet please
  • 15:41 - 15:45

owner of both both of the entities on
  • 16:04 - 16:15
this site approximately 65 acres located
  • 16:08 - 16:19
just east of East 56th Street the 65
  • 16:15 - 16:22
bypass as Erica explained this is a
  • 16:19 - 16:27
floodplain down there it's a creek area
  • 16:22 - 16:29
this is a site where the end to a zoning
  • 16:27 - 16:36
is from here north that's a 60 foot wide
  • 16:29 - 16:38
lot in an area of 7,500 square feet and
  • 16:36 - 16:42
to the south at this point here south is
  • 16:38 - 16:44
the into a which is a 75 foot wide lot
  • 16:42 - 16:48
and nine thousand square foot minimum
  • 16:44 - 16:50
lot size this area to the east
  • 16:48 - 16:53
that's for correcting that Eric but
  • 16:50 - 16:55
three Lots over here will be a future
  • 16:53 - 16:58
preliminary plat but I mean we went
  • 16:55 - 17:01
through the rezoning last year in July
  • 16:58 - 17:04
August it was just there was an intent
  • 17:01 - 17:06
or the the requirements at that time was
  • 17:04 - 17:08
to kind of show intent so we'll come
  • 17:06 - 17:11
back and get that modified and probably
  • 17:08 - 17:14
has some design options or alternatives
  • 17:11 - 17:15
on that in the future so if you first
  • 17:14 - 17:17
    phase the development that they're
  • 17:15 - 17:21
looking at is approximately this this
  • 17:17 - 17:23
area up and through here so we are
  • 17:21 - 17:26
working through this has an existing
  • 17:23 - 17:29
pond in this area that will be enhanced
  • 17:26 - 17:32
to provide the storm water quality and
  • 17:29 - 17:36
water quality quantity that is required
  • 17:32 - 17:40
we've done it done an extensive modeling
  • 17:36 - 17:42
a swim model which is a very extensive
  • 17:40 - 17:44
model on how the stormwater works into
  • 17:42 - 17:46
the site through the site detains and
  • 17:44 - 17:49
    then
  • 17:46 - 17:53
location we will be required to and we
  • 17:49 - 17:56
are working with the DNR on a dam permit
  • 17:53 - 17:58
for that existing pond it's a newer pond
  • 17:56 - 18:01
but it would never did get a dam permit
  • 17:58 - 18:04
so we're keeping the embankment of the
  • 18:01 - 18:06
pond in place and kind of enlarging it
  • 18:04 - 18:08
to provide the required storm water
  • 18:06 - 18:08
through this that's required the city of
  • 18:08 - 18:13
    the north
  • 18:08 - 18:17
so utilities wre brought a sanitary
  • 18:13 - 18:19
sewer up through here it was last year I
  • 18:17 - 18:21
think they did the construction of it so
  • 18:19 - 18:24
that's available for us to connect on to
  • 18:21 - 18:28
and extend and we have the roadways
  • 18:24 - 18:34
itself and then water is located along
  • 18:28 - 18:37
56th Street there are some pretty major
  • 18:34 - 18:40
encumbrances with gas main coming up
  • 18:37 - 18:42
    through here and also overhead
  • 18:40 - 18:45
    transmission high-voltage overhead
  • 18:42 - 18:48
transmission through here so besides the
  • 18:45 - 18:49
floodplain and the interstate and we
  • 18:48 - 18:50
have all these other things that were
  • 18:49 - 18:52
kind of working around and and working
  • 18:50 - 18:54
    through that process with those
  • 18:52 - 18:58
    different entities itself
  • 18:54 - 19:03
during the course of approval at the
  • 18:58 - 19:06
council there was see this it might be
  • 19:03 - 19:09
easier on this side that the count one
  • 19:06 - 19:13
of the council members prior to this
  • 19:09 - 19:15
layout we have just lots here with side
  • 19:13 - 19:18
yard swales to accommodate there's two
  • 19:15 - 19:21
points of flow coming from this lot here
  • 19:18 - 19:23
council member requested that we not
  • 19:21 - 19:26
have lots there so as you can see with
  • 19:23 - 19:29
this design this whole area we removed
  • 19:26 - 19:30
those three Lots in here and so that he
  • 19:29 - 19:33
comes down out lot owned by the
  • 19:30 - 19:34
association so we're not trying to set
  • 19:33 - 19:36
the amount of fool coming off our
  • 19:34 - 19:40
neighbor to the west in between the lot
  • 19:36 - 19:43
lines so from there we gathered at up
  • 19:40 - 19:48
take it through a large box and out into
  • 19:43 - 19:48
the pond so on the south here
  • 19:50 - 19:55
and the south currently air flows go on
  • 19:53 - 19:59
to the neighbor and then down and out
  • 19:55 - 20:02
we're doing a console gathering it here
  • 19:59 - 20:05
and in a box boy that she's little off
  • 20:02 - 20:07
site taking it down to that same area
  • 20:05 - 20:09
the small sump and then out letting into
  • 20:07 - 20:10
the pond that kind of shows them the
  • 20:09 - 20:13
pond and the different levels of the
  • 20:10 - 20:16
pond that we're doing with that I'd be
  • 20:13 - 20:18
happy to answer any questions on any of
  • 20:16 - 20:21
the items on the fund a plat do you
  • 20:18 - 20:24
agree with the staff recommendations are
  • 20:21 - 20:24
you agreement with all those yes
  • 20:25 - 20:28
    questions
  • 20:29 - 20:38
okay thank you thank you anyone else
  • 20:32 - 20:38
here to speak in support of this project
  • 20:38 - 20:44
all right anyone want to speak in
  • 20:41 - 20:47
opposition okay please state your name
  • 20:44 - 20:50
address and then we need you to sign the
  • 20:47 - 20:50
sheet right there on the table
  • 20:53 - 20:56
    [Music]
  • 20:56 - 21:04
Matt Murphy 3301 East 56th Street maybe
  • 21:00 - 21:07
get me maybe get a little closer pull it
  • 21:04 - 21:11
    closer straight alright sorry
  • 21:07 - 21:15
    and so it's Matt Murphy
  • 21:11 - 21:19
I live at 3301 East 56th Street which is
  • 21:15 - 21:22
represented on the chart as n2a I think
  • 21:19 - 21:27
is right over the top of my house I was
  • 21:22 - 21:31
here in July offered my thoughts on what
  • 21:27 - 21:37
I think how this affects my property
  • 21:31 - 21:39
none of that has changed and Eric was
  • 21:37 - 21:40
good enough to give me a call at about
  • 21:39 - 21:45
    4:30 today
  • 21:40 - 21:47
and so I've just seen the new plan took
  • 21:45 - 21:51
me about 30 minutes to get here so I had
  • 21:47 - 21:53
about 30 minutes to digest what Snyder &
  • 21:51 - 21:56
Associates in John larceny are working
  • 21:53 - 22:01
to mitigate what was discussed the last
  • 21:56 - 22:03
time so I don't know if I'm in support
  • 22:01 - 22:06
or if I'm against this at this point
  • 22:03 - 22:08
because I've got about 30 minutes of
  • 22:06 - 22:12
looking at it what I see right off the
  • 22:08 - 22:16
bat is is while there is kind of a
  • 22:12 - 22:20
retention pond effect to that out lot
  • 22:16 - 22:22
that the Snyder associates identified if
  • 22:20 - 22:26
you look at the contour lines of it is a
  • 22:22 - 22:30
three foot maybe a three foot depression
  • 22:26 - 22:32
in the ground and so as it relates to
  • 22:30 - 22:35
draining off my property so that the
  • 22:32 - 22:39
water doesn't stand on my property I
  • 22:35 - 22:41
don't know if it does that or not I have
  • 22:39 - 22:45
to believe the civil engineers look at
  • 22:41 - 22:48
these things and they decide how this is
  • 22:45 - 22:50
gonna work I am also interested in the
  • 22:48 - 22:53
    hundred-year flood data I don't know
  • 22:50 - 22:55
when that hundred years started and when
  • 22:53 - 22:58
the next hundred years hits I just know
  • 22:55 - 23:02
that every year in a two to three inch
  • 22:58 - 23:05
rain which does occur we're draining the
  • 23:02 - 23:09
the property that is on the west side of
  • 23:05 - 23:12
    56th through two culverts
  • 23:09 - 23:14
that run on both sides of my property it
  • 23:12 - 23:19
runs 15 foot wide and about a foot and a
  • 23:14 - 23:23
half deep it is a lot of water and so as
  • 23:19 - 23:26
that gets down on the East End of my
  • 23:23 - 23:29
property it kind of splits off into two
  • 23:26 - 23:33
in two directions but generally runs to
  • 23:29 - 23:37
the pond so with what Snyder says has
  • 23:33 - 23:40
proposed here with an out lot in a
  • 23:37 - 23:42
anyway for that water to run off absorb
  • 23:40 - 23:46
however it's going to leave there I
  • 23:42 - 23:48
don't know if that works or not I would
  • 23:46 - 23:51
simply ask for time to take a look at it
  • 23:48 - 23:54
    I'll get a civil engineer they'll come
  • 23:51 - 23:58
out and basically read the plans and
  • 23:54 - 24:01
tell me is this gonna work or not so the
  • 23:58 - 24:05
last time I was here was July I was here
  • 24:01 - 24:08
for the past two hearings that it was on
  • 24:05 - 24:11
the agenda didn't get briefed but
  • 24:08 - 24:13
generally that is a lot of time for
  • 24:11 - 24:16
Snyder & Associates and john Larson and
  • 24:13 - 24:20
I have respect for both of them they're
  • 24:16 - 24:22
very successful in their businesses they
  • 24:20 - 24:25
had eight months to prepare what you see
  • 24:22 - 24:28
today I had 30 minutes to prepare
  • 24:25 - 24:30
    something in response
  • 24:28 - 24:35
so I would just ask for more time before
  • 24:30 - 24:37
it's approved I in and as I said the
  • 24:35 - 24:42
last time the property line that runs
  • 24:37 - 24:45
    between Karen Armstrong and myself
  • 24:42 - 24:46
everything north of that it has no
  • 24:45 - 24:48
    effect on me
  • 24:46 - 24:51
none whatsoever and so I think that that
  • 24:48 - 24:54
was approved before and I assume that
  • 24:51 - 24:57
it's still approved I have no objection
  • 24:54 - 24:59
to any of that I am only concerned about
  • 24:57 - 25:01
that area that is directly east of my
  • 24:59 - 25:02
property and how that affects my
  • 25:01 - 25:05
    property
  • 25:02 - 25:09
did I stand on my five minutes I don't
  • 25:05 - 25:11
know it's five questions thanks for your
  • 25:09 - 25:11
    consideration
  • 25:14 - 25:23
is there anyone else who wants to speak
  • 25:17 - 25:24
about this issue okay well close the
  • 25:23 - 25:29
    public hearing
  • 25:24 - 25:33
yeah Oh rebuttal do you want to sorry
  • 25:29 - 25:33
    thank you
  • 25:37 - 25:43
breck hope Snyder & Associates and we've
  • 25:41 - 25:46
been working I've got four engineers are
  • 25:43 - 25:49
engineers in our office has been working
  • 25:46 - 25:51
on a very extensive swim model that's
  • 25:49 - 25:54
associated with this we've worked with
  • 25:51 - 25:57
city staff we've got two engineers down
  • 25:54 - 25:59
there we've been working with probably
  • 25:57 - 26:02
since December working through all these
  • 25:59 - 26:06
questions and stuff so I mean this has
  • 26:02 - 26:08
been looked at and double looked at we
  • 26:06 - 26:11
would just assume because this delays a
  • 26:08 - 26:14
lot of things some tree removal items we
  • 26:11 - 26:17
had I mean we just assumed not delay it
  • 26:14 - 26:19
any further if that if that a
  • 26:17 - 26:22
consideration tonight so I mean we'd
  • 26:19 - 26:26
like to to move on so we could get
  • 26:22 - 26:29
    additional items done construction plans
  • 26:26 - 26:36
begins some grading operations and stuff
  • 26:29 - 26:36
so could you speed erector I mean yes
  • 26:37 - 26:41
I'm kind of kind of walk through that
  • 26:44 - 26:47
    net you hear all this
  • 26:48 - 26:53
yeah I want to make sure you can hear
  • 26:51 - 26:55
    yeah all right
  • 26:53 - 26:59
currently on insight part of our site
  • 26:55 - 27:00
flows onto his site there's a swale that
  • 26:59 - 27:02
comes down through here and a swale that
  • 27:00 - 27:05
    gums down through here
  • 27:02 - 27:07
these pipes outlet here on the west side
  • 27:05 - 27:09
and I'm not sure if the basins are built
  • 27:07 - 27:12
will be a storm water detention basins
  • 27:09 - 27:15
and kind of the metered flow there we
  • 27:12 - 27:22
opened all of this up here and set the
  • 27:15 - 27:22
road elevation at a moment please
  • 27:22 - 27:30
that said at 106 106 what happens in
  • 27:28 - 27:33
here is this water comes in it's not a
  • 27:30 - 27:35
detention to retention it's in a sum so
  • 27:33 - 27:39
when that water start building up it can
  • 27:35 - 27:42
get into the intake faster this is a 42
  • 27:39 - 27:45
inch pipe here this is a 24 and this
  • 27:42 - 27:48
one's of 24 so what we did at this
  • 27:45 - 27:52
location that you put a big 5x5 box is
  • 27:48 - 27:54
open on all five all four sides 100-year
  • 27:52 - 27:56
pipe out plus we set the run at an
  • 27:54 - 27:59
elevation when this starts filling up
  • 27:56 - 28:02
it'll go over the road before it flows
  • 27:59 - 28:05
back onto that or wouldn't flow back on
  • 28:02 - 28:06
it which is build up and go back on so I
  • 28:05 - 28:09
mean we've looked at that in great
  • 28:06 - 28:11
detail we've collected we've cut off the
  • 28:09 - 28:13
water that used to flow toward him cut
  • 28:11 - 28:15
it off here I put an intake in here put
  • 28:13 - 28:17
100-year pipe once again along in here
  • 28:15 - 28:20
and that would overflow down to our
  • 28:17 - 28:22
street so we've eliminated a lot of flow
  • 28:20 - 28:24
that used to go onto there that's not
  • 28:22 - 28:27
going to flow in there plus we set this
  • 28:24 - 28:29
at an elevation with the size of pipe to
  • 28:27 - 28:32
lower flow and head to the pond fired
  • 28:29 - 28:35
causing damage on the upstream property
  • 28:32 - 28:37
so I'd say we've been working up a
  • 28:35 - 28:41
    couple of the development engineers
  • 28:37 - 28:44
since December going through this so we
  • 28:41 - 28:45
got a lot of review a lot of discussion
  • 28:44 - 28:49
    not great
  • 28:45 - 28:53
where did this process go after we vote
  • 28:49 - 28:53
    on tonight staff
  • 28:56 - 29:01
so they would finalize the documents in
  • 28:59 - 29:04
    accordance with the administrative
  • 29:01 - 29:07
    comments plus your action my
  • 29:04 - 29:09
    understanding is they would submit
  • 29:07 - 29:14
    construction drawings and grading plan
  • 29:09 - 29:16
permit grading permit to begin moving
  • 29:14 - 29:19
earth on the site and so this goes back
  • 29:16 - 29:21
to the permit and development off well
  • 29:19 - 29:24
they have to sign off on all those
  • 29:21 - 29:27
    comments yeah I don't think there's a
  • 29:24 - 29:31
lot actually but they'll get the final
  • 29:27 - 29:35
document and then they will also have to
  • 29:31 - 29:36
    review public improvement plans that
  • 29:35 - 29:39
would actually go to I think they go to
  • 29:36 - 29:41
    City Council so the construction
  • 29:39 - 29:44
contracts get so what we're up against
  • 29:41 - 29:46
right now is the the bat habitat for
  • 29:44 - 29:49
April 15th we can't go in here and do
  • 29:46 - 29:51
tree removals after April 15th so if we
  • 29:49 - 29:54
delay it two weeks or four weeks it's
  • 29:51 - 29:57
just gonna it could delay the project
  • 29:54 - 29:59
for a year there's migrating bats so we
  • 29:57 - 30:02
have a couple projects like this around
  • 29:59 - 30:06
Des Moines if the trees don't get
  • 30:02 - 30:08
removed by the time their migration
  • 30:06 - 30:11
pattern hits Des Moines then they gotta
  • 30:08 - 30:15
be left for the for the duration of the
  • 30:11 - 30:15
season and then before they yeah
  • 30:17 - 30:22
questions other questions yes yes a
  • 30:20 - 30:24
question it would it be appropriate for
  • 30:22 - 30:34
Matt to ask a question or if he has one
  • 30:24 - 30:34
of the engineer now okay come on
  • 30:40 - 30:46
just put put the issue of the trees in
  • 30:43 - 30:49
perspective there are no trees except
  • 30:46 - 30:53
for well they're two trees but there's
  • 30:49 - 30:56
only one that is in the area that I'm
  • 30:53 - 30:57
    talking about and I and I don't I don't
  • 30:56 - 31:00
know if they're going to take the big
  • 30:57 - 31:02
weeping willow tree down it's about a 75
  • 31:00 - 31:04
year old tree it's a beautiful tree I
  • 31:02 - 31:05
hope they're not taking that down but I
  • 31:04 - 31:07
    don't think that's the tree they're
  • 31:05 - 31:10
talking about all those trees are to the
  • 31:07 - 31:14
    south of my property mmm
  • 31:10 - 31:17
so the area that I'm talking about again
  • 31:14 - 31:20
is just directly east of my property so
  • 31:17 - 31:22
nothing to the north nothing to the
  • 31:20 - 31:25
south concerns me with regards to the
  • 31:22 - 31:28
runoff of water from the property I do
  • 31:25 - 31:29
appreciate what they're talking about on
  • 31:28 - 31:31
the south side of the property with
  • 31:29 - 31:36
regard to how they're going to get that
  • 31:31 - 31:40
water to run off it that doesn't mean
  • 31:36 - 31:42
that much to me over there anything that
  • 31:40 - 31:44
they do on the south side of the
  • 31:42 - 31:49
property it's a forest reserve right now
  • 31:44 - 31:51
it can only beautify the area but again
  • 31:49 - 31:55
directly east of the property by the
  • 31:51 - 31:58
pond that is that's the area that I'm
  • 31:55 - 32:01
asking give me time allow me to have a
  • 31:58 - 32:04
civil engineer come in and explain what
  • 32:01 - 32:08
is going to happen and then that person
  • 32:04 - 32:10
can tell me about 100-year flood data
  • 32:08 - 32:13
whether that is correct or not I don't
  • 32:10 - 32:14
know it basically everybody right now is
  • 32:13 - 32:17
counting on 100-year flood data in a
  • 32:14 - 32:20
model I don't know what any of that
  • 32:17 - 32:22
means I'm so even based on his
  • 32:20 - 32:25
explanation you're still you would still
  • 32:22 - 32:27
like to have more time oh absolutely
  • 32:25 - 32:29
okay I just wanted to clarify this yeah
  • 32:27 - 32:32
I don't know how long it takes to to get
  • 32:29 - 32:35
a civil engineer to be able to that that
  • 32:32 - 32:38
I can hire to take a look at this but I
  • 32:35 - 32:42
can't imagine that it's gonna be in less
  • 32:38 - 32:44
than a month okay other questions okay
  • 32:42 - 32:46
thank you yes ma'am thank you
  • 32:44 - 32:50
well I'll close the public hearing and
  • 32:46 - 32:53
time for discussion sure what can we do
  • 32:50 - 32:53
    to make everybody happy
  • 32:55 - 33:03
I've got design expert down there what
  • 32:58 - 33:06
can we do to make everybody happy my
  • 33:03 - 33:08
opinion is that Snyder & Associates has
  • 33:06 - 33:11
looked at it and city staff has looked
  • 33:08 - 33:13
at it and what I see as the proposal
  • 33:11 - 33:15
he's not worried about the Southside
  • 33:13 - 33:17
he's worried about what comes off the
  • 33:15 - 33:20
west through the two pipes and sides
  • 33:17 - 33:23
sideswipes his property and heads off to
  • 33:20 - 33:26
the east what Bret has told us is that
  • 33:23 - 33:28
the the top level of the road that
  • 33:26 - 33:31
they're proposing through there is below
  • 33:28 - 33:33
the elevation of his property so to me
  • 33:31 - 33:35
the water that's flowing from those two
  • 33:33 - 33:38
pipes beside his property is going to
  • 33:35 - 33:40
flow down to the sump through a box
  • 33:38 - 33:41
culvert and if it gets too full it's
  • 33:40 - 33:43
still gonna flow across the top of the
  • 33:41 - 33:46
road so it's not going to affect his
  • 33:43 - 33:49
property so in my opinion as a landscape
  • 33:46 - 33:51
architect and not an engineer he's gonna
  • 33:49 - 33:55
waste his money by hiring an engineer
  • 33:51 - 34:02
but that's just me so I would say we
  • 33:55 - 34:02
should pass it on but that's my opinion
  • 34:02 - 34:09
that's a good opinion other other
  • 34:04 - 34:09
    thoughts perspectives
  • 34:09 - 34:14
would you wanna make a mold you make
  • 34:11 - 34:16
that as a motion Greg I move dad
  • 34:14 - 34:19
    [Music]
  • 34:16 - 34:21
thank you I don't have a problem with
  • 34:19 - 34:26
that I understand understanding that the
  • 34:21 - 34:31
road is lower than mr. Murphy's property
  • 34:26 - 34:33
word Brent go that true so that you got
  • 34:31 - 34:37
a belt and suspenders approach to this
  • 34:33 - 34:39
thing meaning say your 5 foot box gets
  • 34:37 - 34:40
backed up the water is going over the
  • 34:39 - 34:42
    road
  • 34:40 - 34:46
is that the way it happened that is
  • 34:42 - 34:49
correct I always learned that as I
  • 34:46 - 34:52
called it a free out so no matter what
  • 34:49 - 34:54
the mechanical device is the pipes and
  • 34:52 - 34:56
    everything you put stuff in
  • 34:54 - 34:58
you still need it's a stream and so you
  • 34:56 - 35:01
don't want to impede the stream and so
  • 34:58 - 35:03
that low point is lower than than a
  • 35:01 - 35:06
floor elevation or whatever you don't
  • 35:03 - 35:10
want to screw up and so it is so to me
  • 35:06 - 35:16
we've provided the free out that that
  • 35:10 - 35:16
allows it to flow away make sense to me
  • 35:16 - 35:21
it seems to me there are more systems in
  • 35:18 - 35:23
place with this plan to divert the water
  • 35:21 - 35:27
away from his property than there are
  • 35:23 - 35:29
currently so it seems like it would make
  • 35:27 - 35:32
    sense
  • 35:29 - 35:37
other comments will we have motion on
  • 35:32 - 35:40
the floor to approve staff all in favor
  • 35:37 - 35:40
    raise your right hand
  • 35:40 - 35:54
    opposed abstentions motion passes
  • 35:45 - 36:00
so thank you I hope that we got some
  • 35:54 - 36:03
questions answered yeah mr. Murphy will
  • 36:00 - 36:04
be able to follow actions at City
  • 36:03 - 36:06
Council that would be for the public
  • 36:04 - 36:08
    improvement plans
  • 36:06 - 36:11
the final plat will be for the first
  • 36:08 - 36:13
phase of this would go through the City
  • 36:11 - 36:16
Council so if he wants to track it
  • 36:13 - 36:19
through the process and we'll make
  • 36:16 - 36:21
available anything in the record that's
  • 36:19 - 36:24
    submitted for review or approval
  • 36:21 - 36:28
administrative Lea vailable to him if he
  • 36:24 - 36:29
wants to take that to his you know
  • 36:28 - 36:32
people that he wants to have a look at
  • 36:29 - 36:36
it but so as this moves forward there's
  • 36:32 - 36:38
still opportunity for him to in in weigh
  • 36:36 - 36:40
in on the process I should say well I
  • 36:38 - 36:42
imagine they're all talking they don't
  • 36:40 - 36:45
seem to be at each other's throat and I
  • 36:42 - 36:47
imagine that mr. Murphy could be invited
  • 36:45 - 36:50
to Snyder to see the modeling yeah I
  • 36:47 - 36:52
    think he said that before
  • 36:50 - 36:54
    [Applause]
  • 36:52 - 36:59
I have I have one comment Eric on
  • 36:54 - 37:02
section 8 of the staff report the last
  • 36:59 - 37:05
paragraph it says on December 15 2020
  • 37:02 - 37:07
the conditional zoning was repealed and
  • 37:05 - 37:12
    the existing zoning became effective
  • 37:07 - 37:14
yeah that's probably a bad day 2019 yeah
  • 37:12 - 37:16
I think so you can catch it and I have a
  • 37:14 - 37:19
question for mr. Murphy do you have a
  • 37:16 - 37:24
copy of the drawings that we were given
  • 37:19 - 37:26
I emailed the PDF to him that's the I
  • 37:24 - 37:31
think that's all he's talking about the
  • 37:26 - 37:37
30 minute opportunity but if Brent Brent
  • 37:31 - 37:39
submits the final four staff sign-off on
  • 37:37 - 37:42
the staff comments I will make that
  • 37:39 - 37:44
available to him as well so you have
  • 37:42 - 37:44
    there
  • 37:44 - 37:51
okay a close the public hearing
  • 37:48 - 37:58
do we have any committee ER directors
  • 37:51 - 37:59
reports all right thank you a motion to
  • 37:58 - 38:02
    adjourn
  • 37:59 - 38:02
    [Music]
  • 38:09 - 38:12
    [Music]
  • 38:18 - 38:22
    [Music]
