John Berman on what's at stake in January 6 investigation

  • 0:00 - 0:04
    Our Democratic lawmakers investigating
the first coup attempt this country
  • 0:04 - 0:07
has ever seen, taking a butter knife to a
    gun fight?
  • 0:07 - 0:10
Or will they, as they're signaling
    tonight,
  • 0:10 - 0:11
truly get tough on those who stand
  • 0:11 - 0:15
    between them and the truth?
Also, did President Biden just wheel a
  • 0:15 - 0:18
    Howitzer into battle?
John Berman here, in for Anderson,
  • 0:18 - 0:20
A string of new developments to bring you
  • 0:20 - 0:23
from both ends of Pennsylvania Avenue.
  • 0:23 - 0:27
They all touch on this: whether those who
tried to undermine democracy itself will
  • 0:27 - 0:31
be held accountable. Because as one
    political observer Tweeted today,
  • 0:31 - 0:37
"An unpunished coup is a training
exercise." Those are the stakes as the
  • 0:37 - 0:41
    committee tries to enforce subpoenas
on four ex-Trump aids and allies. As of
  • 0:41 - 0:46
tonight, only two, former White House
    Chief-of-Staff Mark Meadows and former
  • 0:46 - 0:50
Pentagon official Kash Patel, are even
engaging at all in the process after a
  • 0:50 - 0:53
    midnight deadline came for producing
    documents came and went;
  • 0:53 - 0:55
    and that's the committee's word,
    by the way.
  • 0:55 - 0:58
    Engaging,
which could mean anything, and is a far
  • 0:58 - 1:03
cry from cooperating. Dan Scavino, it's
not clear whether he has responded at all,
  • 1:03 - 1:08
or has even been served. However, he has
not even mentioned in the joint statement
  • 1:08 - 1:12
from the committee chair Benny Thompson and
vice chair Liz Cheney. As for Steve
  • 1:12 - 1:17
Bannon, he's flat out defying the
committee. His lawyer, citing the former
  • 1:17 - 1:21
    president's executive privilege, which is
a pretty braising claim to make given
  • 1:21 - 1:26
that Bannon hasn't worked in the White
House since 2017. And for the record,
  • 1:26 - 1:34
    January 6, 2021 wasn't in 2017. Bannon is
acting on the former president's orders
  • 1:34 - 1:38
A trump lawyer last night, telling all
four not to comply. As you know, the
  • 1:38 - 1:42
former president has made it clear,
he no longer even sees January 6 as a
  • 1:42 - 1:48
thing, saying this week, the real
insurrection was on election day. And last
  • 1:48 - 1:53
night on Fox, he made his contempt plain
for those who have tried and failed to
  • 1:53 - 1:59
hold him accountable. "They had fake
    impeachments, two fake impeachments, where
  • 1:59 - 2:03
the Republicans were great, I have to say,
they stuck with us. The whole thing was
  • 2:03 - 2:09
fake, and I had to survive. And to survive
you had to be tough. And you had to be out
  • 2:09 - 2:15
there. You didn't have time to be
necessarily dainty and nice." 'Dainty and
  • 2:15 - 2:20
nice,' or as it used to be called,
following the rules, obeying the law, that
  • 2:20 - 2:24
sort of thing. Faced with that kind of
attitude, the Biden White House todau
  • 2:24 - 2:29
broke a tradition, saying the president
would not invoke executive privilege over
  • 2:29 - 2:33
Trump documents sought from the national
archives by the select committee. In other
  • 2:33 - 2:37
words, Biden would allow the release. So
there is now a conflict, because we
  • 2:37 - 2:42
learned late today that the former
president has sent a letter to the
  • 2:42 - 2:46
    archives asserting privilege and threatening
to, quote "take all necessary and
  • 2:46 - 2:51
appropriate steps to protect the office
of the presidency." And President Biden?
  • 2:51 - 2:57
Listen to how his press secretary framed
it. "The administration takes the events
  • 2:57 - 3:02
of January 6 incredibly seriously. As the
president said on its six month
  • 3:02 - 3:07
anniversary, that day posed as an existential
crisis and a test of whether our democracy
  • 3:07 - 3:12
    could survive." 'Whether our democracy
could survive.' That's really something to
  • 3:12 - 3:16
hear from anyone, let alone someone
speaking for the president. It's also
  • 3:16 - 3:17
    where we are tonight.
