So, for answering the essay questions,
you should include the law in your answer.

After all, this is a Business Law course.

And to get full credit on the essay
responses, you need to name the law.

For example, if a case involves an issue
with due process under the Fifth
-
Amendment, some students might be inclined
to say,

in response,
-
"Okay, John Doe, his rights have been
violated because he didn't know about
-
the hearing."
-
And although that's perhaps the right
conclusion, depending on the facts, there
-
are some important steps that were
skipped.
-
So, when you answer an essay question,
start with the law, name the law.
-
"This case involves the Due Process
Clause of the Fifth Amendment."
-
Then, tell me what that is.
-
The Due Process Clause, or the relevant
part, here, requires notice and a hearing.
-
And then, tie it to the facts.
-
"John Doe didn't get notice of the
hearing and therefore his rights were
-
violated."
-
Or, perhaps, "No hearing was done and
therefore his rights were violated."
-
And that is the key to getting full credit
on the essay questions.

You need to set yourself apart from
the students who don't know what the
-
law is and they're just taking a guess,
right?
-
They're avoiding the law, just coming up
wth the conclusion because they don't have
-
that information. They don't know what
the law is.
-
So, if you know what the law is, you need
to set yourself apart by telling me what
-
the law is in your response.
-
