Why are drug prices so high? Investigating the outdated US patent system

    who I had strictly put
    in the friend zone at the time,

    came over to my house and met my dad,

    a pharmaceutical scientist
    who had just retired
  • 0:20 - 0:22
    after bringing a drug to market.
  • 0:22 - 0:24
    My dad said,
  • 0:24 - 0:26
    "Ah, you probably
    wouldn't have heard of it.
  • 0:26 - 0:27
    It's for IPF,
  • 0:27 - 0:30
    idiopathic pulmonary fibrosis."
  • 0:31 - 0:35
    Rudy paused for a long time,
    and then he said,
  • 0:35 - 0:39
    "That's the disease that took
    my father's life 15 years ago."
  • 0:40 - 0:43
    Rudy says that this
    is the moment he fell in love.
  • 0:43 - 0:45
    (Laughter)

    With my father.
  • 0:46 - 0:48
    (Laughter)

    Even though it was too late
    for my dad to save his,
  • 0:52 - 0:56
    he felt that destiny had delivered us
    this full-circle moment.

    In my family, we have a special love
    for my father's inventions.
  • 1:02 - 1:05
    And in particular, we have
    a reverence for his patents.
  • 1:05 - 1:09
    We have framed patents
    on the wall in our house.
  • 1:10 - 1:15
    And there's a recognition in our family
    that everything I've been able to do --
  • 1:15 - 1:18
    college, law school,
    health justice work --
  • 1:18 - 1:21
    all of it is because America
    enabled my father
  • 1:21 - 1:25
    to fulfill his potential as an inventor.
  • 1:25 - 1:30
    (Applause)
  • 1:30 - 1:34
    Last year, I met the director
    of the US Patent Office
  • 1:34 - 1:35
    for the first time,
  • 1:35 - 1:39
    and I sent my family a selfie
    from that office in Virginia.
  • 1:39 - 1:40
    (Laughter)
  • 1:40 - 1:42
    I got so many emojis back,
  • 1:42 - 1:44
    you would have thought I had met Beyoncé.
  • 1:44 - 1:46
    (Laughter)
  • 1:46 - 1:47
    But truth be told,
  • 1:47 - 1:50
    I was actually there
    to talk about a problem --
  • 1:50 - 1:55
    how our outdated patent system
    is fueling the high cost of medicines
  • 1:55 - 1:57
    and costing lives.
  • 1:57 - 2:02
    Today, over two billion people
    live without access to medicines.
  • 2:02 - 2:04
    And against this global crisis,
  • 2:04 - 2:06
    drug prices are skyrocketing,
  • 2:06 - 2:08
    including in wealthier countries.
  • 2:08 - 2:13
    Thirty-four million Americans
    have lost a family member or a friend
  • 2:13 - 2:15
    in the last five years,
  • 2:15 - 2:17
    not because the treatment didn't exist,
  • 2:17 - 2:20
    but because they couldn't afford it.
  • 2:20 - 2:24
    Rising drug costs are pushing
    families into homelessness,
  • 2:24 - 2:27
    seniors into bankruptcy
  • 2:27 - 2:31
    and parents to crowdfunding treatment
    for their critically ill children.
  • 2:32 - 2:35
    There are many reasons for this crisis,
  • 2:35 - 2:38
    but one is the outdated patent system
  • 2:38 - 2:42
    that America tries to export
    to the rest of the world.
  • 2:43 - 2:46
    The original intention
    behind the patent system
  • 2:46 - 2:48
    was to motivate people to invent
  • 2:48 - 2:52
    by rewarding them
    with a time-limited monopoly.
  • 2:52 - 2:56
    But today, that intention
    has been distorted beyond recognition.
  • 2:57 - 3:00
    Corporations have teams
    of lawyers and lobbyists
  • 3:00 - 3:05
    whose sole job is to extend
    patent protection as long as possible.
  • 3:06 - 3:09
    And they've kept the patent office busy.
  • 3:09 - 3:12
    It took 155 years for the US Patent Office
  • 3:12 - 3:15
    to issue its first five million patents.
  • 3:15 - 3:20
    It took just 27 years
    for it to issue the next five million.
  • 3:21 - 3:24
    We haven't gotten
    drastically more inventive.
  • 3:24 - 3:28
    Corporations have gotten
    drastically better at gaming the system.
  • 3:29 - 3:31
    Drug patents have exploded --
  • 3:31 - 3:36
    between 2006 and 2016, they doubled.
  • 3:36 - 3:38
    But consider this:
  • 3:39 - 3:44
    The vast majority of medicines
    associated with new drug patents
  • 3:44 - 3:46
    are not new.
  • 3:46 - 3:50
    Nearly eight out of 10
    are for existing ones,
  • 3:50 - 3:53
    like insulin or aspirin.
  • 3:53 - 3:57
    My organization,
    a team of lawyers and scientists,
  • 3:57 - 4:03
    recently conducted an investigation
    into the 12 best-selling drugs in America.
  • 4:03 - 4:05
    We found that, on average,
  • 4:05 - 4:10
    there are 125 patents
    filed on each medicine.
  • 4:10 - 4:13
    Often for things we've known
    how to do for decades,
  • 4:13 - 4:16
    like putting two pills into one.
  • 4:17 - 4:20
    The higher a patent wall a company builds,
  • 4:20 - 4:23
    the longer they hold on to their monopoly.
  • 4:23 - 4:25
    And with no one to compete with,
  • 4:25 - 4:27
    they can set prices at whim.
  • 4:27 - 4:29
    And because these are medicines
  • 4:29 - 4:31
    and not designer watches,
  • 4:31 - 4:34
    we have no choice but to pay.
  • 4:35 - 4:39
    The patent wall is a strategy
    to block competition.
  • 4:39 - 4:42
    Not for the 14 years maximum
  • 4:42 - 4:46
    that America's founders
    originally envisioned,
  • 4:46 - 4:49
    or the 20 years allowed by law today,
  • 4:49 - 4:52
    but for 40 years or more.
  • 4:53 - 4:57
    Meanwhile, prices on these drugs
    have continued to increase --
  • 4:57 - 5:00
    68 percent since 2012.
  • 5:00 - 5:04
    That's seven times the rate of inflation.
  • 5:05 - 5:07
    And people are struggling or even dying,
  • 5:07 - 5:10
    because they can't afford the meds.
  • 5:11 - 5:13
    Now I want to be really clear
    about something.
  • 5:13 - 5:17
    This isn't about making
    the pharmaceutical industry the bad guy.
  • 5:18 - 5:20
    What I'm talking about today
  • 5:20 - 5:24
    is whether the system we created
    to promote progress
  • 5:24 - 5:26
    is actually working as intended.
  • 5:27 - 5:31
    Sure, the pharmaceutical companies
    are gaming the system,
  • 5:31 - 5:34
    but they're gaming it because they can.
  • 5:34 - 5:38
    Because we have failed
    to adapt this system
  • 5:38 - 5:40
    to meet today's realities.
  • 5:40 - 5:42
    The government is handing out
  • 5:42 - 5:45
    one of the most prized
    rewards in business --
  • 5:45 - 5:50
    the opportunity to create a product
    that is protected from competition --
  • 5:50 - 5:54
    and asking for less and less
    in return on our behalf.
  • 5:55 - 6:01
    Imagine awarding 100 Pulitzer Prizes
    to one author for the same book.
  • 6:01 - 6:02
    (Murmurs)
  • 6:03 - 6:05
    It doesn't have to be this way.
  • 6:05 - 6:08
    We can create a modern patent system
  • 6:08 - 6:11
    to meet the needs
    of a 21st-century society.
  • 6:11 - 6:12
    And to do that,
  • 6:12 - 6:16
    we need to reimagine the patent system
    to serve the public,
  • 6:16 - 6:18
    not just corporations.
  • 6:19 - 6:20
    So how do we do it?
  • 6:21 - 6:22
    Five reforms.
  • 6:23 - 6:26
    First, we need to stop
    handing out so many patents.
  • 6:27 - 6:29
    Back under the Kennedy administration,
  • 6:29 - 6:33
    in an effort to curb rising drug costs,
  • 6:33 - 6:36
    a congressman from Tennessee
    proposed an idea.
  • 6:36 - 6:38
    He said,
  • 6:38 - 6:39
    "If you want to tweak a drug,
  • 6:39 - 6:42
    and you want to get another patent on it,
  • 6:42 - 6:46
    the modified version has to be
    significantly better, therapeutically,
  • 6:46 - 6:47
    for patients."
  • 6:47 - 6:49
    Because of intense lobbying,
  • 6:49 - 6:52
    this idea never saw the light of day.
  • 6:52 - 6:55
    But a reimagined patent system
  • 6:55 - 7:00
    would resurrect and evolve
    this simple, yet elegant proposition.
  • 7:00 - 7:02
    That to get a patent,
  • 7:02 - 7:05
    you have to invent something
    substantially better
  • 7:05 - 7:07
    than what's already out there.
  • 7:07 - 7:09
    This shouldn't be controversial.
  • 7:09 - 7:11
    As a society,
  • 7:11 - 7:15
    we reserve the big rewards
    for the big ideas.
  • 7:15 - 7:19
    We don't give Michelin stars
    to chefs who just tweak a recipe --
  • 7:19 - 7:24
    we give them to chefs who change
    how we think about food.
  • 7:24 - 7:27
    And yet, we hand out patents
    worth billions of dollars
  • 7:27 - 7:28
    for minor changes.
  • 7:29 - 7:30
    It's time to raise the bar.
  • 7:31 - 7:33
    Second,
  • 7:33 - 7:38
    we need to change the financial incentives
    of the Patent Office.
  • 7:38 - 7:40
    Right now, the revenue
    of the Patent Office
  • 7:40 - 7:44
    is directly linked to the number
    of patents that it grants.
  • 7:45 - 7:51
    That's like private prisons
    getting paid more to hold more people --
  • 7:51 - 7:55
    it naturally leads to more incarceration,
  • 7:55 - 7:56
    not less.
  • 7:56 - 7:59
    The same is true for patents.
  • 8:00 - 8:04
    Third, we need more public participation.
  • 8:04 - 8:07
    Right now, the patent system
    is like a black box.
  • 8:07 - 8:13
    It's a two-way conversation
    between the patent office and industry.
  • 8:13 - 8:16
    You and I aren't invited to that party.
  • 8:16 - 8:19
    But imagine if instead,
  • 8:19 - 8:24
    the Patent Office became a dynamic center
    for citizen learning and ingenuity,
  • 8:24 - 8:28
    staffed not just by technical
    experts and bureaucrats,
  • 8:28 - 8:32
    but also by great
    public-health storytellers
  • 8:32 - 8:34
    with a passion for science.
  • 8:34 - 8:38
    Regular citizens could get
    accessible information
  • 8:38 - 8:40
    about complex technologies
  • 8:40 - 8:44
    like artificial intelligence
    or gene editing,
  • 8:44 - 8:49
    enabling us to participate
    in the policy conversations
  • 8:49 - 8:52
    that directly impact our health and lives.
  • 8:54 - 8:55
    Fourth,
  • 8:56 - 8:59
    we need to get the right to go to court.
  • 8:59 - 9:03
    Right now in America,
    after a patent is granted,
  • 9:03 - 9:06
    the public has no legal standing.
  • 9:06 - 9:11
    Only those with a commercial interest,
    usually other drug companies,
  • 9:11 - 9:12
    have that right.
  • 9:13 - 9:16
    But I've witnessed firsthand
    how lives can be saved
  • 9:16 - 9:20
    when everyday citizens
    have the right to go to court.
  • 9:21 - 9:23
    Back in 2006 in India,
  • 9:23 - 9:26
    my organization worked
    with patient advocates
  • 9:26 - 9:30
    to challenge, legally,
    unjust HIV drug patents,
  • 9:31 - 9:33
    at a time when so many people were dying,
  • 9:33 - 9:36
    because medicines
    were priced out of reach.
  • 9:36 - 9:39
    We were able to bring down
    the prices of medicines
  • 9:39 - 9:41
    by up to 87 percent.
  • 9:41 - 9:46
    (Applause)
  • 9:46 - 9:48
    On just three drugs,
  • 9:48 - 9:52
    we were able to save health systems
    half a billion dollars.
  • 9:52 - 9:57
    Now, cases like these
    can save millions of lives
  • 9:57 - 9:59
    and billions of dollars.
  • 9:59 - 10:03
    Imagine if Americans
    had the right to go to court, too.
  • 10:05 - 10:09
    And lastly, we need stronger oversight.
  • 10:10 - 10:15
    We need an independent unit
    that can serve as a public advocate,
  • 10:16 - 10:19
    regularly monitoring the activities
    of the Patent Office
  • 10:19 - 10:21
    and reporting to Congress.
  • 10:22 - 10:24
    If a unit like this had existed,
  • 10:24 - 10:28
    it would have caught, for example,
    the Silicon Valley company Theranos
  • 10:28 - 10:32
    before it got so many patents
    for blood testing
  • 10:32 - 10:36
    and landed an evaluation
    of nine billion dollars,
  • 10:36 - 10:37
    when in reality,
  • 10:37 - 10:39
    there was no invention there at all.
  • 10:40 - 10:45
    This kind of accountability
    is going to become increasingly urgent.
  • 10:45 - 10:47
    In the age of 23andMe,
  • 10:47 - 10:49
    important questions are being asked
  • 10:49 - 10:52
    about whether companies
    can patent and sell
  • 10:52 - 10:56
    our genetic information
    and our patient data.
  • 10:56 - 10:59
    We need to be part of those conversations
  • 10:59 - 11:00
    before it's too late.
  • 11:01 - 11:05
    Our information is being used
    to create the new therapies.
  • 11:05 - 11:10
    And when that moment of diagnosis
    comes for me and my family,
  • 11:10 - 11:12
    or for you and yours,
  • 11:12 - 11:16
    are we going to have to crowdfund
    to save the lives of those we love?
  • 11:17 - 11:19
    That's not the world I want to live in.
  • 11:19 - 11:23
    It's not the world I want
    for my two-year-old son.
  • 11:24 - 11:28
    My dad is growing older now,
  • 11:28 - 11:33
    and he is still as quietly brilliant
    and morally directed as ever.

    Sometimes people ask us
    whether things get heated between us:
  • 11:37 - 11:39
    the patent-holding scientist
  • 11:39 - 11:42
    and his patent-reforming lawyer daughter.
  • 11:43 - 11:48
    It's such a profound misunderstanding
    of what's at stake,
  • 11:48 - 11:52
    because this is not
    about scientists versus activists,
  • 11:52 - 11:55
    or invention versus protection.
  • 11:55 - 11:57
    This is about people,
  • 11:57 - 12:00
    our quest to invent and our right to live.

    My dad and I understand
    that our ingenuity and our dignity
  • 12:05 - 12:07
    go hand in hand.
  • 12:07 - 12:10
    We are on the same side.

    It is time to reimagine a patent system

    that reflects that knowing.
