WEBVTT 99:59:59.999 --> 99:59:59.999 Right now, there's a lot happening with the Moon. 99:59:59.999 --> 99:59:59.999 China has announced plans for an inhabited South Pole station 99:59:59.999 --> 99:59:59.999 by the 2030s, 99:59:59.999 --> 99:59:59.999 and the United States has an official road map 99:59:59.999 --> 99:59:59.999 seeking an increasing number of people living and working in space. 99:59:59.999 --> 99:59:59.999 This will start with NASA's Artemis program, 99:59:59.999 --> 99:59:59.999 an international program to send the first woman and the next man 99:59:59.999 --> 99:59:59.999 to the Moon this decade. 99:59:59.999 --> 99:59:59.999 Billionaires and the private sector are getting involved 99:59:59.999 --> 99:59:59.999 in unprecedented ways. 99:59:59.999 --> 99:59:59.999 There are over a hundred launch companies around the world 99:59:59.999 --> 99:59:59.999 and roughly a dozen private lunar transportation companies 99:59:59.999 --> 99:59:59.999 readying robotic missions to the lunar surface. 99:59:59.999 --> 99:59:59.999 We have reusable rockets for the first time in human history. 99:59:59.999 --> 99:59:59.999 This will enable the development of infrastructure 99:59:59.999 --> 99:59:59.999 and utilization of resources. 99:59:59.999 --> 99:59:59.999 While estimates vary, scientists think 99:59:59.999 --> 99:59:59.999 there could be up to a billion metric tons of water ice on the Moon. 99:59:59.999 --> 99:59:59.999 That's greater than the size of Lake Erie, 99:59:59.999 --> 99:59:59.999 and enough water to support perhaps hundreds of thousands of people 99:59:59.999 --> 99:59:59.999 living and working on the Moon. 99:59:59.999 --> 99:59:59.999 So although official plans are always evolving, 99:59:59.999 --> 99:59:59.999 there's real reason to think that we could see people 99:59:59.999 --> 99:59:59.999 starting to live and work on the Moon in the next decade. 99:59:59.999 --> 99:59:59.999 However, the Moon is roughly the size of the continent of Africa, 99:59:59.999 --> 99:59:59.999 and we're starting to see that the key resources 99:59:59.999 --> 99:59:59.999 may be concentrated in small areas 99:59:59.999 --> 99:59:59.999 near the poles. 99:59:59.999 --> 99:59:59.999 This raises important questions about coordinating access to scarce resources, 99:59:59.999 --> 99:59:59.999 and there are also legitimate questions about going to the Moon: 99:59:59.999 --> 99:59:59.999 colonialism, cultural heritage, 99:59:59.999 --> 99:59:59.999 and reproducing the systemic inequalities of today's capitalism. 99:59:59.999 --> 99:59:59.999 And more to the point, 99:59:59.999 --> 99:59:59.999 don't we have enough big challenges here on Earth? 99:59:59.999 --> 99:59:59.999 Internet governance, pandemics, terrorism, 99:59:59.999 --> 99:59:59.999 and, perhaps most importantly, climate crisis and biodiversity loss. 99:59:59.999 --> 99:59:59.999 In some senses, 99:59:59.999 --> 99:59:59.999 the idea of the Moon as just a destination 99:59:59.999 --> 99:59:59.999 embodies these problematic qualities. 99:59:59.999 --> 99:59:59.999 It conjures a frontier attitude 99:59:59.999 --> 99:59:59.999 of conquest, 99:59:59.999 --> 99:59:59.999 big rockets and expensive projects, 99:59:59.999 --> 99:59:59.999 competition and winning. 99:59:59.999 --> 99:59:59.999 But what's most interesting about the Moon 99:59:59.999 --> 99:59:59.999 isn't the billionaires with their rockets, 99:59:59.999 --> 99:59:59.999 or the same old power struggle between states. 99:59:59.999 --> 99:59:59.999 In fact, it's not the hardware at all. 99:59:59.999 --> 99:59:59.999 It's the software. 99:59:59.999 --> 99:59:59.999 It's the norms, customs and laws. 99:59:59.999 --> 99:59:59.999 It's our social technologies. 99:59:59.999 --> 99:59:59.999 And it's the opportunity to update 99:59:59.999 --> 99:59:59.999 our democratic institutions 99:59:59.999 --> 99:59:59.999 and the rule of law 99:59:59.999 --> 99:59:59.999 to respond to a new era of planetary-scale challenges. 99:59:59.999 --> 99:59:59.999 I'm going to tell you about how the Moon can be a canvass 99:59:59.999 --> 99:59:59.999 for solving some of our biggest challenges here on Earth. NOTE Paragraph 99:59:59.999 --> 99:59:59.999 I've been kind obsessed with this topic 99:59:59.999 --> 99:59:59.999 since I was a teenager. 99:59:59.999 --> 99:59:59.999 I've spent the last two decades working on international space policy, 99:59:59.999 --> 99:59:59.999 but also on small community projects with bottom-up governance design. 99:59:59.999 --> 99:59:59.999 When I was 17, 99:59:59.999 --> 99:59:59.999 I went to a UN conference 99:59:59.999 --> 99:59:59.999 on the peaceful uses of outer space in Vienna. 99:59:59.999 --> 99:59:59.999 Over two weeks, 160 young people from over 60 countries 99:59:59.999 --> 99:59:59.999 were crammed into a big hotel next to the UN building. 99:59:59.999 --> 99:59:59.999 We were invited to make recommendations 99:59:59.999 --> 99:59:59.999 to Member States 99:59:59.999 --> 99:59:59.999 about the role of space in humanity's future. 99:59:59.999 --> 99:59:59.999 After the conference, 99:59:59.999 --> 99:59:59.999 some of us were so inspired 99:59:59.999 --> 99:59:59.999 that we actually decided to keep living together. 99:59:59.999 --> 99:59:59.999 Now, living with 20 people might sound kind of crazy, 99:59:59.999 --> 99:59:59.999 but over the years it enabled us to create a high-trust group 99:59:59.999 --> 99:59:59.999 that allowed us to experiment with these social technologies. 99:59:59.999 --> 99:59:59.999 We designed governance systems ranging from assigning a CEO 99:59:59.999 --> 99:59:59.999 to using a jury process, 99:59:59.999 --> 99:59:59.999 and as we grew into our careers, 99:59:59.999 --> 99:59:59.999 and we moved from DC think tanks to working for NASA 99:59:59.999 --> 99:59:59.999 to starting our own companies, 99:59:59.999 --> 99:59:59.999 these experiments enabled us to see 99:59:59.999 --> 99:59:59.999 how even small groups 99:59:59.999 --> 99:59:59.999 could be a petri dish 99:59:59.999 --> 99:59:59.999 for important societal questions such as representation, 99:59:59.999 --> 99:59:59.999 sustainability or opportunity. 99:59:59.999 --> 99:59:59.999 People often talk about the Moon 99:59:59.999 --> 99:59:59.999 as a petri dish, 99:59:59.999 --> 99:59:59.999 or even a blank slate, 99:59:59.999 --> 99:59:59.999 but because of the legal agreements 99:59:59.999 --> 99:59:59.999 that govern the Moon, 99:59:59.999 --> 99:59:59.999 it actually has something very important in common 99:59:59.999 --> 99:59:59.999 with our global challenges here on Earth. 99:59:59.999 --> 99:59:59.999 They both involve issues 99:59:59.999 --> 99:59:59.999 that require us to think beyond territory and borders, 99:59:59.999 --> 99:59:59.999 meaning the Moon is actually more of a template 99:59:59.999 --> 99:59:59.999 than a blank slate. NOTE Paragraph 99:59:59.999 --> 99:59:59.999 Signed in 1967, 99:59:59.999 --> 99:59:59.999 the Outer Space Treaty 99:59:59.999 --> 99:59:59.999 is the defining treaty governing activities in outer space, 99:59:59.999 --> 99:59:59.999 including the Moon, 99:59:59.999 --> 99:59:59.999 and it has two key ingredients 99:59:59.999 --> 99:59:59.999 that radically alter the basis 99:59:59.999 --> 99:59:59.999 on which laws can be constructed. 99:59:59.999 --> 99:59:59.999 The first is a requirement for free access to all areas of a celestial body. 99:59:59.999 --> 99:59:59.999 And the second is that the Moon and other celestial bodies 99:59:59.999 --> 99:59:59.999 are not subject to national appropriation. 99:59:59.999 --> 99:59:59.999 Now, this is crazy, 99:59:59.999 --> 99:59:59.999 because the entire earthly international system -- 99:59:59.999 --> 99:59:59.999 the United Nations, 99:59:59.999 --> 99:59:59.999 the system of treaties and international agreements, 99:59:59.999 --> 99:59:59.999 is built on the idea of state sovereignty, 99:59:59.999 --> 99:59:59.999 on the appropriation of land and resources within borders 99:59:59.999 --> 99:59:59.999 and the autonomy to control free access 99:59:59.999 --> 99:59:59.999 within those borders. 99:59:59.999 --> 99:59:59.999 By doing away with both of these, 99:59:59.999 --> 99:59:59.999 we create the conditions for what are called the commons. 99:59:59.999 --> 99:59:59.999 Based on the work 99:59:59.999 --> 99:59:59.999 of Nobel Prize-winning economist Elinor Ostrom, 99:59:59.999 --> 99:59:59.999 global commons are those resources that we all share, 99:59:59.999 --> 99:59:59.999 that require us to work together to manage and protect 99:59:59.999 --> 99:59:59.999 important aspects of our survival and wellbeing, 99:59:59.999 --> 99:59:59.999 like climate or the oceans. 99:59:59.999 --> 99:59:59.999 Commons-based approaches 99:59:59.999 --> 99:59:59.999 offer a greenfield for institution design 99:59:59.999 --> 99:59:59.999 that's only beginning to be explored 99:59:59.999 --> 99:59:59.999 at the global and interplanetary level. 99:59:59.999 --> 99:59:59.999 What do property rights look like, 99:59:59.999 --> 99:59:59.999 and how do we manage resources, 99:59:59.999 --> 99:59:59.999 when the traditional tools of external authority 99:59:59.999 --> 99:59:59.999 and private property don't apply? 99:59:59.999 --> 99:59:59.999 Though we don't have all the answers, 99:59:59.999 --> 99:59:59.999 climate, internet governance, authoritarianism, 99:59:59.999 --> 99:59:59.999 these are all deeply existential threats 99:59:59.999 --> 99:59:59.999 that we have failed to address with our current ways of thinking. 99:59:59.999 --> 99:59:59.999 Successful paths forward will require us to develop new tools. NOTE Paragraph 99:59:59.999 --> 99:59:59.999 So how do we incorporate commons-based logic 99:59:59.999 --> 99:59:59.999 into our global and space institutions? 99:59:59.999 --> 99:59:59.999 Well, here's one attempt 99:59:59.999 --> 99:59:59.999 that came from an unlikely source. 99:59:59.999 --> 99:59:59.999 As a young activist in World War II, 99:59:59.999 --> 99:59:59.999 Arvid Pardo was arrested for anti-fascist organizing 99:59:59.999 --> 99:59:59.999 and held under death sentence by the Gestapo. 99:59:59.999 --> 99:59:59.999 After the war, 99:59:59.999 --> 99:59:59.999 he worked his way into the diplomatic corps, 99:59:59.999 --> 99:59:59.999 eventually becoming 99:59:59.999 --> 99:59:59.999 the first permanent representative of Malta to the United Nations. 99:59:59.999 --> 99:59:59.999 Pardo saw that international law did not have the tools 99:59:59.999 --> 99:59:59.999 to address management of shared global resources, 99:59:59.999 --> 99:59:59.999 such as the high seas. 99:59:59.999 --> 99:59:59.999 He also saw an opportunity to advocate for equitable sharing between nations. 99:59:59.999 --> 99:59:59.999 In 1967, Pardo gave a famous speech to the United Nations 99:59:59.999 --> 99:59:59.999 introducing the idea 99:59:59.999 --> 99:59:59.999 that the oceans and their resources 99:59:59.999 --> 99:59:59.999 were the "common heritage of mankind." 99:59:59.999 --> 99:59:59.999 The phrase was eventually adopted as part of the Law of the Sea Treaty, 99:59:59.999 --> 99:59:59.999 probably the most sophisticated commons management regime 99:59:59.999 --> 99:59:59.999 on the planet today. 99:59:59.999 --> 99:59:59.999 It was seen as a watershed moment, 99:59:59.999 --> 99:59:59.999 a constitution for the seas. 99:59:59.999 --> 99:59:59.999 But the language proved so controversial 99:59:59.999 --> 99:59:59.999 that it took over 12 years to gain enough signatures 99:59:59.999 --> 99:59:59.999 for the treaty to enter into force, 99:59:59.999 --> 99:59:59.999 and some states still refuse to sign it. 99:59:59.999 --> 99:59:59.999 The objection was not so much about sharing per se, 99:59:59.999 --> 99:59:59.999 but the obligation to share. 99:59:59.999 --> 99:59:59.999 States felt that the principle of equality 99:59:59.999 --> 99:59:59.999 undermined their autonomy 99:59:59.999 --> 99:59:59.999 and state sovereignty, 99:59:59.999 --> 99:59:59.999 the same autonomy and state sovereignty 99:59:59.999 --> 99:59:59.999 that underpins international law. 99:59:59.999 --> 99:59:59.999 So in many ways, 99:59:59.999 --> 99:59:59.999 the story of the common heritage principle 99:59:59.999 --> 99:59:59.999 is a tragedy, 99:59:59.999 --> 99:59:59.999 but it's powerful because it makes plain the ways 99:59:59.999 --> 99:59:59.999 in which the current world order 99:59:59.999 --> 99:59:59.999 will put up antibodies and defenses 99:59:59.999 --> 99:59:59.999 and resist attempts at structural reform. 99:59:59.999 --> 99:59:59.999 But here's the thing: 99:59:59.999 --> 99:59:59.999 the outer space treaty has already made these structural reforms. 99:59:59.999 --> 99:59:59.999 At the height of the Cold War, 99:59:59.999 --> 99:59:59.999 terrified that each would get to the Moon first, 99:59:59.999 --> 99:59:59.999 the United States and the USSR 99:59:59.999 --> 99:59:59.999 made the Westphalian equivalent of a deal with the devil. 99:59:59.999 --> 99:59:59.999 By requiring free access and preventing territorial appropriation, 99:59:59.999 --> 99:59:59.999 we are required to redesign our most basic institutions 99:59:59.999 --> 99:59:59.999 and perhaps in doing so 99:59:59.999 --> 99:59:59.999 learn something new we can apply here on Earth. NOTE Paragraph 99:59:59.999 --> 99:59:59.999 So although the Moon might seem a little far away sometimes, 99:59:59.999 --> 99:59:59.999 how we answer basic questions now 99:59:59.999 --> 99:59:59.999 will set precedent for who has a seat at the table 99:59:59.999 --> 99:59:59.999 and what consent looks like, 99:59:59.999 --> 99:59:59.999 and these are questions of social technology, 99:59:59.999 --> 99:59:59.999 not rockets and hardware. NOTE Paragraph 99:59:59.999 --> 99:59:59.999 In fact, these conversations are starting to happen right now. 99:59:59.999 --> 99:59:59.999 The space community is discussing basic shared agreements 99:59:59.999 --> 99:59:59.999 such as, how do we designate lunar areas as heritage sites? 99:59:59.999 --> 99:59:59.999 And how do we get permission for where to land 99:59:59.999 --> 99:59:59.999 when traditional external authority 99:59:59.999 --> 99:59:59.999 doesn't apply? 99:59:59.999 --> 99:59:59.999 How do we enforce requirements for coordination 99:59:59.999 --> 99:59:59.999 when it's against the rules to tell people where to go? 99:59:59.999 --> 99:59:59.999 And how do we manage access to scarce resources 99:59:59.999 --> 99:59:59.999 such as water, minerals, 99:59:59.999 --> 99:59:59.999 or even the peaks of eternal light, 99:59:59.999 --> 99:59:59.999 craters that sit at just the right latitude 99:59:59.999 --> 99:59:59.999 to receive near constant exposure to sunlight, and therefore power? NOTE Paragraph 99:59:59.999 --> 99:59:59.999 Now, some people think that the lack of rules on the Moon 99:59:59.999 --> 99:59:59.999 is terrifying. 99:59:59.999 --> 99:59:59.999 And there are legitimately some terrifying elements of it. 99:59:59.999 --> 99:59:59.999 If there are no rules on the Moon, 99:59:59.999 --> 99:59:59.999 then won't we end up in a first-come, first-served situation? 99:59:59.999 --> 99:59:59.999 And we might, 99:59:59.999 --> 99:59:59.999 if we dismiss this moment. 99:59:59.999 --> 99:59:59.999 But not if we're willing to be bold 99:59:59.999 --> 99:59:59.999 and to engage the challenge. 99:59:59.999 --> 99:59:59.999 As we learned in our communities of self-governance, 99:59:59.999 --> 99:59:59.999 it's easier to create something new than trying to dismantle the old. 99:59:59.999 --> 99:59:59.999 And where else but the Moon 99:59:59.999 --> 99:59:59.999 can we prototype new institutions at global scale 99:59:59.999 --> 99:59:59.999 in a self-contained environment with the exact design constraints needed 99:59:59.999 --> 99:59:59.999 for our biggest challenges here on Earth? 99:59:59.999 --> 99:59:59.999 Back in 1999, 99:59:59.999 --> 99:59:59.999 the United Nations taught a group of young space geeks 99:59:59.999 --> 99:59:59.999 that we could think bigger, 99:59:59.999 --> 99:59:59.999 that we could impact nations if we chose to. 99:59:59.999 --> 99:59:59.999 Today, the stage is set for the next step, 99:59:59.999 --> 99:59:59.999 to envision what comes after 99:59:59.999 --> 99:59:59.999 territory and borders.
