Clients asked me, what am I entitled to receive for child support or how much do I have to pay for child support? Well, it’s statutory, it’s govern by the Child Support Standards Act Guidelines.

First of all, we figure out each parties’ gross income and from gross the only deduction we take are New York City Tax and Social Security. Then for one child, you have to pay 17%, two children 25%, three children 29%, four children 31% of your gross figure. That gives you the basic child support.

In addition to that there are statutory add-ons, they are basically childcare expenses, un-reimburst medical expenses, possibly education expenses, possibly extracurricular expenses. This is the pay on top of the base figure and its paid of the proportion to the parties’ income.

The courts do have discretion, its not like you just punch them as you do calculator, they have discretion especially in cases involving high wage earners. This is where you need a lawyer who knows how to convince the judge to deviate from the guidelines and come up with the result that is most favorable to you.
